WHEREAS, the proposed amended site plan is for the new construction of a 436.2 sq. ft. storage building on a 38,459 sq.'ft. parcel in the LI Zone; and WHEREAS, Romanelli Realty is the owner of the property known as 1515 Young's Avenue, located on the w/s/o Young's Avenue, approximately 90' n/o Traveler Street, in Southold, SCTM # 1000-60-1-6; and WHEREAS, on February 8, 2005, a formal.site plan application was submitted for approval; and WHEREAS, on April 14, 2005, the Southold Town ZoningBoard of Appeals reviewed an application for a side yard variance and granted approval under appeal number 5679 with one condition and the Planning Board incorporates this in,this approval; and WHEREAS, on May.12, 2005, the Southold Fire District recommended that fire protection is adequate and the Planning Board accepted this recommendation; and WHEREAS, on May 16, 2005, the Southold Town Building Inspector reviewed and certified the.site plan for"Storage Building" use; and WHEREAS, on May 18, 2005,the Southold Town Engineering Inspector reviewed and approved the proposed drainage with conditions and the Planning Board has'accepted his recommendations; and Burt's Reliable — Page Two- 7/12/05 WHEREAS, on June 14, 2005, the Southold Town Planning Board started the lead agency coordination process on this Unlisted Action; and WHEREAS, on June 23, 2005, the Architectural Review Committee reviewed and granted approval of the architectural drawings and associated site plan materials, and the Planning Board accepted this approval and determined it to be satisfactory; and WHEREAS, the following four items are incorporated and included in the site plan: 1. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light -in such a manner as to contain the light.and glare within property boundaries. The lighting must meet Town Code requirements. 2. All signs shall meet Southold Town Codes and shall be subject to the approval of the Southold Town Building inspector. 3. The applicant must provide to the Planning Department an as-built site plan/survey to verify the exact locations of the proposed drainage wells during the construction phase of the project file records. 4. If the infrastructure allows, up to three small cherry trees will be planted by the Tree Committee in the Town right of way along Young's Avenue to enhance the landscaping in front or the site; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met, be it therefore RESOLVED, on July 11, 2005,the Southold Town Planning Board, acting under the State Environmental Quality Review Act, pursuant to 6 NYCRR Part 617, Section 617.7, performed a coordinated review of this unlisted Action. The Committee devoted the first hour to reorganizing. Glynis Berry and Ural Talgat were welcomed as architectural members who have agreed to serve on an interim basis until December 31 , 2005. Sanford Hanauer and Robert Keith were elected Co-Chairman, the latter to serve on an interim basis until December 31 . The Committee then discussed the desirability of providing design guidelines for the structures planned for the Industrial Subdivision approved for the intersection of Depot Lane and the North Road. These will be the first industrial buildings to be considered in a common setting. Also the location is on a Scenic Byway. In its commitment to the Scenic Byway Advisory Board, the Town indicated that it would "Define and encourage (through a combination of controls and incentives) development standards for development that maintain priority views and vistas." The architects on the Committee were asked to develop recommendations of color ranges for sidewalls, roofs and trim, the siting and lighting of signage, fencing, exterior lighting and roof lines, the latter to suggest the lines of local the farm barns . We will ask for a meeting with the Planning Board once this proposal has been thought through. MOVED by Howard Meinke and seconded by Sanford Hanauer, it was RESOLVED to approve the minutes of the meeting of March 25, 2005. NORTH FORK SELF STORAGE (County Road 48, 370 feet east of Depot Lane - Cutch.ogue) SCTM# 1000-96-1-1.4 The applicant described 5 rnetal buildings totaling 38,000 sq. ft. on three acres. The roofs, sidewalls, and garage doors will be Evergreen with Classic Beige trim. Am office is planned in the northwest corner of the widest building, #3. Black vinyl chain link fence will be used except near the entrance gate. The Committee first thanks the applicant for the considerable effort made to improve upon the design of the typical steel self-storage facility. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to me, it is my determination that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following standard best management practices are implemented. Pursuant to Chapter 95, the Planning Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. This site plan is for a new construction of a 4362 sq. ft. storage building on a 38,459 sq. ft. parcel in the LI Zone located w/o Young's Avenue in Southold The proposal is in conformance with the Light Industrial zoning district and the general character with the community(the Town Railroad Station is located to the south, a retail-garden center business to the north and a lumber yard to the east of the property across Young's Avenue). Due to the size of the parcel there is no opportunity to preserve significant open space. No significant adverse impacts are expected to the above goals as a result of the development of the property. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. No historical structures or known archeological resources exist on site. 0.., Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. The use is existing,no significant visual impacts will result from the proposed action. Policy 4. Minimize loss of human life, structures, and natural resources from flooding and erosion. No loss of human life, structures or impacts to natural resources from flooding and erosion will occur as a result of this action. Policy 5. Protect and improve water quality and supply in the Town of Southold. The property is served by public water. Waste is disposed of via an existing, functioning on site sanitary waste system. Potential surface-water runoff generated from the structure and parking area must be disposed of via sub-surface leaching pools (dry-wells) located throughout the property. Further to protect ground water quality and conserve water supply to the greatest extent possible it is recommended that the Planning Board encourage the following best management practices for landscaping, lawn establishment and maintenance of the;lawn post construction to further protect water quality: 1. Preserve the existing landscaping and require native landscaping to minimize irrigation and fertilizer applications. 2. Where possible,require disease-resistant and drought-tolerant plants. 3. Leave grass clippings on the lawn as mulch. 4. Cut lawn no shorter than 3"to encourage deep roots. 5. Do not overwater lawns (excess irrigation causes soil nutrients,to be lost). Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. This policy does not apply to this action. Policy 7. Protect and improve air quality in the Town of Southold. No significant impact to air quality will occur as a result of the proposed action. Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. Solid wastes will be properly disposed of at the Town of Southold Landfill and therefore no significant adverse impacts due to solid waste will occur as a result of this action. No hazardous substances have been identified on or incorporated within the proposed action. The Policy could be further supported by the following solid waste management initiatives which would include: a. The use of the Town of Southold Compost Facility materials which contribute to the replenishment of organic matter in local soils and help reduce the reliance of chemical fertilizers and herbicides and minimize the reduction of chemical fertilizers and herbicides in the Town's ground and surface waters. b. Participating in the Town of Southold's STOP program. c. Eliminating or reducing the generation of hazardous wastes to the maximum extent practical. d. PROPERTY FACTS/DESCRIPTION: The applicant's 38,459 sq. ft. parcel has 150 feet along the .west side of Youngs Avenue, and is located in the Light Industrial Zone District. The property is improved with the principal building and accessory buildings, as shown on the March 31, 1989 survey prepared by Peconic Surveyors, P.C., amended March 9, 1999, and December 20, 2004. BASIS OF APPLICATION: Building Department's December 15, 2004 Notice of Disapproval, citing Section 100-142, concerning an application for a building permit to construct additions proposed at less than 20 feet on a single side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 31, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new (max. two story) building 66.6 feet by 36.6 feet, between two existing buildings, as shown on the set of plans amended 3/28/05, prepared by Penny Lumber. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's proposed new two-story building measures 38 ft. by 67 ft. and will connect two existing buildings on the north side of the property. The side yard setbacks will not change, maintaining the existing nonconforming setbacks of TY on the west end and 2'9" on the east end of the new construction. The variance granted herein is substantial, and represents a 17'1" reduction from the current code requirement of 20 feet. 4. The difficulty was self-created and is related to a plan that applicant chose to expand, while reasonably placing the new construction between two buildings which do not meet the code's minimum setback requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
