The Trustees issued a permit to remove the shoal seaward of the bulkhead. 2. DEC personnel met with the Trustees, on site, along with approximately& concerned homeowners and Mr. Fragola. I was also present. 5. The DEC issued a permit. However, removal of the shoal was not permitted. A controversy has arisen. 4. Aerial photography and documentation prove that Fordham Canal was created in 1904. 5. Aerial photography indicates that all docks are parallel to the bulkhead or shoreline on Fordham Canal.There are no catwalks allowing interference with safety and navigation. 6. 1 believe that under the DEC's regulation dated May 2000 (see enclosed) Should have allowed the dredging and the dock secured to the bulkhead. There would have been no controversy as the homeowner's themselves have the same structures (see aerial photographs). 7. It appears that the permit expeditor was unaware of the change in regulations in May of 2000 and the DEC did not advise him of his error but proceeded to process the application as per the 1995 regulations. Thu:,the controversy in the community. 8. The responsibility of the error is innocent to all parties. 9. Mr. Fragola has agreed to the additional cost of the change and wants to correct the intrusion into the waterway. Furthermore, we were told that the DEC issued a corrective action plan to Mr. Fragola. To date, nothing -has been done. We have endured a difficult and hazardous boating season because this has not been corrected. Mr. Fragola's dock and boat are at a critical turning point in the canal and we cannot see around it when passing. Please advise us as to when we can expect to see this corrected. Al, we met last Fall on the site with town trustees present, two representatives of the DEC, and seven residents of adjoining properties to this project. All of us heard the DEC give Mr. Fragola and Rambo Marine Contracting the permission to place their float back, and in line with,the adjoining Rutkowski property. I consider the installation as it is now, which was placed by Rambo Marine,to not only be a contradiction to the allowance of the DEC, but to be an outright hazard to navigation and a danger to any boat attempting to negotiate this condition. Mr. Fragola is planning to put a 34 foot boat with a twelve foot beam at this dock. This will place the boat well into the center of the canal with no consideration for the property on the opposite shore or those who must attempt to pass in between. This is not acceptable. Mr. Fragola and Rambo Marine Contracting should be held to the original plan as set forth on location by the DEC last Fall. I consider this installation to be a danger and a hazard to my family and will hold all parties present at that Fall meeting responsible. Al, when Mr. Preston took this property and made a canal, it was his primary intention to provide a navigable waterway, not a weed farm or a clam nursery. Most of all, he was concerned with safe boating. All else is secondary. There were no clams here. There were no weeds here. These are benefits derived from his undertaking. WHEREAS,En-Consultants,Inc. on behalf of DONNA FRAGOLA applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated August 30, 2001. WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 20, 2001 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. Please also note that the proposed dwelling has been reconfigured and enlarged, as reflected on the revised site plan prepared by Joseph Ingegno,L.S., last dated December 5, 2001, three copies of which are also attached hereto. This change brings the proposed house no closer to the wetland boundary, however, as the northwesterly corner of the house—the point of the house nearest to the wetlands— remains set back a minimum of 75' from the wetland boundary on the adjoining parcel. Although I have similarly reflected this change on the En-Consultants, Inc. project plan, the language of the wetland permit should of course refer both to the project plan prepared by En-Consultants, Inc. for the proposed marine construction and to the site plan prepared by Joseph Ingegno, L.S., for the upland structures.
