SouthoJ,d Town Board of Appea_s -2- August 6, lei The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper, and notice to the applicant. The- Chairman stated that there was a petition in the file objecting to this variance. The petition was signed by 20 residents of the ' Captain Kidd Estates. The Chairman also read a letter from Theodore Garris, Esq. , objecting to the application on behalf of Theofanis ' P. and .Anastasia Kyvernitis, the owners of lots #116,, 117, and 118, in the Captaan Kidd Estates. THE 'CHAIR.MAN: is there anyone present who wishes to speak in favor of this application? ALEXANDER' CHASE',41 ESQ. : I represent Mr. Varmava, the owner of the property. I would like to make some bomments in favor of this application. I imagine that.most of the people here will- speak in opposition. In that case-, I would like permission to hold my remarks until after the opposition is heard. THE-CHAIRMAN: You will be given a chance to rebut. is there anyone else who wishes to speak in favor of this application? (There was no response. ) THE. CHAIRMAN: Is there anyone present who wishes to speak against this application? MRS. KYVERNITIS: I am against it. MRS. -TUSOUNIS: May I speak for Mrs. Kyvernitis,, she doesn't ti4. speak -English very well. She lives two lots dwon from the applicant. (Mrs. Tusounis showed on the map the lot she was talking about. ) ' She feels that this would lessen the value of her property. - She feels that if her house has to be setback 35 .feet, then this house should not be allowed to stick- out. ('Inhere -was some discussion of the setback of the other houses in the area. Everyone seemed to think that- their'house were set - back the required amount of feet,, however, there was some question . of where the setback line started from. There was also some question of how far off the road the Town owns. The size of the adjoining lot was also discussed. ) Southold Town Board of`App'6als -3- August 6, 1964 JIM MORAETES. I have a house on corner of -Central Avenue, lot #155. When I put my house up, I go by the law and have to have it setback 35 feet- from the road. Now this man he wants to put- his house closer to the road. If you allow this., pretty soon everybody will be putting there houses closer and closer to the road and each other. THE CHAIRMAN: Does anyone have a house closer than 35 feet to the read? JIM MORAETES: They are all 35 feet from the road. THE' CHAIRMAN: Is there anyone else who wants to speak against this application? (There was no response. ) THE 'CHAIRMAN: Are there any other questions? (There was no response. ) THE CHAIRMAN: Mr. Chase will then be given a chance to rebut. - ALEXANDER CHASE, ESQ. : I would like to say a few words about the people here in opposition. I would like to say that I believe that most of the people here, and I say this with respect, I beleive that most of them object because they have the wrong idea of what this person is asking for. These people will keep and maintain the value of this area. . Any other owner would have difficulty building on this lot. I would like to say that there are complicated circumstances present which would be of value to this Board. This is an odd shaped lot. (Mx. Chase went on to describe the property, the depth and width. ) Mr. and Mrs. Varmava would like to have their house -facing the main road, in order to do so, they need a special exception. They need 10 more feet. I believe .this Board has made personal inspection of the area. There is no obstruction of view from the . east. There would be no question of obstruction of'view. In respect to the value of the house, this man plans to build a 15,000 dollar home. He will not lessen the value of the other homes, but he will increase it. The rest of the houses on Luther Drive are of lesser value. Southold Town Board of App' `.s -4- August 6, I would like to say that they are an elderly couple. The mahLi is 70 years olds, and I._believe that the woman is in later years. They want to enjoy their retired years in this respect. They want to build on Luther Road to have land behind them to grow flower and have a garden. I believe there are homes within the area that w.have less than 35 feet, so that it wouldn't-be something new to the area. I am afraid that if this application is denied, that no home will be build on this lot. (The Chairman explained the difference between a variance and a special exception, and the conditions surrounding them. In order to grant a variance there,-.must be a hardship. The Chairman said .there was no hardship in this case because the house could be turned around to face Central Avenue. ) ALEXANDER`-CHASE,ESQ.: This is one of the few lots ,, as you can see,that were cut short. . All the other lots in Captian Kidd Estates has at least 90 feet. If 'the house were build facing Central Drive, his back yard would be made smaller. .. As a son of a party that owns property in this area,, I know the character of the district. It is one of the summer type subdivisions and that for retired people. If they have a small back yard, they will have very little room to cultivate their interest, , The area on the other side will be developed in the way of flowers and ornamental things of that- nature. THE' CHAIRMAN: Iodoesn2t ?make any difference how you put the house on the lot. ALEXANDER CHASE,ESQ. : My clients wish to build the house facing Luther 'Road. (Mrs. Anastas, owner' of lot #90 in' Captian Kidd Estates, said she had bought her house from these people and she said she thought that she was in violation because when she bought the house there were hedges planted and she thought that these were against the ordinance. ) THE 'CHAIRMAN: Are there any other questions? ALEXANDER CHASE, ESQ. .- I ask that Mrs.- Anastas=s statemeht be stricken from the record. THE' CHAIRMAN: is there anything else in connection with1his application? (There was no response. ) Southold Town Board of'Ap�eals -5- August 6, :iy64 After investigation and inspection the Board finds that Christos Varmava wishes to build on a lot that has insufficient depth to meet the setback and sideyard requirements of the Ordinance. The Board does not find this a unique and unnecessary hardship as the house could be located a different way on the lot. The applicant request that the house be built facing Luther'Road. In order to do this they will need the Board to grant a special exception. However, if the house was built to face Central Drive.,, no special exception would be .necessary. The Board has to take into consideration tWat the lots in Captain Kidd Estates are not subject to Section 303 of ' the Zoning Ordinance. The Board feels that it would be better to have .the back yard made smaller rather than the front yard area, for reasons .of°traffic safety and conservation of land values. The Board feels that it is a lesser hardship to have a smaller back yard than front yard, particularly on a corner lot. The Board also points out that there are other lots in the Town that are full size lots. The Board finds that the public convenience and welfare and justice will not be served and 'I"ithe legally established or,permitted use of neighborhood property and adjoing use districts will be permanently or substantially injured and the spirit of the Ordinance will not be observed. On motion by Mr. Gillispie,, seconded by Mr. Hulse, it was .RESOLVED that Edward Abitz, Mattituck,, New York, a/c Christos Varmava, 95 Seaman Avenue.,, New York, New York,. be- denied permission to build on alot with insufficient setback and side yards. It was further resolved. that .any house build on this lot must be set back 35 feet from-Central Avenue,. 35 feet- from Luther Road, and have rear' yard of at least 25 feet. III,, Section 303.,, Article'X,.. Section 1000A,. for permission to build on a lot with insufficient area. The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper, and notice to the applicant. THE' CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (Mrs. Eva Sinuta and her son Harry Sinuta were present .at-the hearings, but had nothing further to add to the application. In the application Mrs.-. Sinuta stated that she had a possibility of obtaining some additional land when the adjoining property owner filed a subdivision map. - The Chairman asked what guarantee she had that she would obtain this land. The Chairman suggested that Mrs. Sinuta obtain something in muting to guarantee that see will obtain land when the subdivision map is filed. ) THE' CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that Mrs.- Sinuta wishes to divide a lot and build on a lot with insufficient area. . Although there is room enough for' the small house that is proposed, there isn't enough area to meet the requirements of the Ordinance. Mrs. Sinuta states that she has the possibility of obtaining additional property that will give her enough• or more than enough area to build the proposed house. The Board agrees that-Mrs. Sinuta should, first -have something in writing that will guarantee the obtaining of such land. The Board finds that this will be a one family house in a residential district, and in no way will change the character of this district. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared -by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. (CR 25)., Greenport, New York, subject to the following. conditions: 1._ A letter of intention,or whatever- Mrs.. Sinuta's lawyer suggests, from the subdivider of the adjoining property. 2. THE' CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (Robert Bennet appeared on behalf of the Mattituck- Bohack -. Store. The Board advised him that- they were not willing to go along with the sign, especially in view of the fact that there is at .the present time much controversy in the'Town of' Southold in regard to signs. The Board suggested having a smaller sign that read Bohack. entrance or something of that nature. However, where the sign is to be located is the exit from the parking lot. The Board agreed that this application should be postponed until after definite action has been taken on the signs in Southold Town. ) On motion by Mr. Hulse, seconded by Mr. Gillispie, it was Southold Town Board of Apr,.-_.'Ls -8- August :6, _,;4 RESOLVED that the application of Going Sign-Company,. 206 Front Street, Mineola, New York, a/c Bohack, Mattituck•, New York be postponed until the second meeting of the Southold Town Board of Appeals in October., 1964. (Mr. King and the Board discussed the layout of the proposed new building and the buildings surrounding the area. Mr. King had no additional information to add to the application. ) THE 'CHAIRMAN: Is there anyone present who wishes to speak against this application? '(There was no response. ) After investigation and inspection the Board finds that Edwin King wishes to build a barrack for the storage of boats. This building will be constructed at- King's Marinas on Narrow River Road,. Orient.,. New York. The Board finds that the proposed building will be 68 feet, 6 inches long and will be 20 .feet wide. This building will be in line with the surrounding buildings owned by Mr. King at King's Marina.,,- Orient,, New York. The Board finds that the public convenience and welfare and justice will be served, and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit- of the Ordinance will be observed. i Southold Town Board of Appeals -9- August 6, 1964 On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that-Edward King.,. Orient, New York®" be granted permission to build a shed for 'the storage of boats as shown on the sketch by Edward King., dated July 16, 1964, which is not in scale, on property located east side Narrow River' Road-, Orient, New York. Vote of the Board: Ayes; Mr. Gillispie., Mr. Bergen, Mr. Hulse. PUBLIC HEARING: Appeal No. 701 - 8:45 P.M. (E.D.S.T. )s, upon application of Constance Freeman,: Main Road,. Orient,, New York, for a special exception in accordance with the Zoning Ordinance,- Article III,,. Section 300,.. Subsection la,. for permission to convert a one- family dwelling into a two, family ,dwelling. HOWARD TERRY: No she said she couldn't- make it tonight. (Mr. Terry stated what Mrz.. Freeman had said her intentions were and what the interior ' of the house had. The Board briefly discussed the application. Mr. Gillispie stated that he knew the applicant was a widow, however that has no bearing on the case. it was also brought out that there is a multiple residents adj ointng Mrs.-7reeman's property. ) THE CHAIRMAN: Is them a anyone present. who wishes to. speak against this application? (There was no response. ) Southold Town Board of:Appe&!'S -10--- August 6s izv64 After investigation and inspection the Board finds that Mrs. Freeman wishes to convert a one family dwelling to a two family dwelling. . The Board finds that this dwelling is too large to be occupied by one person. It will not depreciate property values of adjoining property. Mrs. Freeman request this special exception to obtain additional income to meet the cost of maintaining the property. The Board points out that Mrs. Freeman's property is bounded on the east by a Multiple Residences the Oyster Pond Inn. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. - On motion by Gillispie.s seconded by Mr. Hulses, it was RESOLVED that-Constance Freemans Main Roads Orient,, New Yorke be granted permission to convert a one family dwelling into a two family dwelling., on property located south side Main Roads Orients New York. (E.D.S.T. ) t upon application of Fredrick Gordon, 251 Fifth .Avenues•; Greenports New Yorks, a/c Edward Speechese North Roads Greenporte - New Yorks. for a special exception in accordance with the Zoning Ordinance-, Article III•s Section 300, subsection la, for permission to convert a barn. into a two-family dwelling. Location of property: north side North Road (CR 27A) , Greenport, New York, bounded north by J.M.S. Land & Development Corp. , east by J.M.S. Southold .Town Board of Appeaa —11-- August - 6t 1 The Chairman also read a .letter written to Mr. Fredrick Gordon on February 20, 1964 concerning this application. . Then Mr. Gordon first made this application,there was no provision in the Ordinance to provide for a residential two family dwelling. The letter informed Mr. Gordon that the Board of Appeals had no power oxa. this :type of application. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (The Board and Mr. Gordon discussed the application. Mr. Gordon stated that- only the first floor of the building will be used. He stated that the barn was rebuilt 50 to 60 years ago. He pointed out that the Speeches' residents is on the south west cornerof the property. It was brought out that the property in question is surrounded by the McCann property on the. sound. There is no garage on the property. There are just two main buildings and a 89 by 10' brick smoke house. ) THE'CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that Edward Speeches wishes to convert a barn into a two family dwelling. The Board finds that the conversion of this building will be an asset to the Town of Southold, in few of the fact that the appearance of the house will be improved. The barn: could not be changed to a one family dwelling because it is too large. The Board finds that the applicant states in the application that this would not be on a commercial basis, and the additional apartment would be classified as a guest apartment. The Board finds that this two family dwelling will not harm the character of the district. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED that Fredrick Gordon, 251 Fifth Avenue, Greenport, New York, a/c Edward Speeches, North Road, Greenport, New York, be granted permission to convert a barn-' ..into a two family dwelling I Southold Town Board of App�.__s -12- August: 6..' on property located north side North Road (CR 27A) , Greenport, New York. Vote of the Board: Ayes:Mr. Gillispie, Mr. Bergen, Mr. Hulse. PUBLIC HEARING: Appeal No. 7 03 . - 9:2 0' P.M. (E.D.S.T. ) , upon application of Beachcomber Motel & Restaurant,, Inc. , Duck- Pond Road, Cutchogue,, New York, for a special exception in accordance with the Zoning Ordinance., Article III, Section 300_, . Subsection 11., for permission to erect a directional sign on the property of Edward A.- Zuhoski, Jr. . Location of property: south side Middle Road, Cutchogue, New York., bounded north by Middle Road,, east-by J. Haurus, south by-E.A. Zuhoski, west by J. Simcik. Fee paid $5.00. The Chairman opened the hearing by reading application for special exception-1, legal notice of hearing, affidavit attesting to its publication in the official newspaper., and notice to the applicant. The' Chairman also read the letter from Mr. Edward Zuhoski giving permission to Beachcomber hotel & Restaurant to erect a sign on his property. THE' CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? MRS. ARTHUR LEVINE: I don't know if it. is .necessary to say anything else. (The Board looked at the maps of the-County to see where they are proposing to take 75 feet from the North Road. Mrs. Levine stated that they presently have one sign on Depot- Lane and main Road, one on Depot- Lane and the North Road, and an arrow on Oregon Lane. They also have rented a bill-board in Mattituck. Mr. Hulse suggested that they attach something to the bottom of the sign indicating that the motel and restaurant is closed in the winter. This sign will be doubled face. THE' CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) Southold Town Board of Appeals -13- --August 6, ' �L)64 After investigation and inspection the Board finds that the Beachcomber Motel & Restaurant request permission to place a doubled face directional sign on the property of 'Edward A. Zuhosk i, Jr. The Board also finds that-Edward Zuhoski, Jr. has given permission to erect such a sign on his property. The . Board finds that the Beachcomber Motel & Restaurant is a con- siderable distance from the main highway and a sign is needed to direct people to this business. The sign will read: "Left at Blinker on-L. I. Sound, Beachcomber Motel & Restaurant, end of Depot Lane". On the back of the sign it will read: "You have' just .passed the Beachcomber Motel & Restaurant. " The Board finds that this sign is in the public interest to the Town of ' Southold. The- Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use district- will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED that Beachcomber Motel & Restaurant, Inc. , Duck Pond Road, Cutchogue; New York, be granted permission to erect . a direction sign on the property of :Edward A. Zuhoski, Jr. , located on the south side of Middle Road, Cutchogue, New York, subject tothe following conditions: 1. The Sign shall be located in the north west corner of Edward 'Zuh.oski, Jr. property. 2. The sign shall be 42 by 63 . 3. The sign shall be located at least five feet from any property line. 4. The sign shall be three feet from ground level. vote of the Board: Ayes:Mr. Gillispie, Mr. Bergen, Mr. Hulse. Mr. Dickerson appeared before the Board for an informal discussion in relation to changing a piece of property to business in Mattituck. The Board advised him that they should apply to the Town Board for such a change. Southold Town Board of Ap&.;als -14- August 6,- �_964 On motion by Mr. Gillispie,seconded by Mr. Hulse, it was RESOLVED that the minutes of the Southold Town Board of - Appeals dated July 23, 1964, be approved as submitted. Vote of the Board: Ayes: Mr. Gillispie, Mr. Bergen, Mr. Hulse. In accordance with a letter from William Midgley, Jr. , of the Cutchogue Fire Department, on motion by Mr. Gillispie, seconded by Mr.- Bergen, it was RESOLVED that the Cutchogue Fire Department be granted per- mission to display posters in the Town of- Southold advertising their annual "Bar-B-¢" to be held August 22, 1964,,, These posters will be removed promptly after the event. It is believed that this is in the public interest. It is specifically forbidden to place these posters on utility poles or on private property without permission. Vote of the Board: Ayes:-Mr. Gillispie, Mr. Bergen, Mr. Hulse. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Southold Town Board of: Appeals set 7:30 P.M. (E.D.S.T. ) , Thursday, August 20, 1964, at the Town Office, Main Road, Southold, New York, as time and place of hearing upon applicatic of Goldsmith Building and Construction, Main Street, Southold, New York, a/c Jerome Conway, Jr. , Chestnut.Road, Southold, New York, for a variance in accordance with the Zoning Ordinance,- Article III.- Section 304, for permission to erect-. a building with insufficient setback. Location of property: south side Chestnut- Road,. Souhold, New York, bounded north by-Chestnut.Road, east.by H.M. Conway, south by H.M. Conway, west-by H.. Conwayl;F. Moffet.
