NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A. Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives,employees,agents, and assigns.for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with
the terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for-informing its independent contractors, employees, agents and assigns of their
responsibility to comply.with this permit, including all special conditions while acting as the permittee's agent with
respect to the permitted activities, and such persons shall be subject to the'same sanctions for violations of.the
Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits,approvals,lands,easements'and rights-of-way that
maybe required to carry out the activities that are authorized by this permit.
Item D; No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian
rights of others in order to perform the permitted work nor does it authorize the Impairment of any rights, title, or
interest in real or personal property held or vested In a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: 'Facility Inspection by the Department
The permitted site orfacility, including relevant records,is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL.Such-representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3)_
The permittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site.or facility. Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department,issuance of this permit does not modify,supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or.determination.'
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must'submit a separate written application to the Department for renewal,modification or transfer
'of this permit..Such application must include any forms or supplemental information the Department requires.Any
renewal, modification or transfer granted by the Depertment'must be in writing.
The permittee must submit a renewal application at least
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities(HWMF), major Air Pollution Control(APC)and Solid Waste
Management Facilities (SWMF); and
b) 30.days before expiration of all other permiftypes.
Submission of applications for permit renewal or modification are to be submitted to:.
NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg*40, Stony Brook, NY 11790-2366
General Condition 4: Permit Modifications,Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension or revocation include:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the ECL.and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material Information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have.materially
changed since the permit was issued.

ADDITIONAL GENERAL CONDITIONS.FOR ARTICLES 15(TITLES),24;26,34 AND 6NYCRR PART 608
(TIDAL WETLANDS)
1. If future operations by the State of New York require an alteration in the position ofthe structure or work he
authorized, or if, in the opinion of the Department-of Environinental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the
people of the'State, or cause loss or destruction of the natural resources of the State,the owner may be ordered
by the Department to remove oralterfhe structural-work,obstructions,or hazards caus®d thereby withoutexpense
to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed,the owners,shall, without expense to
the State,and to such extent and in such time and mannerasthe Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the
navigable and flood capacity of the watercourse. No claim.shall be made against the.State of New'York on
account of any such removal or alteration.
2. The State of New York shall in no case:be liable for any damage or injury to the structure or work herein.
authorized which may be caused by orresultfrom future operations undertaken by the State for the conselvation
or improvement of navigation,or for other purposes,and no claim or right to compensation shall accrue from any
such damage.
3. Granting of this permit does not relieve the applicant of the.responsibility of obtaining any other-permission,
consent or approval from the U.S.Army Corps of Engineers, U.S.Coast Guard,New York State Office of General
Services or local government which may be required.
4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project.
5. Any material dredged in the conduct of the work'herein permitted shall be removed evenly,without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep-holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.'
7: 'if upon the expiration or revocation of this permit, the project hereby authorized has not been.completed, the
applicant shall,without expense to the State,and to such extent and in such time and manner as the Department
Of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such removal or alteration.
8. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies thatthe
subject project will not contravene effluent limitations or other limitations or standards under Sections 301; 302,
303, 306 and 307 of the Clean Water Act of 1977(PL 95-217) provided that all of the conditions listed herein are
met.
9. At least 48 hours prior to commencement of the project,the pe'rmittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and undorstand all terms and
conditions of this permit. Within 30 days of dompletion of project, the'bottom portion of-the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or•his agent as.part of the permit application.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected-buffer areas.
2. The storage of construction equipment and materials shall be confined to terminus of Arshamonaque Avenue.
3. All dredged material shall be disposed on an approved upland site and be retained so as to not re-enter any water
body, tidal wetland or protected buffer area.
4. During the dredging operation,the permittee and his contractor shall prevent spillage of sediment during excavation
and haulage. Dredging shall be accomplished with a clam shell or other closed"bucket" equipment.
S. Excavated sediments shall be placed directly into the approved disposal site or conveyance vehicle. No
sidecasting (double dipping) or temporary storage of dredge material is authorized.
6. Dredging is prohibited from June 1 - September 30 of each year to protect spawning shellfish and/or spawning
finfish.
7. The use of a dragline for dredging is strictly prohibited.
8. Dredging shall be undertaken no more than once•in any calendar year unless specifically authorized by the
Department.
9: For maintenance dredging projects, per'mittee shall submit a Notice of Commencement prior to each dredging
occurrence, specifying the-disposal site (including an updated site plan). Upon completion, a Notice of Completion
specifying the amount of dredged material deposited at the approved disposal site must be submitted.

TERMS and CONDITIONS
The Permittee Beixedon Dredging Assn & John J. Nickles
residing at P.O. Box 877, Southold N. y, as
part. of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
i. That the said Board of Trustees and the Town of Southold ate released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oiler-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits-initiated by third parties, and the said Permittee assumes fall liability
with respect thereto, to the complete'exclusion of.the Board of Trustees of the Town of Southold
2. That this Permit is valid fora period of 24 mos. which is considered to be the
estimated time'required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with.the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the.said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
G. That there shall be no interference with the right of the public to pass and repass long
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the.removal and/or alterations .
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the.
work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice., to remove or alter this work or project herein stated without expenses to the Town .
of Southold.
S. That the said Board will be notified by the Permittee of the completion.of the work Auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 25,2001 regarding the above matter:
WHEREAS, Catherine Mesiano,Inc. on behalf of BEIXEDON DREDGING ASSN. &JOHN
J.NICKLES applied to the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated April 4, 2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 25, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS,the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of BEIXEDON DREDGING
ASSN. &JOHN J. NICKLES to maintenance dredge approx. 300 cy. of shoaled material from
the inlet to Petty's Pond to a depth of 5 feet below mean low water at 1:3 slopes, over an
irregularly shaped area with maximum dimension of 35'X 150', for the purpose of navigational
safety. Dredge spoil is to be deposited above mean high water on the eroded beach of the lot to
the west of the inlet. Silt fencing will be placed and maintained on the north, east and south
sides of the spoil site. The spoil site will be planted with Cape American beach grass on 18"
centers.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

A detailed description and plans of the applicants' activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact, including
cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national
concern for both protection and utilization of important resources. The benefits which reasonably may
be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments.
All factors which may be relevant to the proposal will be considered including the cumulative effects
thereof, among those are conservation, economics, aesthetics,general environmental concerns, wetlands,
historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion
and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and
fiber production,mineral needs,consideration of property ownership and,in general the needs and welfare
of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and
officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this
proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue,modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING
AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE,
otherwise, it will be presumed that there are no objections to the activity.
Any person may request, in writing, before this public notice expires, that a public hearing be held to
collect information necessary to consider this application. Requests for public hearings shall state, with
particularity, the reasons why a public hearing should be held. It should be noted that information

submitted by mail is considered just as carefully.in the permit decision process and bears the same weight
as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not likely
to affect any Federally endangered or threatened species or their critical habitat. However, pursuant to
Section 7. of the Endangered Species Act(16 U.S.C. 1531), the District Engineer is consulting with the f
appropriate Federal agency to determine the presence of and potential impacts to listed species in the
project area or their critical habitat. x
Based upon a review of the latest published version of the National Register of Historic Places, there are
no known sites eligible for, or included in, the Register within the permit area. Presently unknown
archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the
required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of the
guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority
of Section 404 (b) of the Clean Water Act and the applicants will obtain a water quality certificate or
waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior
to a permit decision.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456
(c)], for activities under consideration that are located within the coastal zone.of a state which has a
federally approved coastal zone management program, the applicants have certified in the permit
application that the activity complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver ofthe applicants' certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone'of New York State, the
applicants' certification and accompanying information is available from the Consistency Coordinator,
New York State Department of State, Division of.Coastal Resources and Waterfront Revitalization, -

WORK DESCRIPTION
The applicants, John J. Nickles and Beixedon Dredging Association, have requested Department
of the Army authorization to dredge material from Petty's Pond, Southold Bay at the Town of
Southold, Suffolk County, New York with ten years maintenance and subsequent beach
nourishment and upland disposal.
The work would involve dredging, with ten years maintenance, of approximately 300 cubic
yards of material from an irregularly shaped area with approximate dimensions of 35 feet by 150
feet in the inlet to Petty's Pond to a maximum depth of 5 feet below the plane of mean low
water. Side slopes of the proposed dredge area would have slopes of 1:3.
The dredged material would be placed above mean high water line as beach nourishment on an
adjacent beach to the west of inlet and/or on the upland property of Thomas Ball. All dredged
material be suitably retained so as to prevent reentry into any waterway.
Return flow would be authorized to reenter the waterway through after filtering through a silt
fence and hay bales.
Three additional dredging events are anticipated if a ten-year maintenance dredging permit is
issued. Approximately 300 cubic yards of material are anticipated to be dredged per event.
The stated purpose of this project is to restore and maintain previously authorized depths in the
inlet to Petty's Pond and nourish eroded beach.

Dear Southold Town Trustees:
We are writing in response to a dredging application by Beixedon Dredging
Association and John Nickles. Our property is adjacent to the proposed spoil site. We
are concerned because our property is being eroded by the bulkheads at the entrance of
the creek, particularly the groin on the east side of the creek. We feel the spoil should be
placed in such a manner that the eroded beach will be renourished. In years past the
dredging company placed the sand along the bulkheads with enough sand to cover the
rocks.
We are also concerned about the proposed silt fencing, which is to be placed and
maintained on the north, east and south sides of the spoil site. We feel this.will impede
the natural east to west movement of sand along the beach. The beach is badly eroded
and we are counting on the renourishing of the beach from the dredging every few years
to help alleviate the problem.
I would also like to have the applicant's survey, developed by Robert Fox,
amended to reflect that our correct address is 1980 Arshamomaque-Avenue. Also please
note that on the upper right hand corner of that survey it is stated that the applicant is
Beixedon Estates P.O.A. The applicant is not related in any way to the Beixedon Estates
Association, which includes all the property owners of Beixedon Estates.

My year:..-round full time residence is in Biexidon Estates
on the beach front at 1726 Arshamomaque Avenue, Southold.
It has come to my attention'-.that an application has been
made to dredge the inlet:..to Petty' s Pond.
1 . I have no objection to and support the dredging
of the inlet which is certainly required to keep the inlet
navigable.
2. I object to the disposition of the spoil as indicated
on the application and accompanying survey. The western
extent of the erosion is much greater than is indicated,
reaching as far as Rogers Road. The erosion of the whole
beach front west to Rogers Road is due, at least in part, to the
excessively long jetty extending into the Bay east of the
inlet which acts to starve the beach west of the inlet by
impeding the normal litoral drift and diverting the sand out
into the . Bay.
3. The spoil Should be placed along the beach
between the high and low water marksand be- permitted to drift
westward to nourish the beach. On PrEwIous oecagions whe�i'-,the
iftlet`:Vas' dredged, '.;the spoil wasi di8tributed" fal'bng the beach
west of the inlet.
4. . Please explain what is meant b "silt fencing"
and its purpose.

A dredge pulled in this morning(May 30,2008)in the Petty's Pond Boat Basin(John
Nickles project—permit#6830) It is dredging sand and placing the sand to'the east side
of the jetty. We ask that you immediately stop the work for the following reasons.
1. There doesn't appear to be a valid town permit for this dredging.
2. Dredging after the allowable deadline.
3. The sand(according to USACE permit)is to be placed on the western downdrift
beach.

The proposed spoil site has been significantly eroded and placement of dredge
spoil will replenish the shoreline as well as help replenish the longshore drift East
to West.
STATEMENT OF EFFECT, if any, on the wetlands and tidal waters of the town
that may result by reason of such proposed operations:
Minimal impact is anticipated.
• The depth of dredging is proposed at 5' to minimize potential for
undermining toe of existing bulkhead at east side of inlet.
• Boat traffic will cause bottom disturbance if dredging is not done.
• Spoil site is an eroded area that requires restoration.

YOU ARE HEREBY GIVEN NOTICE:
1. That it is the intention of the undersigned to request a Permit from the Board
of Trustees to:
Perform mechanical maintenance dredging of approximately 300 cubic yards of shoaled
material from the inlet to Petty's Pond to a depth of 5 feet below mean low water at 1:3
slopes, over an irregularly shaped area with maximum dimension of 35' x 150', for the
purpose of navigational safety.
Dredge spoil is to be deposited above mean high water on the eroded beach of the lot
to the west of the inlet. Silt fencing will be placed and maintained on the north, east and
south sides of the spoil site. The spoil site will be planted with Cape American Beach
Grass on 18" centers.
2. That the property which is the subject of Environmental Review is located
adjacent to your property and is described as follows:
Inlet to Petty's Pond at Town Harbor, Southold
and
Vacant lot at Arshamomaque Ave., Southold
3. That the project which is subject to Environmental Review under Chapters 32,
37,or 97 of the Town Code is open to public comment on April 25, 2001. You may
contact the Trustees Office at 765-1892 or in writing.
The above referenced proposal is under review of the Board of Trustees of the Town of
Southold and does not reference any other agency that might have to review same
proposal.
