A Special Meeting of the Southold Town Board of Appeals was held
on Saturday, June .26 , 1982 at 9 :20 o'clock a.m. at the Southold Town
Hall, Office of the . Board of Appeals, Main Road, Southold, New York.
Present were: Gerard P. Goehringer, Chairman; Charles Grigonis ,
Jr. ; Robert J. Douglass; and Joseph H. Sawicki. Absent was: Serge
Doyen, (Fishers "Island) .
The Chairman called the meeting to order at 9: 20 a.m. and proceeded
with the first decision reserved from the June 17, 1982 regular titeeting
of the board.
RESERVED DECISION: Appeal No. 3000.
Upon application of 'Bouton Services, Inc. for JOHN J. BOGERT, Fox and
Crescent Avenues, Fishers Island, NY 06390 for a Variance to the Zoning
Ordinance, Article III, Section 100-32 for permission to erect antenna
tower exceeding the. height limitation for accessory structures. Location
of Property: Private Road, Isabella Beach, Fishers Island, NY; County Tax
Map Parcel No. 1000-10-6-3.
The public hearing on this matter was held on June 17, 1982, which
was declared closed subject' to receiving communication from Gay Fugate
within five days of -the hearing date. Communications was received by
telegram the following day, June 18 , 1982.
The board made the following findings and determination:

By this appeal, appellant seeks permission to erect a radio-transmis-
sion antenna tower, approximately 60 feet in height approximately three
feet from the existing enclosed-pool building on a concrete/rock base at
premises located on a Private Road .near Isabella Beach, and more particu-
larly known on the Suffolk County Tax Map as District 100.0, Section 10 ,
Block 6 , Lot 3.
Section 100-32 permits accessory structures or other accessory uses
in the required rear yard, provided that such building shall not exceed
a height of 18 feet. The accessory tower structure applied for herein
is to be located in the required rearyard; however its use as a radio
antenna would be impaired by static and poor reception if not permitted
to be at this height.
The premises in question contains one acre in area, with approxi-
mately 222 feet along Private Road and approximately 170 feet along
the most southerly private road. Existing on the premises is a large
one-family home with attached -enclosed-pool structure.
One letter of objection to the proposed project has been. received
for the record indicating that " . . .area in particular location could
have serious drawbacks on esthetics and environmental characteristics
of the area. . . . No other information or evidence was furnished.
In considering this appeal, the board determines that the variance
request is not substantial 'in relation to the code requirements; that
the circumstances herein are unique; that by allowing the variance no
substantial detriment to adjoining properties would be created; that
the difficulty cannot be obviated. by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general pur-
poses of zoning; and that the interests of justice will be served by
allowing the variance as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Douglass, it was
RESOLVED, that the application of Bouton Services, Inc. for JOHN J.
BOGERT for permission to erect radio antenna tower, be and hereby IS
APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS :
1. The tower must be properly anchored on rockbase with appropri-
ate guide wires to withstand storm winds;
2 . Use of this tower will not cause any adverse effect on surround-
ing areas.

Upon application of GERARD GALLIANO, 2125 Pine Tree Road, Cutchogue,
NY for a Variance to the Zoning Ordinance, Article III, Section 100-32 for
permission to construct garage in the frontyard area at 2125 Pine Tree
Road, Cutchogue, NY; Nassau Farms Subdivision, Filed Map No. 1179, Lot
No. 19; County Tax Map Parcel No. 1000-98-1-13.
The public hearing on this matter was held on June 17 , 1982 , at which
time the hearing was declared closed and receipt of the exact distances
to property lines.
After receiving the requested information, the board deliberated and
made the following findings and determination:
By this appeal, appellant seeks permission to construct a 12 ' by 20 '
garage near the grape arbor in the frontyard area located approximately
six feet to the south property line and 110 feet to Pine Tree Road. The
premises in question contains an area of approximately 31,000 square feet
with 76-foot road frontage and 107. 49-foot frontage along Little Creek.
Existing on the premises is an one-story frame house with porches (as
indicated on the July 2 , 1976 survey submitted with the appeal application) .
It is the consensus of the board that this location is the most feasible
and practical under the circumstances , particularly due to narrow passage-
ways along the side of the house. The board . agrees with the reasoning of
appellant.
In considering this appeal, the board determines that the variance
request is not substantial; that the circumstances herein are unique and
practical difficulties have been shown; that by allowing the variance no
substantial detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant, other
than a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be in harmony with and promote the general purposes of
zoning; and that the interests of justice will be served by allowing the
variance.
On motion by Mr. Goehringer, seconded by Mr. Douglass, it was
RESOLVED, that the application of GERARD GALLIANO by Norman Addy
as agent, for permission to .construct garage in the frontyard area, be
and hereby IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS :
1. That this garage structure shall not be closer than six feet
to the south property line and not be closer than 110 feet to Pine Tree
Road;
2 . That this garage structure be used only for storage (no sleeping
or living quarters) .

Upon application of ESTELLE L. WEINRIB, 27 West 86th Street, New York,
NY 10024 (by Norman Addy) for a Variance to the Zoning Ordinance, Article III,
Section 100-32 for permission to construct accessory building in the front
and/or side yard area at 3400 .O1e Jule Lane, Mattituck; bounded north by
Wood; west by Canal; south by Kimmins; east by Ole Jule Lane; County Tax Map
Parcel No. 1000-122-4-20 .
The public hearing on this matter was held on June 17, 1982, at which
time the hearing was declared closed pending receipt of the exact distances
requested to the property lines for the proposed project.
After receipt of the requested information, the board deliberated and
made the following findings and determination:
By this appeal, appellant seeks permission to construct a 10 ' by 12 '
accessory storage building back-to-back of existing accessory building
located in the frontyard area, 67 to the north property line and 77 feet
to Ole Jule Lane. The premises in question contains an area of approxi-
mately 36 ,000 square feet with 130 ' frontage along Ole Jule Lane and
255 ' frontage along James Creek. Existing on the premises are a one-family
private dwelling with attached deck and accessory building in the frontyard
area. It is the consensus of the board that similar circumstances are
existing and the relief requested is minimal. The board agrees with the
reasoning of appellant.
In considering this appeal , the board determines that the variance
request is not substantial; that the circumstances herein are unique and
practical difficulties have been shown; that by allowing the variance no
substantial detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant, other
than a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be in harmony with and promote the general purposes of
zoning; and that the interests of justice will be served by allowing the
variance.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was

front and/or side yard areas, be and hereby IS APPROVED, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. That the 10 ' by 12' storage building be no closer than 67 feet
to the north property line and no closer than 77 feet to Ole Jule Lane;
2 . That the storage building may never be used for sleeping
quarters and is to remain as a storage building, as stated in this
application;
3. That this storage building shall not exceed the size 10 ' by 121 .

Tax Map Parcel No. 1000-122-4-20 .
Vote of the Board: Ayes : Messrs. Goehringer, Grigonis , Douglass

resolution was unanimously adopted.
APPEAL NO. 2986 . Application for PETER D. PIZZARELLI for a Variance
to the Zoning Ordinance, Article III, Sections 100-30 (A) and (C) for
permission to construct an addition to existing accessory building
converting same into a two-bedroom cootage for family -and guest use in
an "A" Zone, in addition to the main dwelling at 5710 Indian Neck Lane,
Peconic, NY; County Tax Map Parcel No. 1000-98-5-14. 3:
Recently, the Board of Appeals went to inspect the subject premises
and existing cottage which is the subject of this application, and the
board members were refused permission to inspect same. Inasmuch as the
board is not familiar with this property and the structure which has
been constructed and completed and which is the subject of this appeal
application, the board. adopted the following resolution in order to
allow more time to obtain permission to 'Inspect--same:i"
On motion by Mr. Grigonis, seconded by Mr. Sawicki, it was
RESOLVED, to rescind the board' s previous resolution adopted
June 17, 1982 in which the board originally scheduled this matter for
the next regular meeting of the board to be held July 8, 1982 , until
such time as the board has had an opportunity to inspect the site and
subject building.

Upon application of JOSEPH W. HAWKINS, 7085 Horton Lane, Southold, NY
for a Variance to the Zoning Ordinance, Article III, Section 100-32A for
permission to construct windmill exceeding the height limitations for
accessory structures. Location of Property: 7085 Horton Lane, Southold,
NY; bounded north by Horton Lane; east by Sheffield; south by Kramer and
Kempner; west by Booth and others ; County Tax Map Parcel No. 1000-54-7-1. 004 .
The public hearing on this matter was held on June 17, 1982, at which
time the hearing was declared closed .pending receipt of further information
and deliberations.
The board made the following findings and determination:
By this appeal, appellant seeks permission to construct a windmill
in the rearyard area at a height of approximately 75-80 feet (including
the blades , etc. ) . The premises in question is a parcel located off the
west side of Horton Lane and having 150 . 83 ' road frontage, 200 ' along the
northerly property line, 64 . 72 ' along the rear property line, 106 . 41 '
and 270 ' at angles extending along the southerly side of the property to
Horton Lane. Existing on the premises is a 12-story frame house with
attached garage set back approximately 130 feet from Horton' s Lane.
Upon inspection of the property, the board finds the center line to be
at approximately 60 feet from. either the north or south property lines ,
and it is the opinion of this board that the windmill should not be
permitted to be constructed at a height above 60 feet (in the event the
tower should fall) .
In considering this appeal, the board determines that the variance
request is not substantial in relation to the code requirements ; that
the circumstances herein are unique.; that by allowing the variance no
substantial detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method feasible to appellant other
than a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be in harmony with and promote the general purposes of
zoning; and that the interests of justice will be served by allowing
the variance as applied for and as specified below.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was
RESOLVED, that the application of JOSEPH W. HAWKINS, Appeal
No. 2998 , for permission to construct windmill at a height exceeding
the maximum permitted by the zoning code, be and hereby IS APPROVED,
SUBJECT TO THE- FOLLOWING CONDITIONS :

1. That the windmill be located at the 90 ' mark . from the rear
of the house leaving the sideyards equally distant to either the
north or south side lines (approximately 60 feet) ;
2. That the windmill shall not be. any higher than 60 feet from
ground level (including the propeller, tail and generator) ;
3. Use of this generating tower will not cause any adverse
effect on surrounding properties.
Location of Property: 7085 Horton Lane, Southold, NY; County
Tax Map Parcel No. 1000-54-7-1.004 .
Vote of the Board: Ayes : Messrs. Goehringer, Grigonis, Douglass
and Sawicki. Absent was: Mr. Doyen (Fishers Island) .
NEW APPEAL: Appeal No. 2930. Application for SAL CAIOLA for
permission to construct ten condominium units at the south side of
C.R. 48 , Southold, NY.
WHEREAS, the board is. familiar with this site, which is located
in a wetlands area and Flood Zone "A-4" requiring a minimum building
elevation at eight feet above mean sea level; and
WHEREAS, this board has not received information describing the
types and locations of sewage disposal systems; and
WHEREAS, this property is adjacent to two large waterways, to
wit, Arshamomaque Pond and the Long Island Sound;
On motion by Mr. Grigonis, seconded by Mr. Douglass,
NOW, THEREFORE, BE IT RESOLVED, to adopt the following "Positive
Environmental Declaration" pursuant to the rules and regulations of
the State Environmental Quality Review Act (SEQRA) :

NEW APPEALS: Appeals No. 2871 and 2875. Applications for SOLWIN
INDUSTRIES LTD. for permission to construct 40 windmill towers and ten
water 'towers exceeding the height limitation of the zoning code, and an
interpretation of the zoning code to the effect that a "windmill farm"
is a permitted industrial use in this C-1 Zoning District.
Motion was made by Mr. Goehringer, seconded by Mr. Sawicki :
(1) to rescind .this board ' s June 17 , 1982 resolution in which
the board originally shceduled these appeals (No. 2971 and 2975) for
a recessed date of July 29th; thereby "recessing these appeals without
date"until compliance has been met with the procedures and requirements
of SEQRA and properly re'=scheduled:,: and re-advertised pursuant to law;
(2) to rescind this board' s May 26, 1982 resolution in which the
.board originally determined-this project to be a "Type II Action" and
declared a "Negative Declaration" pursuant to the requirements of the
N.Y.S. Environmental Quality Review Act [SEQRA] ;
(3) to request that the applicant file a Long Environmental
Assessment Form [EAF] and Draft Environmental Impact Statement [DEIS]
as early as possible;
(4) to request that the applicant supply copies of the
"informational packet" for the public, -f.or. wh_ich one copy was fur-
nished to each of the board members on June 17th, due to the numerous
requests for same through the Building Administrator, Victor Lessard.
Vote of the Board: Ayes : Messrs. Goehringer., Grigonis , Douglass

tion was unanimously adopted.

Project Proposed: Construction of ten condominium units, gravel
surface roadway, parking area (s) and regrading and swimmingpool.
ENVIRONMENTAL DECLARATION:
Pursuant to Section 617. 7 of the N.Y.S. Department of Environ-
mental Conservation Act, Article 8 of the Environmental Conservation
Law, and Section 44-4 of the Southold Town Code, and in order to
commence the processing of the SEQRA procedures, the Board of Appeals
of the Town of Southold at this time wishes to declare itself lead
agency in this proposed project and hereby classifies same as an
Unlisted Action which may have significant adverse effects upon the
environment for the following reasons :
1. Stormwater runoff may result from the development and improve-
ment of this property;
2. Information has not been made available indicating the type
and location of the proposed sewage disposal systems, and the per-
centage of buildable upland area does not appear adequate thereby
possibly causing adverse--effects on neighboring water wells and
pollution into either or both surrounding waterways.
3. A large physical change to the project site, which may be
designated to be a critical area ecologically or hydrologically.
It is requested at this time that the applicant and/or his agent
furnish our department with a Long Environmental Assessment Form and
Draft Environmental Impact Statement.
This declaration should not be considered a determination made for
any other department or agency which may also be involved, nor for any
other project not covered by the subject appeal application.

RESERVED DECISION: Appeal No. 2991. Application for MIRIAM BATSON,
by David E. Kapell as agent, 143 Sixth Street, Greenport, NY 11944 for a
Variance to the Zoning Ordinance, Article III, Section 100-31 for permis-
sion to construct addition to existing dwelling with a reduction in rear-
yard setback at Bayview Drive, East Marion, NY; County Tax Map Parcel
No. 1000-37-4-3.
The public hearing on this matter was held on June 17, 1982, at
which time the hearing was declared closed pending receipt of the exact
dimensions of the proposed new deck and the total square footage of the
existing structures on the lot in order to determine,--total lot coverage
percentages.
On June 25, 1982 Mr. Kapell submitted the following information:
(1) Total lot area: 14 ,000 square "feet;
(2) Total coverage including existing decks : 2 ,186 square feet.
It is the understanding of the board that the above information did not
include the area of the proposed new deck, and the board instructed
the secretary to request same of Mr. Kapell before a .decision could be
rendered.
