There were present: Robert W. Gillispie,Jr. , Chairman, Robert Bergen, Fred Hulse, Jr. Absent: Mr. Charles Grigonis, Jr. , Serge Doyen, Jr. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the minutes of t :.e_Southold- Town Board of Appeals dated August 31, 1964, be approved as submitted. Vote of the Board: Ayes: Mr. Gillispie, Mr. Bergen, Mr. Hulse. • ' Southold Town Board of Appeals -2.- •September .;, 1964 PUBLIC HEARING: Appeal No. 709 - 7: 30 P.M. (E.D. S.T. ) ,' upon application of Mike Winiarz, Mattituck, New York, a/c Stanley Winiarz, Mattituck, New York, for a variance in accordance with the Zoning Ordinance, Article IV, Section 400, Subdivision 1, and Article IV, Section 409, for permission to erect a business building. Location of property: north side Main Road, Mattituck, New York, bounded north by Church property, east by Esso Standard Oil, south by Main Road, west by Joseph Moisa. Fee paid $5. 00. The Chairman opened the hearing by reading application for a variance, legal notice: of hearing, affidavit attesting to its publication in the official newspaper, . and notice to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (There was no response. ) Mike Winiarz was present at the hearing, but he had nothing further to add to the application, since it was discussed with the Board at a previous meeting. THE CHAIRMAN: . Is there anyone present who wishes to speak against this -application? (There was no response. ) After investigation and inspection the Board finds that Mike Winiarz, a/c Stanley Winiarz request permission to build a business building on a lot where there is an existing residence. After the construction of the new business building, there will be insufficient front yard for the residence. However, to move the existing residence would incur.-,: a great expense. The Board finds that the proposed bus- iness building is to be 40' x 401 . This is in a "B" Business District, and will conform with the development of the area. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike . in the immediate vicinity of thin property and in the same use district; and the variance does observe the spirit of the Ordinance and will not .change the character of the district. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was Southold Town Board of Appe'cils -3- - September lam;j 1964 RESOLVED that Mike Winiarz, Mattituck, New York, a/c Stanley Winiarz, Mattituck, New York, be granted- permission to erect a business building on property where there. is an existing residence, on property located north side Main Road, Mattituck, New York, in accordance with the following suggestions of the Board: 1. The building shall be located 25 feet from the Main Road. 2. The building shall be erected parallel to the Main Road. 3. -The building shall be erected 3 feet from the Esso property on the east. Section 307, for permission to build an addition to the existing dwelling with insufficient . .side yard. Location .of pm perty: . south side private right-of-way off- east side Bay Home Road, . Southold; New York, bounded north by A.W. . Fismer Est. , east .by Grace Fismer, south by Bay, and west .by A.W. . Fismer Est. Fee paid $5.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper, and notice to the applicant. THE CHAIRMAN: Anyone present ?wish to speak in favor of this application? ELLSWORTH GRATHWOHL: The application speaks for itself. (Mr. Grathwohl and the Board discussed the application. It was established that the lotis 200 feet in depth and has approximately 100-110 feet in frontage. Mr. Grathwohl stated that the proposed location was the only feasible place of putting the addition. ) THE CHAIRMAN: Are there any other questions anyone would like to ask? (There was no response. ) SOUTHOLD Town Board of Ap�,It�als -4- September 1964 .THE CHAIRMAN: Anyone present wish to. object to this application? (There was no response. ) After investigation and inspection the Board finds that Ellsworth Grathwohl a/c Louis Perkinson wishes to build an addition to enclose bottled gas tanks and for the storage of other tools. This is the most practical location for the addition, in view of the fact, that .the service connections are already there for the gas tanks. The Board feels that enclosing the gas tanks will improve the appearance of the area. The Board points out that to the immediate east is meadow and marsh land,and the nearest .permanent .dwelling is 400 feet. The Board finds that -strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not .be shared by all properties alike in the immediate vicinity ofthis property and in the same use district; and the variance does observe the spirit .of the Ordinance and will not change the character of the district.. On motion by Mr*.. Hulse, seconded by Mr. Bergen, it was RESOLVED that -Ellsworth Grathwohl, .Main Road, Southold, . New York, a/c Louis Perkinson, Southold, New York, be granted permission to build an addition to the existing dwelling with insufficient side yard, on property located south side private right-of-way off east side Bay Home Road, Southold, New York. Vote of the Board: Ayes: Mr. Gillispie, Mr. Bergen, Mr. Hulse. On motion by Mr. Gillispie, seconded by Mr. Bergen, it- was RESOLVED that the Southold Town Board of Appeals set 7 :30 P.M. (E.D.S.T.) , Thursday, September 24, 1964, at the Town Office, . Main Road; Southold, New York, . as time and place of- hearing upon application- of John G. Glander, . Grathwohl Road, New Suffolk, New York, for a variance in accordance. with the Zoning Ordinance, Article III, Section 307, for permission to attach the garage to the house with insufficient sideyard. Location of property: east side Grathwohl Roads New Suffolk,' New York, bounded north by Guido Petrusa, east by Grathwohl, south by Bruno Zuhoski, west 'by .Grathwohl Road. Estimated expense for three members of Board to attend Association of Towns meeting in New York in February . $375.00 2. Estimated travel expense of Board to Fishers Island $125.00 Total Travel -Expense 800.00 Remuneration of Board of Appeals: $1250.00 of which . is remuneration to the Chairman and the balance representing $1150.00 to each member. 5850.00 Total estimated expense of Board of Appeals 7800.00 Toal estimated income from appeal applications 500.00 7300.00 Southold Town Board of Appeals -6- September 's 1964 it is the opinion of the Board of Appeals that the fee for all applications to the Board be increased from $5.00 to $10.00, in view of the cost of public notices. Vote of the Board: Ayes: Mr. Gilli.spie, Mr. Bergen, Mr. Hulse. It was further .aRESOLVED that a letter be sent to the Town .Board, Town of. Southold, commending the proformance of the secretary, and recommending an increase in salary from $3180 to $3680. The. Board viewed the County Maps indicating what .property would be taken for the further extension of County Route 27. The next meeting of the Southold Town Board of Appeals will be held 7 :30 P.M., .
