Your proposal to cut the trees and shrubs in half in the adjacent area is not consistent with the intent of the Tidal Wetlands Act to preserve, protect and enhance the present and potential values of the tidal wetland. Cutting the vegetation will most likely destroy the oaks and cedars, thereby creating a negative impact to a valuable wildlife habitat currently utilized by various birds and rabbits for shelter and food. In addition, this area also serves as . a natural buffer to the residential community. Therefore, a permit cannot be issued for the project as proposed. However, as an alternative, the Department will approve a plan to cut the phragmites once a year and remove all cut material from the adjacent area. The original proposal, as described in Public Notice Number 93-04916-L2 issued April 28, 1993, involved the extension of the existing pier with an outer L-shaped fixed pier, installation of a tongue and groove wave curtain and new fixed platform and placing the existing floats and ramp on the west side of the fixed pier extension. A total of 16 pilings would have been placed west and east of the fixed pier to create boat slips. Additional pilings would have been installed to secure the fixed pier and the floats. The revised work would now involve the extension of a 6 foot by 96.5 foot fixed pier to 6 feet by 245 feet with an outer T- shaped fixed pier of 6 feet by 110 feet. Both fixed sections would have 20 foot sections of wave curtain on alternate sides with 10 foot spacing. Two 4 foot by 30 foot fixed finger piers would be placed north of the outer T-shaped section of the main fixed pier. Due to the existing construction of floating dock sections, we have experienced heavy damages from storms as well as being unable to attract our residents to use the facility because of rigorous and unsafe access to their boats. Seebode J Chief, Regulatory Branch 3 ;i CENAN-OP-RE PUBLIC NOTICE NO. 93-04910-L2 WORK DESCRIPTION The applicant, Cleaves Point Village, has requested Department of the Army authorization to modify an , existing pier assembly, construct an extension, and install floating wave curtain and pilings in Gardiners Bay at East Marion, Town of Southold, Suffolk County, New York. The work would involve the extension of a six foot by 96.5 foot fixed pier to six feet by 251 feet with an outer L-shaped fixed pier of six feet by 32 feet. The overall. length of the proposed fixed pier would be approximately equal to the length of the present pier, ramp, float and floating wave curtain. The tongue and groove wave curtain would be attached to the middle of the entire length of the proposed fixed pier. A new six foot by eight foot fixed platform and the existing floats and ramp would be placed on the west side of the fixed pier extension. Eleven pilings would be installed west of the fixed pier and five pilings would placed 20 feet east of the fixed pier to create boat slips. Additional pilings would be installed to secure the fixed pier and the floats. Proposed dock will retain existing 9 '-6" fixed inner section; and will extend existing 61x 901-6" fixed pier to 61x 235 ' with an outer "L" of 61x 321 . The overall length of the proposed fixed pier is equal to the length of the present fixed pier, ramp, float and floating wave curtain. A tongue and groove wave curtain will be attached to center of fixed pier (MLW) . A new 6 1 x 8 ' fixed platform will be added to the west side of fixed pier and the existing 31x 14 ' ramp and (6) 61x 201 floating docks placed on west side of fixed pier and secured by additional pilings. (11) pilings will be placed at various distances west of fixed pier; (5) pilings will be placed 20' east of fixed pier to create slips.
