Albertson, at Greenport, N.Y. on Tuesday, April 9, 1963 . The meeting was called to order at 3:00 P.M. with.-the following_ . present: Supervisor Albertson; Councilmen Demarest and GrathwcU; Justices Tuthill and Clark; Town .Attorney Tasker; Supt. ;of Highways Price and Town Clerk Richmond. Moved by Justice Clark; seconded by Councilman Grathwohl; RESOLVED: That the minutes of the meeting of March 26, 1963 be and they hereby are duly approved. Vote of Town Board: Ayes-Supervisor Albertson; councilmen Demarest and Grathwohl; Justice Clark. Moved by Justice Clark; seconded by Councilman Grathwohl; WHEREAS; an application was received from Julius Zebroski et al for an Open Development Area under the provision of Section 280A of the Town Law, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold'be and he hereby .is directed to transmit this application to the Planning Board, in accordance with Section 280Aof . the Town Law. Moved: by- Councilman -Demarest; :seconded by..Councilman Grathwohl; WHEREAS, the Town Board pursuant to due notice thereof,, held a hearing on April 9, 1963 at which time all interested persons were given an opportunity to be heard, minutes of which were recorded by Judith Boken, RESOLVED: That the Southold Town Bingo Ordinance is hereby...amended. to read as follows: 187 AN ORDINANCE TO AMEND THE ORDINANCE ADOPTED BY THE TOWN OF SOUTHOLD# SUFFOLK COUNTY, NEW Y'ORK$ AUTHORIZING THE CONDUCT" OF BINGO BY CERTAIN ORGANIZATIONS FOR CERTAIN PURPOSES IN SUCH TOWN. SECTION I.'• Purpose. The purpose of this ordinance is to amend an ordinance adopted by the Town Board of the Town of Southold, Suffolk County, New. York, dated July 28, 1958, authorizing the conduct of Bingo in such town to change the reference in such ordinance from Article �14-G of the General Municipal Law to Article 14-H of the General/Law, Ts so renumbered by Chapter 438 of the Laws of 1962, and to set forth therein the -following additional amended and renumbered restrictions concerning the conduct of the game'..'of Bingo by An authorized organization in such Town, as required .by Section 479 of -the. General Municipal Law of the State of New York as amended by Chapter 438 of the Laws of 1962: BE IT 'RESOLVED AND ORDAINED: that it shall be lawful for any authorized organization, as defined in Section 4.76 of Article 14-H of the General Municipal Law,• upon obtaining the required license, to conduct the game of Bingo within the terrikorial limits of the Town of Southold, .. subject to the provisions of this ordinance, Article, l4-H_ of the General Municipal Law and Article 19-B of the Executive Law, and the following restrictions: l. . No person, firm, association, corporation or organization other than a licensee under the provisions of Article 14-H of the General Municipal Law, shall conduct such game or shall lease ,.or otherwise. make available for conducting Bingo a hall or other premises for any consid- eration whatsoever, direct or indirect. 2. 'No Bingo, games :shall be held, operated or conducted on. or within any- leased premises if rental-under. such lease is to be paid, wholly or partly, on the basis of a percentage ,of the receipts or net profits derived from the operation of such game. 3 . No authorized organization licensed under the provisions. of Article 14-H of the General Municipal Law shall purchase or receive any supplies or equipment specifically designed or adapted .for use in the conduct of Bingo games .from other than a supplier (licensed under the Bingo Control Law or from another authorized organization. , 4. The entire net proceeds of any game of Bingo and of. any rental shall'`be `exclusively devoted to the lawful purposes of the organization permitted 'to conduct the same. 5 . No prize shall exceed the sum or value of two hundred. fifty dollars in any single game of Bingo. 6. No series of prizes on any one Bingo occasion . shall 'aggreg ate more than one thousand dollars. 7. No person except a bona fide member of any such organization shall participate in the management or operation of. such game. 8. No person shall receive any remuneration for ppLtticipating ,. . in the management or operation of any game of Bingo. 9. The •unauthorized conduct of a. Bingo game and., any' willful violation of any provisions of. this ordinance shall constitute and be . punishable as a misdemeanor. BE IT FURTHER RESOLVED: That the Town Clerk be and .he 'hereby is author- ized and directed to cause notice of said .amendment to be posted and published pursuant to law.
