I TERMS and CONDITIONS The Permittee Ted Dowd residing at 1775 Inlet Way,. Southold N. y, as part of the consideration*for the issuance of the Permit does understand and prescribe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits-initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for .a period of 24 mos. which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. I That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. . That the work involved will be subject to the .inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. i 5. Box 836 Southold, NY 11971 Re: SCTM#92-1-8 Dear Mr. Dowd: The following action was taken by the Board of Town Trustees during its regular meeting held on October 27, 1999 regarding the above matter: WHEREAS, TED DOWD applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated OCTOBER 4, 1999, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 27., 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the .surrounding area, and, WHEREAS, the Board has considered. all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, i NOW THEREFORE BE IT, RESOLVED, that the Board of' Trustees approve the application of TED DOWD to maintenance dredge the entrance of Fairhaven Inlet• which has closed. Dredged material' to be used as fill nearby, 100-150 c.y. with the condition that the upland area be planted with American Beach Grass 18" on center and Rosewood Regosa. BE .IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar ,project., Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. ; Two inspections are required and the Trustees are to be notified upon completion of said project. Dear Board Members , We are greatly concerned that the dredging of Cedar Beach Inlet over the years has resulted in sand and stone accumulating at the mouth of Fairhaven Inlet . As a result , the inlet is nearly closed and will eventually become stagnant . Fairhaven Inlet is a natural estuary as depicted in Attachment One which is a September S , 1926 copy Van Tuyl ' s survey prepared prior to the development of Cedar Beach Park . The survey was obtained from the Town Tax Assessors Office . Fairhaven Inlet began to slowly close after dredging began on Cedar Beach Inlet .. The sand and stone accumulating there is the same material deposited on the East side of Cedar Beach Inlet . Enclosed are pictures that depict what has occurred . In addition , we have framed pictures that can be made available on site . During the last inlet dredging , the county removed some material from the mouth of Fairhaven Inlet . Since they are scheduled to dredge the inlet again this Fall , we requested they remove material again . We were told to make the request through the Town of Southold. Mr Alessi discussed the matter with Mr Krupski and was told to request the Trustees view the inlet on August 18 , 1999 . We would be glad to meet the 'Trustees at their convenience .. Low tide is at 10 :00 when the full effect of the problem can be easily seen . The work would involve dredging; with ten years maintenance, by clamshell 'or backhoe, of approximately 150 cubic yards of material from the entrance to Fair Haven Inlet to a maximum depth of 4 feet below mean low water. Dear Board Members , We are greatly concerned that the dredging of Cedar Beach Inlet over the years has resulted in sand and stone accumulating / at the mouth of Fairhaven Inlet . As a result , the inlet is nearly closed and will eventually become stagnant . Fairhaven Inlet is a natural estuary as depicted in Attachment One which is a September 5 , 1926 copy Van Tuyl ' s survey prepared prior to the development of Cedar Beach Park. The survey was obtained from the Town Tax Assessor ' s Office . Fairhaven Inlet began to slowly close after dredging began on Cedar Beach Inlet . The sand and stone accumulating there is the same material deposited on the East side of Cedar Beach Inlet . Enclosed are pictures that depict what has occurred . In addition, we have framed pictures that can be made available on site . During the last inlet dredging, the county removed some material from the mouth of Fairhaven Inlet . Since they are scheduled to dredge the inlet again this Fall , we requested they remove material again . We were told to make the request through the Town of Southold. Mr Alessi discussed the matter with Mr Krupski and was told to request the Trustees view the inlet on August 18 , 1999 . We would be glad to meet the Trustees at their convenience .
