HomeMy WebLinkAboutTB-05/07/1963 MEETING OF MAY 7, .196,3. The Southold Town Board met at the office of Supervisor Lester M. Albertson, 16 South Street, Greenport, New York, on May 7, 1963 . The meeting was called. to order at 3: 00 P.M. with the following present: . Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill . and Clark; Supt. of Highways Price; Town Attorney ,Taskbr and Town Clerk Richmond. Several. people of the Town attended the Board meeting, many of whom were interested in the Sign Ordinance. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of April 23, 1963, be and they hereby are duly approved. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That the regular meeting of the Town Board will ,be held at the office of the Supervisor, Lester M. Albertson, on Tuesday, May 28, 1963, at 3: 00 P.M. Vote of__ _Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl_; Justices. Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS,. the Town Board on its 'awn motion by resolution adopted on the 7th day of March,.. 1963, proposed certain amendments in the Build- ing Zone Ordinance of the Town of Southold, Suffolk County, New York, and WHEREAS, the said matter was referred to the Planning Board for its official recommendation and report, and WHEREAS, thereafter, the Town Board pursuant to due notice thereof, held a hearing thereon on April 9, 1963 at .which time all interested persons wereXgiven an opportunity to be heard, and WHEREAS, the Town Board thereafter considered the evidence given at said hearing and considered said matter'.at length, NOW, THEREFORE, BE IT RESOLVED: That the said proposed amendments to the Southold Town Building Zone Ordinance be not adopted. Vote of Town Board: Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. (Copy of amendment not adopted) 1. By amending Article III, Section 300, Subdivision It of the Building Zone Ordinance. of the Town of Southold to read as follows; 11. When authorized as a special exception by the Board of Appeals as hereinafter provided, one (1) sign, single or double- faced, not more than four (4) feet in height and eight (8) feet in' width, the lower edge of which shall be. not less than two (2) feet above the ground and the. upper edge of which shall not extend more than six (6) feet above the ground, provided, however, that such sign shall be set back not less than thirty-five (35) feet from all street lines except that where a set-back line has been established in the vicinity with permanent buildings of more or less than thirty- five (35) feet, such sign shall not project beyond the set-back line so established, and provided further that such sign shall be set back not less than fifteen (15) feet from all property lines. II. By. amending Article IV, :Section 408, Subdivision (b) of the Build- ing Zone Ordinance of the Town of Southold to read as follows: (b) WALL SIGNS-- One (1) sign attached to or incorporated in each building wall and advertising only the business conducted in such building, provided such sign does not: 1. Exceed two (2) square feet in total area for each horizontal foot of such wall, and 2. Exceed in width one hundred (100) percent of the horizontal measurement of such wall, and 3.. Exceed ten (10) feet in height, and 4. Exceed fifteen (15) feet six (6) inches from the ground level to the upper edge of sign, and 5 . Project more than one (1) foot from such wall. 202 III. By repealing Article X, Section 1002, of the Building Zone Ordinance of the Town of Southold. Moved by Councilman Demarest; 'seconded by Justice Clark; WHEREAS, Ruth F.- Wells by petition verified on the 21st day of December, 1962, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agricultur- al District to "M" Multiple Residence District, and WHEREAS, the said petition was referred ;tot�4the Planning Board for its official recommendation and report, and WHEREAS, the Planning Board has filed its official report with the Town . Board, and WHEREAS, THE Town Board pursuant to due notice thereof, held a public hearing on said petition on April 19, 1963, at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition of Ruth F. Wells be and the same is, in all. respects denied. , Vote of Town board: Ayes-Supervisor Albertson; councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by. At 3:30 P.M. in accordance with 'the notice published according _to 'law, bids were opened for proposals for urnishirig 'to the Town of Southold five (5) ,aluminum rowboats for use Vy Lifeguards at bathing beaches in the Town. The following bids were submitted: Durateckmfg. Co. -------------$758.25 Ulrich Marine----------------- 783 .90 The bids were referred. to the Beach Committee for study. At 3:30 P.M._ in accordance with 'the notice published according to law, bids were opened for proposals for furnishing to the jown of Southold five (5) new 1963 2-door 8 cylinder automobiles' for u'se as -policecars. Moved by Justice Clark; seconded by Councilman Demarest; :WHEREAS, Goose Bay Estates Civic .Association applied/to the Town Board for financial assistance in dredging the entrance of Goose Creek, a Town waterway in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor, Lester M. Albertson be and he hereby is authorized to contribute Town Funds in an amount equal to � of the total cost up to but not to exceed the sum of $475.00 toward the cost. of dredging the entrance of Goose Creek, Southold, N.Y. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. r Moved by Justice Tuthill; seconded by Justice Clark; WHEREAS, the Town Board has heretofore accepted the bid of Robert Wadding- ton, Jr. for the alteration and additions to the Terminal Building at Fishers Island TNew�,7yotk-'.,, :intthe amount of $16, 042 .00 and directed the B Board of ,Commissioners of 'the Fishers Island Ferry District to prepare a contract for the performance of said work for the . approval of the Town Board, and WHEREAS, the Board of Commissioners prepared and submitted a proposed contract for the approval of the Town Board, and WHEREAS, the proposed ,contract submitted by the Board of Commissioners of the Fishers Island Ferry District is acceptable to the Town Board, RESOLVED: That the Town Board does hereby approve said. contract and does hereby authorizer and direct the Supervisor to approve said contract on behalf of the ToWn Board. Moved by Justice Clark; seconded by Councilman Grathwohl; WHEREAS, this Board deems it in the best interest of the Town of Southold and the .e_mployees thereof that a grievance procedure be established in the Town of Southold under which employees of•the Town of Southold may present grievances, free from coercion, interference, restraint., discrim- -. .ination or reprisal,, and WHEREAS, Article 16 of the General Municipal Law authorizes the establish- ment of a. .grievance procedure, NOW, THEREFORE, BE IT RESOLVED: That the following grievance procedure .- is hereby established for employees of 'the Town of Southold,. Suffolk County, New .York: 1. DEFINITIONS. As used herein .the following terms shall have the following meanings: (aj "Employee" shall mean any person directly employed and compensated by the Town of Southold, except for elected or appointed officers and persons employed in the legislative or judicial branch thereof. .(b) "Grievance" shall mean any claimed violation, mis- interpretation or alleged inequitable' application .of any existing laws, or duly established rules, procedures, regulations,. administrative orders or work rules of the Town of Southold or a department thereof, . which relate to or involve employee health or safety, physical facilities,' materials or , equipment furnished to employees, .or supervision;-..of .employees; provided, however, that such terms shall notinclude any matter involving an employees rate of compensation, retirement benefits, disciplinary proceeding or any other matter which is otherwise reviewable pursuant to. law or any rule or .regulation having the force and, effect of law. (c) "Department" shall mean any office; department, board or other agency of the government .of the. Town of South old. (d) "Immediate Supervisor." ,shall mean. the employee or officer on the next higher level of. authority above the employee' in the department wherein the grievance exists and who normally assigns and super- vises the employee' s work and approves his time record or` evaluates his work performance. 204 (e) "Days" shall mean all days other than Satur- days, Sundays and legal holidays, . Saturdays, Sundays and legal holidays shall 17e excluded in computing the number- of days within which '-action may be taken or notice given within -the terms of this resolution. (2) DECLARATION OF BASIC PRINCIPLES. Every employee of this Town shall have the right to present his grievance in accordance with the procedure provided herein, free from interference, coercion, restraint, discrimination or reprisal, and shall have the-right to be represented by a person of his own choosing, at all stages of the grievance procedure. (3) INITIAL PRESENTATION (ao An employee who claims to have a grievance : shall present his grievance to his immediate supervisor-, orally, within two days after the grievance occurs. (b) The immediate supervisor shall discuss the - grievance with the employee, shall make such investigation as he deems appropriate and shall consult with his superiors to such extent .a.s he deems appropriate, all cbn 'ah informal basis. (c) Within five (5) days af tie.r` `presentation'--of the grievance to hire, the immediate supervisor shall sake hit 'decision'- and communicate the same to the employee presenting the grievance, and to the employee' s representative, if any. (4) SECOND STAGE (a) If- an employee presenting a grievance be not satisfied with the decision made by his immediate superior; he may, within `ten (10) days thereafter, request a review and determination of his grievance by the Town Board. Such request shall be in writing and shall contain a statement of the specific nature of the grievance and the facts relating to it. Such request shall be served upon both the Town Board and the immediate supervisor to whom the grievance was originally presented. Thereupon, within five (5) days after receiving -such request, the immediate supervisor shall submit to the Town Board a written statement of his information concerning the specific nature of the grievance and the facts relating to it. (b) The Town Board may, and at the request of the employee shall, hold a hearing within ten (10) days after receiving the written request and statement from the employee. The employee, -and his" representative, if any, may appear at the hearing and present oral state- ments or arguments. (c) Within ten (10) days after the close of the hearing, .or within fourteen (14) days after the grievance has been- sub- mitted to it if there be no hearing, the -Town Board 'shall make its-,decis- ion and communicate the same to the employee presenting the grievance, and to the employee' s representative, if any. Such decision shall, be final. This resolution shall take effect immediately. Vote of Town board: Ayes- Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Mueller requested some action in regard to- farm tractors turning around on the highway and also the planting of cover crops on the farms, RESOLVED: That said matter be referred to the Highway=>,Committee -for study. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. - Moved by Councilman Demarest; seconded by Justice Tuthill: - WHEREAS, Edward Bagenski of Laughing Water, ,Southold, -New York, - requests permission to run a water pipe across Town Highway and place a well point underground on Town Highway property, and WHEREAS, the Highway Superintendent has examined the situation and recommends the issuance of a permit therefor, NOW, THEREFORE, -BE IT RESOLVED: That the Town Board hereby consents to the issuance of a permit by the Highway Superintendent for the placing of a water pipe and well point with the bounds of a Town Highway known as Minnehaha Blvd. as shown on a certain map submitted by the said Edward Bagenski. Vote of Town Board: Ayes- ALL 21 5 Moved by Councilman Demarest; seconded by Councilman Grathwohl; WHEREAS, hospitals serve in the interest of each person in this community, and WHEREAS, hospitals are staffed' by professionally trained personel who daily provide diagnostic; therapeutie:tiM, and rehabilitative services of the highest quality to help maintain the health of our citizens, and WHEREAS, -hospitals offer career opportunities and rewarding life-work to many persons in this community, and WHEREAS,. each member of a hospital staff perform a task essential to the recovery .of patients or to the safe and efficient operation of the institution, 'BE IT RESOLVED: that this community in recognition of National Hospital Week, May 12-18, salutes its hospital, the Eastern Long Island Hospital, for its continued progress in health care, for conducting the education- al programs that insure a continuing supply of well-trained health personnel, and for providing a growing number of career opportunities for the' outh of America. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, a petition dated Dec. 17, 1962, was received from A. John Gada, Fishers Island, New York, requesting a change of zone of certain property described in said petition from "A" R�'sidential and Agricultural District to "B" Business District, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this petition to the Planning Board in accordance with Section 901, Subdivision C of Article , IX of the Building Zone Ordinance of the Town of Southold. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: That the Town Clerk of the Town- of Southold -be and he hereby is directed to request the Long Island Lighting Company to install One (1) 100 watt street light on Pole #13 on Sound Avenue, Greenport, N.Y. Vote of Town Board: Ayes- Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, the Town Board has heretofore accepted the bid of Thames River Dock and Dredge Company for dock repairs and ramp relocation to the Fishers Island Ferry District TErminal at Fishers Island, New York, in -the amount of #13,580, and directed the Board of Commissioners of the Fishers Island Ferry District to prepare a contract for the performance of said work for the approval of the Town Board, and WHEREAS, the Board of Commissioners prepared and submitted a proposed contract for the approval of the Town Board, and WHEREAS, the proposed contract submitted by the Board of Commissioners of the Fishers Island Ferry District is acceptable to the Town Board, RESOLVED: That the Town Board does hereby approve said contract and does hereby authorize and direct the Supervisor to approve said contract on behalf of the Town Board. Moved by Justice Clark; seconded by Councilman Grathwohl; WHEREAS, the Greenport Fire Department, Greenport, N.Y. applied to the Town Clerk for a Bingo License, and WHEREAS, the Town Board has examined the application and after investig- ating the matter, dulir made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute on behalf of the Board the findings and determinat,ion.s._required by law and. it is further. RESOLVED.—That the Town„Clerk be -and he hereby is directed to issue a Bingo License--to the Greenport Fire Department, Greenport, N.Y. Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS, the Beach Committee .reported that the lowest bid on the aluminum boats was submitted by 'the Duratech Mfg. Co. NOW, THEREFORE, BE IT RESOLVED: That Lester M. Albertson, Supervisor, be and he hereby is directed to enter into a contract with Duratech Mfg. Co. for the purchase of five (5) new aluminum boats at a total cost of .$758.25 . Vote of Town Board: Ayes-,Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by -Councilman Demarest; seconded by Councilman Grathwohl; WHEREAS,. the Police Committee reported that the lowest bid on the Police Cars was submitted by O'Keefe Chdv. 01d. , Inc. NOW,. .THEREFORE, BE IT RESOLVED: That Lester M. Albertson, Supervisor, be and he hereby is directed to enter into a contract with O'Keefe CPiev. . Olds Inc. for the purchase of 'five .(5) new 1963 2-door sedans, 8 cylinder automobiles at a total cost of $5, 929.75 to be delivered at the police Department in Peconic, New York. Vote of Town board: Ayes-supervisor Albertson; councilmen Demarest and Grathwohl; Justices Tuthill and Clark. A letter was received from Walter Ebbitt requesting the. Town Board to enact an ordinance relative to -dogs. This letter was referrednto the Police Committee for study. Letters were .received from Spencer B. Terry and David . Spohn requesting to be relieved of duty on the Rescue Squad. A letter was received from the Fire Chief Association concerning the numbering. of houses in the. Town of Southold.. Supervisor Albertson will meet with the. Association to discuss the matter. The Board will meet tonight, May 7, 1963, with the T. V. Cable Co.. _ . to discuss the possibility of a T.
