Box 1179 1V g-H Southold, New York 11971 RE: Hugh J. Murphy permit no: 4577, March 28, 1996 Dear Mr. Krupski and Town Trustees : In reviewing the permit issued by your board, I found the address was incorrectly shown as Pine Neck Road. Mr. Murphy ' s property is located at 3105 Oaklawn Avenue. Please issue a revised permit if you feel it is necessary. Mr. Murphy has requested me to contact your board regarding another matter. When Mr. Murphy filed an application with your board, he was planning to renovate the existing house and build an addition on the east and south sides of the house. In opening the house for the season, Mr. Murphy took a critical look at the existing house and felt there was not much to save. He would be interested in razing the existing house and building a new house in the footprint provided by the existing house and two proposed additions. The final design of the house would be the same, but in one case, it would consist of all new materials and in the second case, the house would consist of new and old materials. I have spoken to the Building Department,. and they have no objection to building a new house as long as all the permits that have been issued are amended. Therefore, we would like to know whether or not the approval we received from your board would cover the demolition of the existing house and the building of a new house to the proposed footprint originally granted. This request is made because it has taken over a year to obtain a permit for the sanitary system from the Suffolk County Department of Health Services . Because the lot is small, and the properties in this area have private wells and sanitary systems, the project had to be approved by the Board of Review in the health department. We have just received this permit for construction and have filed an application with the Town of Southold Building Department. We regret the delays that have been incurred but are planning to start construction upon the issuance of a building permit. Thank you for your attention to this request. Sincerely, Diane Herold enc. I000-70-6-8 Applicant: Diane Herold PO Box 884 Westbampton Beach, NY 11978 Notice of Hearing: February 3, 1998 Hearing Date: February 19, 1998 Statement of Problem Applicant is requesting a waiver from construction standards that require a separation distance of 150 feet between a shallow well and a septic system. Findings and Facts 1. Site is in Groundwater Management Zone #IV. 2. Area is zoned residential. 3. Public water is not available. 4. Depth to groundwater is approximately 6 feet. 5. Soils are acceptable. 0 6. Applicant wishes to utilize the existing septic and water supply systems to serve the proposed home after the existing home is demolished. 7. Though the levels of contaminants within the water sampled from a test well were acceptable, the presence of nitrates, chlorides and sodium were detected at appreciable levels. Determination By a vote of 3 to 0, the board determined to approve the applicant's request for a waiver from the department's requirement for minimum distance from the leaching pool of a septic system to a shallow well; however, the applicant must covenant the property, in language acceptable to the County Attorney, that the on-site well and sewage disposal system do not meet departmental requirements. Box 1179 Southold, New York 11971 RE: Hugh J. Murphy Permit # 4577 Dear Mr. Krupski and' Board Members : On behalf of my client, Hugh Murphy, I am requesting an extension- -to the above permit which expires March 28 , 1998 . On January 10, 1997, I tried to file an application for approval to construct sewage disposal with the Suffolk County Department of Health Services . I was asked to submit additional information which was done on March 21 , 1997. Subsequent requests from that department dated 4/17/97 and 9/3/97, resulted in the necessity of filing an application for variance or waiver from regulations or specifications on October 10, 1997. The Board of Review was held this morning, at which time we were informed that a decision would be mailed to us in .four to six weeks. This does not permit enough time for us to file an application with Suffolk County Department of Health Services for any upgrades they require nor to file for a building permit with the Town of Southold. In view of these circumstances , an extension of your permit is regu6sted. I have enclosed copies of the correspondence with the health department . If you need additional information in order to act upon this request, please contact me. Thank you for your attention to this matter. Sincerely, Diane Herold enc. In view of the extremely poor condition of the existing house and the fact that no interior wall will remain in its existing location has made Mr. Murphy decide to demolish the existing house and rebuild in the exact footprint as originally proposed in the previous application. We are requesting an amendment to the above application. The six foot addition on the west and the twelve foot addition on the south side of the existing house are still proposed but will become part of the .constructi,on of the new house. The additional change will be the existing house will be rebuilt as a 1-1/2 story house. A revised survey is attached which shows that the footprint of the new house is the same as the ex_isiting house with the proposed additions .
