SOUTHOLD TOWN PLANNING BOARD
May 19 1972
A regular meeting of the Southold Town Planning Board was
held at 7:30 P.M. , Monday, May 19 1972, at the Town Office,
Main Road, Southold, New York.
There were present: Messrs: John Wickham, Chairman;
Henry Moisa, Vice Chairman; Henry Raynor; Frank Coyle;
Alfred Grebe.
Also present: Howard Terry, Building Inspector.
The Planning Board discussed the proposed manor subdivision
of Diedrick, n/s Main Road, Orient, New York, with Mrs. Helen
Reiter, real estate broker of East Main Road, Southold, New York.
It is the opinion of the Planning Board that the twelve .acres
should be divided into twelve lots to prevent future requests
for subdivision. If the property is not divided now the Planning
Board would require a statement from the owner in recordable form
that this property will never be subdivided in the future. The
Planning Board would also require a 50 f oot. road on this property
whether it is a minor or a major subdivision. Mrs. Reiter stated

that the people who are buying six acres want to divide the
property into two lots. The Chairman stated that the Town has
403000 sq. ft. zoning and that each one of the lots on this
property has 80,000 sq. ft. which means that some time in the
next ten years everyone of the people who own the lots will
come to the Planning Board to request division. Mr. Wickham
stated that the property can be put into major subdivision and
that the Planning Board recommends one acre lots. The recommendation
of the Planning Board is to either make the property a major sub-
division or have the owner sign a statement recordable in the
County Clerkts office that the property will not be subdivided in
the future. Mrs. Reiter asked what would happen: if in ten years
this is developed by the Town. The Chairman replied that it would
still be binding. Mrs. Reiter stated that she is ready to sell
and that the buyer is in a position to take over and rent
cottages right away. The Board suggested that Mrs. Reiter talk
to the property owner and to Van Tuyl surveyors to find out what
the cost of a major subdivision would be. The Chairman pointed
out that in the minutes of the last meeting there are some house
rules that say we are looking very carefully at all minor sub-
divisions where people are trying to circumvent major subdivision
regulations. Mrs. Reiter asked whether, because this is a unique
piece of property with summer bungalows on it, it would be
possible to put more cottages on it and was informed that, in that
case, it would have to be M zoned. The Planning Board suggested
that Mrs. Reiter come back to the next meeting of the Board.
A lengthy discussion was held by the Planning Board and
Dominic Aurichio, Esq. regarding Petty Bite subdivision, north
side of Main Road, Orient, New York; property of Dr. George
Newman. Mr. Aurichio presented the Board with plans. The
Chairman of the Planning Board informed Mr. , Aurichio that they
had had correspondence from the County Planning Commission, and
the Chairman read the letter which was signed by Mr. Lee Koppelman.
Mr. Wickham reminded Mr. Aurichio that the Planning Board had
informed him that they would not over-ride the County Planning
Commission and, therefore, the Board had advised Mr. Aurichio to
meet the requirements of the County. Mr. Aurichio stated that
he still did not know what the County Planning Commission wants.
(Mr. Aurichio discussed with the Board the many steps and changes
that had already been made) . Mr. Wickham commented that Mr.
Aurichio and Van Tuyl thought they could come up with a little
less than the County Planning Commission required and the Southold
Town Planning Board supported them but the County Planning
Commission did not approve. The Planning Board suggested that
Mr. Aurichio go to Mr. Charles Lind for design approval. Dr.
Newman asked why Mr. Lind had changed the lines on the Map. Mr.
Wickham replied that Mr. Lind is experienced in planning and .
feels that the intersection should be a right angled intersection.
(Dr. Newman and the Board discussed the Map) . Mr. Wickham commented

that Mr. Aurichio had a point, and Mr. Van Tuyl had a point,
and although it did not work, it was not wasted time. Dr.
Newman stated that he wants to get approval as he wants to get
the work finished. The Chairman informed Dr. Newman that he
has the approval of the Southold Town Planning Board but has
to meet the requirements of the County Planning Commission.

The Planning Board discussed property of Dominick J.
Catalano, minor subdivision, Laurel, New York, with Mr. Joseph
S.alal{d, broker of Jamesp.ort, New York. The Chairman stated
that the Town is moving towards 50 foot roads in minor sub-
divisions. (The Board and Mr. Salaud discussed the dimensions
of the property) . The Chairman asked about access on back lots
and whether the road would have to be continued much past the
intersection. Mr. Howard Terry, Building Inspector, replied
that they just have to go to the property line but would have
to have approval of enough space for fire trucks to go in and
out. He also stated that if they want to dedicate it to the
Town they would have to have 100 foot turn-around. The Chairman
asked if it was located less than 500 feet from the Riverhead
Town Line. Mr. Terry replied that he believes it is more than
500 feet to the Riverhead Town Line as there are two farms in
between. The Planning Board requested that the distance be
marked on the Map - so many feet to Town Line. Mr. Salaud said
that he would comply, and come back to the Board.
The Planning Board discussed major subdivision located at
north side of Eugene' s Road, Cutchogue, New York, with Mr.
Richard Young, Riverhead, New York. Mr. Young stated that
Mike Shepish wants more road frontage, and that there is a
water problem in this area. The Chairman noted that the Town
specification for lot widths is 135 feet; that Lot No. 13 is
quite a bit oversized, Lot 19 could be squeezed a little, and
Lot 23 is not at right angles to the side line. (Mr. Young and
the Board discussed location of playground) . The Chairman
stated that park, playground and drainage regulations had to be
met. Mr. Young stated that he would proceed along those lines.
The Chairman suggested that Mr. Young submit a copy of his plans
to the Town Highway Superintendent.

The Planning Board and Robert Tooker, Esq. , Riverhead, New
York; and James Reeve, Mattituck, New York, discussed Little Neck
Properties, East Cutchogue, New York. Mr. Reeve presented the
Planning Board with an application with proposed covenants and
restrictions. He informed the Board that he had an estimate from

Alden Young. The Chairman asked if Mr. Raymond Dean had examined
the property. Mr. Howard Terry, Bldg. Inspector, stated that he
believed that Mr. Larry Tuthill had the Little Neck Properties
folder and that he was supposed to have come in with a bond
estimate tonight. Mr. Terry stated that to the best of his
knowledge there is a letter in the folder from Mr. Dean approving
this application; and that as soon as the bond estimate is
received Mr. Reeve and Mr. Tooker will be notified. The
Chairman stated that the Planning Board would hold decision over
for two weeks.

A discussion was held by the Planning Board and Richard Cron,
Esq. regarding Map of Bay Homes, Leslie Road, Peconic, New York.
The Chairman stated that the Planning Board would like to talk
to Mr. Raymond Dean, Superintendent of Highways, about this
property. Mr. Cron asked if there could be a public hearing as
the builder has been delayed and wants to get some houses up,
The Chairman stated that as far as he could see all the require-
ments had been met, the Board would have Mr. Dean look at it,
and a public hearing would be held in a couple of weeks.

A discussion was held by the Planning Board and Richard Cron,
Esq. regarding 0. A. Ringwald, Main Road, Orient, New York.
Members of the Planning Board, the Building Inspector, and Mr.
Cron referred to the Tax Map and discussed right-of-way. Mr.
Cron stated that his clients had been advised that they had final
approval of the Planning Board. The whole transaction has been
closed, title has passed, Mr. Tabor has been paid. The Board
and Mr. Cron discussed the possibility of making a 50 foot right-
of-way. The Chairman stated that 25 feet would be held in
reservation for future use; and that it would be to their
advantage to reserve for possible dedication to the Town rather
than having everyone funnel through a 162 foot right-of-way.
Mr. Cron stated that he had not been aware of any other minor
subdivision in the area. Mr. Cron said that he would talk to
his clients and come back to the Board.

The Planning Board and Richard Cron, Esq. discussed the
possibility of filing Map of Waterfront property of H. Alvin
Smith, s/s New Suffolk Avenue, Mattituck, New York. Mr. Cron
stated that the property would never amount to more than five
parcels and at present there would only be three people living
there. The Chairman stated that he did not believe that two of
the lots are buildable, that there is a barrier beach, and that
it is a unique situation with very low swale and by definition
Netlands9' as spartena grows there. Mr. Raynor said that a

pretty good barrier beach had been built there when it was
dredged and that there is some grass beyond the barrier. The
Chairman stated that the Planning Board would want to look at
this . Mr. Cron expressed his opinion that it is wrong to
ask "John Jones' to bear the cost of wetlands, that it is a
prohibitory ordinance, and that there should be some compensation.
Mr. Howard Terry, Bldg. Inspector, suggested that before Mr. Cron
submits Maps he should get elevations. Mr. Cron stated that he
would still need a minor subdivision as the Judge is buying
three buildable parcels. The Chairman stated that the Planning
Board needs contours and would ask for 25 foot right-of-way and
25 foot reserve.
The Planning Board and Mr. Richard Caplan, Bayview Develop-
ment Corporation, Southold, New York, discussed plans of the
Bayview Development Corporation. The Planning Board referred to
Action of the Southold Town Board of Appeals in which they set
forth conditions governing the granting of the appeal. Mr. Caplan
presented the Planning Board with a survey that he claims shows
the actual area of the site. He stated that there was a deviation
in area, that he had 18,000 sq. ft. more than the Planning Board
recognized. He stated that he believed the figure that the
Planning Board had was taken off his drawing, that it was done
to sketch and not survey. He stated that from their point of
view it would cut off three units. Mr. Caplan said that he had
written a letter in support of his comments and that they were
ready to comply with all other requests. Mr. Caplan stated that
the new survey deviates with respect to separation. He informed
the Board that he is requesting a change of zone to M-1. The
Chairman stated that the variance was granted with the condition
that they do not exceed 33 units. Mr. Caplan replied that they
did not want to get themselves into a trap and they would go
back to the Board of Appeals. The Chairman stated that this is
the second time reputable people have done the Map and then two
or three months later you say this Map is wrong. He asked if
Mr. Caplan expected the Board to take this as an honest survey
now. Mr. Caplan said that he hoped the Planning Board would
excuse their errors that were based on inexperience. Mr. Caplan
explained that it was the architect 's fault as he was not
experienced in Southold Town and did not know that a site plan
would be used as a survey document. The Chairman stated that
there is no real problem except that Bayview Development Corp.
had completely undermined cdhfidence that the Board might have
in the survey, the architect, or the planning; and the Planning
Board would like to pass this on to their engineer to see what we
come out with as this is the second time in two months that this
has happened. Mr. Terry, Bldg. Inspector, stated that some of the
land was filled and dug out again, and it might have something to
do with wetlands. (The Board discussed the Map with Mr. Caplan) .
Mr. Caplan said that they own through the middle of the channel;
and that they have an existing motel building which contains

fifteen apartments which they want to maintain and want to get
permission to keep that building intact. Mr. Raynor asked Mr.
Caplan why they show six units instead of four. Mr. Caplan
replied that it makes for fewer buildings and a better view.
The Chairman asked if Mr. Caplan was prepared to give a
perpetual easement to the Town. Mr. Caplan said that he is
prepared to do so if the Town will give him M-1 zoning. He
stated that they intend to use this property for recreation
space or green space and that they are going to put a well in.
The Chairman stated that if the application of Bayview Development
Corporation is accompanied by a statement to the effect that this
will be subject to perpetual easement, it would strengthen your
position with the Town and with the Planning Board. Mr. Caplan
stated that they are. prepared to abide by whatever the Planning
Board determines and will proceed with the filing of the
application. There was a discussion about test borings. Mr.
Raynor expressed amazement that there had been no test borings
done and said he would be interested to know whether there was
clay strata. Mr. Terry, Bldg. Inspector, stated that there is
pretty good bank run under there. The Chairman asked if the
sketch was accurate enough to scale the property lines as the
Planning Board wants to compare them with the Town's established
boundaries. Mr. Caplan stated that he has valid permission
but if necessary they would do a test boring. Mr. Raynor said
he would loke to know what is down below as there are a lot of
cesspools there. The Chairman stated that it is normal to have
the location of test borings shown on the Map and that the
Planning Board would ask the County why they are not required
and why they are not shown on the Map. The Planning Board will
take care of having the survey checked by a surveyor and an
engineer. Mr. Caplan asked if he should leave the drawings
with the Board. The Chairman replied that they might be helpful
as they do show contours.

Fleet subdivision, on May 22, 1972. (They are to bring in an

On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board set May 22,
1972, as date of hearing on application of Clarence Fleet sub-
division.
Vote of the Board: ,Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.

Mr. Howard Terry, Building Inspector, stated that Penny
Lumber, are requesting site plan approval to construct real
estate office on the south side of County Road, Mattituck,
New York. (The Board and Mr. Terry inspected and discussed
Maps) . The Chairman stated that County requirements have to
be met as far as putting the building back where it belongs,
drainage, and parking in back of the building. The Planning
Board would approve nothing less than a 60 foot setback. The
building should not project beyond the connecting line from the
nearest point of Charco's garage and to the nearest point of
the house; the parking lot to be behind the building.
The Chairman read letter which the Planning Board received
from Mr. Donald S. Wilson, Youngs Avenue, Southold, New Yak,
and directed that a letter be written to Mr. Wilson thanking
him for his letter and respectfully suggesting that he attend
the hearing on May 9th.
Mr. Henry Raynor commented on Leisure Greens. He said he
had two Fathers from the Chancellory office visit him. They
would like to meet with the Planning Board. In back of their
minds is the idea that this could be done without Leisure Greens,
Inc. They are wondering what the Board would do if they asked
for a change of zone. They want to sell the property. The
Chairman stated that itts their privilege to come before the
Board.
The speaker at the Cutchogue Chamber of Commerce meeting will
be Supervisor Albert Martocchia.
The Planning Board discussed two acre subdivisions. Mr.
Moisa stated that it should be legislated, that a piece of paper
doesn't mean anything, and that new personnel would not know
whether or not there was a piece of paper filed in the County
Clerk' s office. The Chairman suggested that the Planning Board
put it on the agenda for May 22, 1972.

On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that minutes of Southold Town Planning Board dated
April 18, 1972 be approved as submitted, subject to minor
correction.
Vote of the Board: Ayes: - Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
The Southold Town Planning Board was presented with a
notice from the Health Department approving Big Green Acres
and Bay Homes.
Mr. Howard Terry, Bldg. Inspector, informed the Planning
Board that he had written to the St. Paul Fire Insurance Co.
to the effect that nothing had been done and would not be done
because C.P.F. Land Corporation intend to abandon and refile.
They want the Planning Board to recommend to the Town Board that
the original bond be dropped on Blue Horizons subdivision, Peconi.c,
New Yorli because the subdivision is going to be abandoned and
refiled under new specs.
Notice of filing of Pequash Acres has been recorded as of
the 30th of March, 1972.
Letter was received from Raymond Dean requesting the Planning
Board's approval on adding a section to the highway specifications
and design for residential driveway construction through the
shoulder area and sidewalk area of property line. Mr. Dean wants
this to be in there so everyone who builds a house has to build
to these specifications between the curb line and the property line.
The Planning Board will ask Mr. Dean to attend the May 22nd meeting.
The Town Board approved $15,000 for Big Green Acres.

On motion by Mr. Grebe, seconded by Mr. Moisa, it was
RESOLVED that the minutes of Southold Town Planning Board
dated March 21, 1972 be approved as submitted, subject to minor
correction.
Vote of the Board: Ayes: - Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
Letter from Mrs. Mothersele to be held over until May 22
meeting.
Regarding State Planning Commission dues for two years, Mr.
Terry located check numbers and dates they were audited and wrote
a letter to the Commission. He received a letter of apology
from them.
Re: Mr. Walter Uhl, Orient By The Sea, Sec. 2. Mr. Raynor
and Mr. Wickham will draft a reply before Tuesday, May 9, 1972.
On motion by Mr. Coyle, seconded by Mr. Moisa, it was
RESOLVED that the next executive session of the Southold Town
Planning Board will be held on Monday, May 22, 1972, at the Town
Office, Southold, New York.
Vote of the Board: Ayes: - Messrs: Wickham, Moisa, Raynor,
Coyle, Grebe.
