Martocchia, 16 South Street, Greenport, New York, at 3 :00 P.M. Tuesday, November 26, 1974, with the following present: Supervisor Albert M. Martocchia Councilman James Homan Justice Martin Suter Justice .Louis M., Demarest Town Attorney Robert W. Tasker Highway Superinteddent Raymond C. Dean Town Clerk Albert W. Richmond Absent: Councilman James H. Rich, Jr. Justice Francis T. Doyen On motion of Councilman Homan,, seconded by Justice -Suter, it was RESOLVED that the minutes of the Southold Town Board meeting held November 7, 1974 be approved as submitted. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the next. regular meeting of the Southold Town Board will be held at' 3 :00 P.M. , Tuesday, December 10 , 1974 at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes :- Supervisor Martocchia, Councilman Homan,, Justice Suter, Justice Demarest. Supervisor Martocchia called a recess at 3 :30 P.M. for the purpose of holding two public hearings on Wetland applications by Clempner and Mastrosimone. Muriel Brush took the minutes for the public hearings. The meeting reconvened at 4 :00 P.M. On motion of. Justice Demarest, seconded by Councilman _Homan, WHEREAS Section 123 of the Town Bafwrprovides that town officials and employees who receive and disburse monies of the Town shall account to the Town Board for all monies received and disbursed by them by the 20th day of January, and WHEREAS the Town Board deems it neeessary to engage a public accountant to prepare the aforesaid annual account for all town officers and employees, NOW, THEREFORE, BE IT RESOLVED that the Town Board engage the services of Elaine F. Kaldor, Certified Public Accountant, to make the annual audit of the books and records of officers and employees of the Town of Southold for the fiscal year 1974 at a contract fee of $1, 200.00. Vote of the Town Board: Ayes : Supervisor Martocchia , Councilman Homan, Justice -Suter, Justice Demarest. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board authorize the payment of 3 , 000.00 bill of Smith, Finkelstein, and others. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in awarding lowest bidder A. John NOV �; 6.,1$74,.: 24 Gada the contract to make certain repairs to Building #239, known as the State Police Quarters , in the amount of $1, 197 .00 . Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman HQmap, CJus.tice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board authorizes the Supervisor to sign the following contract with the Southold United Methodist Church: WITNESSETH, that the said party of the first part has letten and by those present does grant and demise unto the said party of the second part, and the said party of the second party has hired and taken and by these presents do hire and take of and from the party ofthe first part a non-exclusive use of areas of the basement of the Southold United Methodist Church as shown on the shaded a'reas of the sketch attached hereto. The said use shall be in the evenings and not to exceed four evenings per week, the. choice of evenings to be coordinated with the other activities o,f the church, so as not to interfere therewith. The Church Minister is to approve the times requested. The Southold United Methodist Church shall be paid $5 . 00 per night of use by the Town of Southold, when billed by the church. The purpose of the occupancy provided for herein shall be limited to those of the Youth Activities Center of the Southold Town Community Services Committee. The Church will provide the utilities, heat, storage areas , tissue, towels, etc. Existing equipment such as ping-pong and pool tables may be used by the lessee. The lessee shall provide adequate chaperones for the Youth Activities. The lessee will clean the areas used by the Youth Activities group a,f ter each use, it being understood that this must be accomplished prior to Sunday morning church use. The lessee will indemnify the lessor for any damage to pe:r'sons or property occurring as a result of the use by the Youth Activities group and will provide insurance coverage therefor. This lease may be terminated at the written request of either party of this agreement on seven (7) days notice to the other. AND that at the expiration of the said term the saiid party of the second part will quit and surrender the premises hereby demised in as good state and condition as reasonable use and weare- thereof will permit, damages by the elements excepted. AND- the paid party of the first part does covenant that the said party of the second party, on paying the said rent, and performing the covenants aforesaid, shall and may peacably and quietly hold, have and enjoy the said demised premises for the term aforesaid. This instrument may not be changed orally. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, . Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board does hereby release the $32, 000.00 bond for roads and other improvements in the subdivision known as Fairy Farms located on the west side of Cases 'Lane, Cutchogue, wl�xNew York, owned by Fair -i-e Farms, Inc. Vote of the Town -Board: Ayes : Supervisor Martocchia, ' Councilman Homan, Justice Suter, Justice Demarest. On motion of Councilman Homan, seconded by Justice Suter, WHEREAS the Southold American' Legion, Griswold-Terry-Glover Post #803 , has applied to the Town Clerk for a Bingo License, and WHEREAS the Town Board has examined the application and after investigation, duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board N0 V2 61974 the findings and determinations required by law, and it is further RESOLVED that the Town. Clerk be and he hereby is directed to issue a Bingo License to the Griswold-Terry-Glover Post #803 American Legion, Southold, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Councilman Homan, seconded by Justice Demarest, WHEREAS the Southold American Legion Auxiliary, Griswold- Terry- Glover Post #803, has applied to the Town Clerk for a Bingo License, and WHEREAS the Town Board has examined the application and after ihvestigatiun, duly made findings and' determinations as required by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is authorized and directed to execute cn behalf of the Town Board the findings and determinations required by law, and it is further RESOLVED that the Town Clerk be and he hereby is directed to issue a Bingo license to the American Legion Auxiliary, Griswold-Terry- Glover Post #803 , American Legion, Southold, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. Application for a trailer permit submitted by Frank Carlin, dated November 13 , 1974 was received and held for study. On motion of Justice Demarest, ,seconded by Councilman Homan, it was RESOLVED that Supervisor Martocchia and Town Attorney Tasker be and they hereby are authorized to advertise for bids fora dog pound. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board does hereby release the $19, 000. bond for roads and other improvements in the subdivision known as "Willow Point'? located on the east side of Bay Home Road, Southold, New York, and owned by Bleeker Construction Co. , Inc. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Suter, seconded by Justice Demarest, ' WHEREAS Bleeker. Construction Co. , Inc: has made application to the Town Board to dedicate certain highways at Southold to be known as Budd ' s Pond Road and Willow Point Road, more fully described in said petition, together with release executed by the owners thereof, and WHEREAS the Highway Superintendent has inspected the said highways and has advised the Town Board that said proposed highways comply in all respects with the specifications for the dedication of highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and he hereby is authorized and directed to forthwith cause the dedication, release and deed to be recorded in the office of the Clerk of the County of Suffolk. Vote of the Town Board: Ayes : Supervisor Martocchia , Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that the Town Clerk be and he hereby is instructed to request the Long Island Lighting Company to remove existing light on Pole #NYT367, and install a new area flood light type fixture on Pole 4NYT753 at the parking area, opposite the post office in Southold Village. Vote of the Town Board: Ayes : Supervisor Mattocchia, Councilman Homan, Justice Suter, Justice Demarest. `"`N O V 2 61974 2 d; On motion' of Justice. Demarest, seconded by Councilman Homan, it was RESOLVED that Supervisor k1bert M. , Martocchia be and he hereby is authorized to advertise for bids for five new police cars and a' Supervisor ' s car. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to complete the purchase of two copy machines in the amount of 1126, 90 with Litton Industries Credit Corporation. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. Mr. David Driscoll presented a proposal to the Town Board for a dog leash ordinance. Copy filed in the Town Clerk ' s Office. Mr. Frank Pospisil returned to the Town Board a Town check covering payment for a senior citizen 's luncheon drawn on the senior citiziens recreation account, requesting that this bill be paid from some other account, and not the recreation account. Marjorie Meyer inquired about a map published in the Long Island Traveler-Mattituck Watchman indicating a Town recreation area on the corner of Route 27A and Mill Lane, Peconic. She was advised that the property in question is not Town owned and the Town Board knows n.nohhing about it. Gladys Csajko held a lengthy discussion with the Board members relative to the salaries paid what she consideres part-time officials ; keeping of dogs in the holding building at night before transporting them to Riverhead; keeping records of Town -Board executive sessions ; leash laws ; failure to take verbatim records of T Town Board meetings . Town Attorney Tasker advised Mrs. Csajko that the law does not require minutes to be taken of Executive Sessions , and the Town Clerk is only required to make a record of resolutions of the Town Board and otherofficial business. Valentine Ruch appeared before the ,T6wn Board to discuss the drainage area in his development. On motion of Justice Suter, seconded by- Councilman Homan, it was RESOLVED ,that this .Town Board meeting be adjourned at 6: 00 P.M.
