Supt. . of Highways Price; Town Attorney Tasker and Town Clerk Richmond,
The hearing on the preliminary budget was opened by the .Su e3visor at
3:00 P.M. ,. minutes of the meeting being taken by Mrs.'�Youn :
Moved -by Councilman Demarest; seconded by Councilman Grathwohl;
RESOLVED: That the minutes of the meetings of 'October 16th and 23rd,
1962 be and .they are hereby duly approved. -
Vote of Town Board: Ayes- Supervisor Albertson;. Councilmen Demarestt: and
Grathwohl; Justices Tuthill and Clark.

RESOLVED: That the next meeting of this Town Board will be held at the
office:,of the Supervisor, Lester M. Albertson, at 16 South Street, Green-
port,. N.Y.. on Tuesday, November 13, . 1962 at 3:00 P.M. .

WHEREAS, the Southold Town Fire Chief's Council has recommended that the
Southold Town Ordinance regulating the burning of rubbish be amended so
as to provide that violation thereofsbhall be deemed an offense rather
than a. misdemeanor, and
WHEREAS, this Board also believes that the aforesaid amendment should be
made in-. said ordinance,
NOW; THEREFORE, BE IT RESOLVED that a public hearing be .held by the
Town Board of the Town of Southold at the Supervisor' s Office, 16 South
Street, Greenport, N.Y. on the 27th day of November, 1962 at 3:30 P.M.
o'clock Eastern Standard Time on the matter of the following proposed
amendment to the ordinance entitled "Southold Town Ordinance regulating
the Burning of Rubbish" adopted on May 21, 1957, to wit:
1.. : Section 5 -of the Southold Town-Ordinance entitled "Southold Town
Ordinance regulating the Burning of Rubbish" is hereby amended to read
as follows:
Any. violation .of this ordinance shall .be deemed, an offense. and shall be
punishable'.by a fine of not more than $50.00.
BE .IT FURTHER RESOLVED: That .the Town Clerk cause a notice of said hear-
ing to be published in .the. Long Island Traveler-Mattituck Watchman, the
official. newspaper of the Town of Southold at least ten days prior to
said. heating. ,

RESOLVED: That Joan Richter of Greenport, N.Y. be and hhe hereby is
appointed Dog Enumerator for the Town of Southold, - Greenport, Orient
: and East MArion .Area, for the year 1963 .

WHREAS, an application has been duly made to the Town Board of the Town
of Southold, .Suffolk County, New York, by the Long. Island Lighting Company
for permission to install a submarine cable and the necessary appurtenances
thereto under Bayshore Road and Island View Lane, both town highways of,
.the. Towntof Southold, for the purpose of conducting electricity across
Peconic Bay to the _Town of Shelter Island, and said Board having duly
convened and heard said application and concluded that the granting there-
of would ...not be detrimental to the Town of Southold and its inhabitants,
NOW., THEREFORE, BE IT RESOLVED: That such right, privilege and permission
be and the same hereby is granted by the Town of Southold to the Long
Island Lighting Company. to install a submarine cable under town highways
known as Bayshore Road and Island View Lane extending from a point approx-

imately 185 , feet northerly from the intersection. of the northerly line
of Island View;Lane with the easterly line , of Bayshore Road and extend-
ing southerly along Bayshore Road approximately 185 feet, .and thence in
an .easterly direction along Island View Lane to the.high water mark of
Peconic Bay, all in accordance with plans submitted by said Long Island
Lighting Company, dated October .5, 1962, entitled: "-Conkling Point . Term-
inals for Submarine Cables" (WO No. 47547) ; upon the following terms,-
restrictions and conditions, - to wit: -
l. Thar said Long Island Lighting Company. is hereby granted the
right and privilege to install a:.submarine cable under Bayshore Road
and Island View Lane, Town Highways, .extending from a point 185 feet
more or less northerly from the southerly terminus of Bayshore -Road in
a southerly direction along said Bayshore Road and in an .easterly direct-
ion along Island View Lane to the- high water mark of Peconic Bay, said
installation to be made in accordance with. plans submitted,,to''thp Town
by said Long Island Lighting .Company entitled "Conkling Point Terminals
for Submarine Cables" (WO No. 4,7547) , for the purpose of transmitting
electricity through said cable under ..the .waters. of Peconic Bay' to the,
Town of Shelter Island.
2. All poles, trenches, structures and other appurtenences. shall
be located under the direction of the Town Board of the Town of Southold
or its duly authorized. agent. :.
3 .. At all times after the installation of said submarine cable .
and appurtenances the Long Island Lighting. Company. shall be permitted..
to examine the same and to keep the same in proper condition and repair,
and to do all necessary work to properly maintain the condition thereof.
4. The installation of said submarine. cable and appurtenances
permitted to be installed hereunder shall be so installed. as not, to:. .
unreasonably interrupt or interfere with public travel upon the:.afore-ii
mentioned .town highways, and shall be installed and maintained
proper workmanlike manner -so that the same shall in no way endanger.- the
public, and the said Long Island Lighting Company shall replace all..
earth removed and shall resufface said highways and shall . leave -,said_ .._
highways in as good a condition as before the installation of said
cable. The said Long Island Lighting Company, upon notice, by..the .T-own
Superintendent df Highways of the Town of southold, shall forthwith
make any repairs required for the protection or preservation -of such
highways and rendered necessary by reason of the. installatiori :.,of said
cable as aforesaid. In case the said Long. Island Lighting Company shall
fail to made such repairs to . said town highways as are required .to;be ,
made by the conditions of this resolution, the necessary repairs may be
made without notice. by the town superintendent of h�Xthways ,of=:the Town
of Southold, at the expense of the said Long Island Lighting. Company.
5, The Long Island Lighting Company shall at all times indemnify
and save harmless the Town of Southold and the members of the said Towri
Board and the Superintendent of Highways of the Town of Southold from
and against any .and all actions, suits; damages, costs, charges and
expenses by reason of the installation and maintenance of .said submarine
cable and appurtenances in the aforesaid town. Highways or by reason of
any act done or omitted to be done in the. premises by the said Long Island
Lighting Company.
6. This consent is made upon further express condition that per-
mission be secured by said Long Island Lighting Company from such other
public bodies and officers and commissions as is required by law.
7 . If the Town Highways under which. said cable is .to be; install-
ed shall be hereafter regraded, widened or relocated by the Town ..Super
intendant of. Highways, it is agreed that ,the Long Island Lighting.'.Comp-
any shall, before any such improvement and at the expense of the Long
Island Lighting Company,. remove said cable and appurtenances and. replace
the same in confromity with the directions of the Superintendent -of�
Highways of the Town of Southold.

WHEREAS, the St. Agnes Holy Name Society (St. Agnes Parish Club) has
applied to the Town Clerk for a Bingo License, and
WHEREAS, the Town' Board has examined the application and after investig-
ation, duly made findings and determinations as r equired by law,
NOW, THEREFORE, BE IT RESOLVED, that -the Supervisor be and he hereby is
authorized and directed to execute on behalf of the Board the findings
and determinations required by law and it is further
RESOLVED: That the Town Clerk be and hereby is directed to issue a, Bingo
License to the St. Agnes- Holy Name Society (St. Agnes Parish Club) .

RESOLVED: That the report of Supervisor Lester M. Albertson for the month

RESOLVED: That the Justices of the Town of Southold be and- they hereby
are authorized to attend Justices Conference of the State of New York
Fordham Law School to be held at New York on November 16, 17, 30, Dec. 1,
7 and 8,, 1962 and be it further
RESOLVED: That the necessary expenses incurred while attending said school
be a legal charge against the Town.

WHEREAS, Amfar Asphalt Corp. applied to the Town Board for a single trailer
permit dated November 5, 1962,
NOW, THEREFORE, BE IT RESOLVED: That t1a application of Amfar Asphalt Corp.
(Francis Ambrosia) to locate a single trailer on the North side of Middle
Road 150' west of .Wickham Road, Mattituck, N.Y. be and hereby- is granted

WHEREAS, the Town Board has given careful consideration to the Southold
Town constabulary which furnishes police protection in the Town of .South-
old and deems it in the best interest. of the Town of Southold that .a . .
constable (sergeant) be appointed to supervise the functions of the Town
constabulary for each shift,and
WHEREAS, a recent examination has been held by the Civil Service. Commiss-
ion of Suffolk County for the position of sergeant and a list established
on or about September 14, 1962.whereby Harold D. Winters,, Joseph Sawicki,
and Barney Harris obtained the highest grade as a result of .such examination,
NOW, THEREFORE, BE IT RESOLVED: That Harold D. Winters, Joseph Sawicki and
Barney P. Harris be ,and they hereby are appointed constable sergeants .of
the Town of Southold on a six month probationary period to take effect
immediately, and that such persons be paid their present compensation for
such .appointment.
