CEHA- Julia Mavellia - 1525 North Sea Drive, Southold, New York
WHEREAS, applicant Julia Mavellia, by her agent Dominic Mavellia, by application dated June
25, 2026 and received July 9, 2026, appealed to the Town Board of the Town of Southold,
sitting as Coastal Erosion Hazard Area Board of Review, from the Board of Trustees' June 15,
2026 denial of a Coastal Erosion Hazard Area (CEHA) Permit for the as-built, in-place
reconstruction of an existing 645 square-foot raised deck with stairs at 1525 North Sea Drive,
Southold,New York(SCTM# 1000-54-4-17), under Section I I I of the Coastal Erosion Hazard
Area Law (the "Law"), or in the alternative sought a variance; and
WHEREAS, on August 25, 2026, the Town Board conducted a duly noticed public hearing on
the appeal at which all interested parties were heard and testimony was taken of the applicant's
consultant; and
WHEREAS, the Board of Trustees, by determination dated July 8, 2026, approved a Wetland
Permit under Chapter 275 for the same deck and stairs, as depicted on the site plan of Charles
W. Kuehn, Architect, received June 29, 2026 and stamped approved July 8, 2026; and
WHEREAS, under § 111-9 of the Law a permit issues only upon findings that the activity is
reasonable and necessary, is not likely to cause a measurable increase in erosion, and prevents or
minimizes adverse effects on natural protective features, and §§ I I 1-13 and I I I-I 6(C) accord
dunes the greatest protective value, allow only nonmajor additions to existing structures in dune
areas, and require that dune crossings be elevated; the Town Board finds the as-built deck and
stairs satisfy § 111-9, while the wood-framed walkway laid through the dune does not, such that
its removal is necessary to satisfy the Law and resolve the LWRP Policy 4.2 inconsistency; and
WHEREAS, the application has been reviewed pursuant to Chapter 268, Waterfront Consistency
Review, of the Town Code and the Local Waterfront Revitalization Program; now, therefore, be
it
RESOLVED that the Town Board finds that the proposed action is a Type 11 Action not subject
to review under the SEQRA Rules and Regulations; and be it further
RESOLVED that the Town Board hereby adopts the Findings and Determination dated August
25, 2026, and GRANTS the application of Julia Mavellia for a Coastal Erosion Hazard Area
Permit pursuant to Chapter 111-20 of the Law for the as-built deck and stairs approved by the
Board of Trustees on July 8, 2026, upon the express CONDITION that the wood-framed
walkway (wooden platform) extending from the concrete walkway to the beach and bluff line,
approximately ninety (90) feet in length, be removed; and be it further

Public Safety Resolution
WHEREAS, the Town Board of the Town of Southold (the "Town Board"), acting in its
capacity as the Board of Police Commissioners of the Southold Town Police Department (the
"Department"), is committed to the safety and well-being of all residents of the Town and to
maintaining public trust in local law enforcement; and
WHEREAS, operations conducted within the Town by outside law enforcement agencies may
create confusion, fear, and the potential for public safety incidents absent clear local response
procedures; and
WHEREAS, the Chief of Police has prepared a public safety response procedure governing the
response of the Department to such operations, which is intended to protect public safety,
preserve trust between the Department and the community, and ensure timely and transparent
communication with Town officials and residents; and
WHEREAS, the Town Board has determined that formal acknowledgment and publication of
such procedures, together with the creation of a standing Public Safety Committee by a separate
resolution, serve the public interest;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southold,
acting in its capacity as the Board of Police Commissioners, hereby acknowledges public safety
response procedures governing the response of the Department to operations conducted within
the Town by outside law enforcement agencies, to be interpreted and implemented consistent
with Chapter 55 of the New York State Laws of 2026 and all other applicable state and federal
law, and without restricting the Department's authority to investigate or enforce violations of the
Penal Law or other criminal statutes; and be it further
RESOLVED, that the Town Board and the Chief of Police will maintain written public safety
response procedures consistent with this resolution, which shall provide, at a minimum, that:
(a) when the Department is notified,by a call to 911 or police headquarters, of an outside
agency operation within the Town or the Village of Greenport, an officer will be dispatched to
verify the operation; and that upon verification, officers will provide a peacekeeping and
calming presence, with body-worn cameras activated in accordance with Department policy,
will neither obstruct nor assist the operation absent a judicial warrant or act as otherwise
required by law and will monitor and seek to de-escalate any confrontation involving bystanders,
and will neither direct, control, nor position themselves so as to impede the operation;
(b) upon verification of an operation affecting public safety, the Chief of Police or his or her

designee will notify the Town Supervisor or his or her designee, who will in turn notify the
members of the Town Board, the Mayor of the Village of Greenport, and the administrators of
affected schools, hospitals, and clinics, such notification is for situational awareness and
preparedness only;
(c) following verification and notification of an operation affecting public safety, the Chief of
Police or his or her designee will issue a timely public statement containing non-sensitive details
of the incident; and
(d) all sworn members of the Department will receive ongoing de-escalation training; and be it
further
RESOLVED, that in addition to the above verification and notification of an operation affecting
public safety, the Board of Police Commissioners, comprising the members of the Town Board,
will conduct a review of the public safety response with recommendations for further action if
circumstances warrant. Non-sensitive details of this review will be shared with the Public Safety
Committee at timely intervals, in a manner that ensures transparency while protecting ongoing
investigations and officer safety; and be it further
RESOLVED, that this resolution is adopted in conjunction with, and shall be read together with,
a standalone resolution of the Town Board that concludes the work of the Public Safety Task
Force established by Resolution 2026-167 and establishes in its place a Public Safety
Committee; and that the Public Safety Committee acting at the direction of the Town Board
shall serve as the principal vehicle for community education and communication regarding the
public safety procedures adopted by this resolution, including the development and
dissemination of educational materials explaining the procedures, what residents can expect
from the Department during outside agency operations, and how to report incidents through 91.1.

WHEREAS, applicant Julia Mavellia, by her agent Dominic Mavellia, by application dated June
25, 2026 and received July 9, 2026, appealed to the Town Board of the Town of Southold, sitting
as Coastal Erosion Hazard Area Board of Review, from the Board of Trustees' June 15, 2026
denial of a Coastal Erosion Hazard Area(CEHA)Permit for the as-built, in-place reconstruction
of an existing 645 square-foot raised deck with stairs at 1525 North Sea Drive, Southold,New
York(SCTM # 1000-54-4-17), under Section 111 of the Coastal Erosion Hazard Area Law (the
"Law"), or in the alternative sought a variance; and
WHEREAS, on August 25, 2026, the Town Board conducted a duly noticed public hearing on
the appeal at which all interested parties were heard and testimony was taken of the applicant's
consultant; and
WHEREAS, the Board of Trustees,by determination dated July 8, 2026, approved a Wetland
Permit under Chapter 275 for the same deck and stairs, as depicted on the site plan of Charles W.
Kuehn, Architect,received June 29, 2026 and stamped approved July 8, 2026; and
WHEREAS, under § 111-9 of the Law a permit issues only upon findings that the activity is
reasonable and necessary, is not likely to cause a measurable increase in erosion, and prevents or
minimizes adverse effects on natural protective features, and §§ 111-13 and 111-16(C) accord
dunes the greatest protective value, allow only nonmajor additions to existing structures in dune
areas, and require that dune crossings be elevated; the Town Board finds the as-built deck and
stairs satisfy § 111-9, while the wood-framed walkway laid through the dune does not, such that
its removal is necessary to satisfy the Law and resolve the LWRP Policy 4.2 inconsistency; and
WHEREAS, the application has been reviewed pursuant to Chapter 268, Waterfront Consistency
Review, of the Town Code and the Local Waterfront Revitalization Program; now, therefore, be
it

RESOLVED that the Town Board finds that the proposed action is a Type II Action not subject
to review under the SEQRA Rules and Regulations; and be it further
RESOLVED that the Town Board hereby adopts the Findings and Determination dated August
25, 2026, and GRANTS the application of Julia Mavellia for a Coastal Erosion Hazard Area
Permit pursuant to Chapter 111-20 of the Law for the as-built deck and stairs approved by the
Board of Trustees on July 8, 2026,upon the express CONDITION that the wood-framed
walkway (wooden platform) extending from the concrete walkway to the beach and bluff line,
approximately ninety (90) feet in length,be removed; and be it further
RESOLVED that this Determination shall not affect or deprive any other agency of its properly
asserted jurisdiction, separate and apart from the proceedings under the Coastal Erosion Hazard

WHEREAS, the Town Board of the Town of Southold(the "Town Board"), acting in its capacity
as the Board of Police Commissioners of the Southold Town Police Department (the
"Department"), is committed to the safety and well-being of all residents of the Town and to
maintaining public trust in local law enforcement; and
WHEREAS, operations conducted within the Town by outside law enforcement agencies may
create confusion, fear, and the potential for public safety incidents absent clear local response
procedures; and
WHEREAS, the Chief of Police has prepared a public safety response procedure governing the
response of the Department to such operations, which is intended to protect public safety,
preserve trust between the Department and the community, and ensure timely and transparent
communication with Town officials and residents; and
WHEREAS, the Town Board has determined that formal acknowledgment and publication of
such procedures, together with the creation of a standing Public Safety Committee by a separate
resolution, serve the public interest;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southold, acting
in its capacity as the Board of Police Commissioners, hereby acknowledges public safety
response procedures governing the response of the Department to operations conducted within
the Town by outside law enforcement agencies, to be interpreted and implemented consistent
with Chapter 55 of the New York State Laws of 2026 and all other applicable state and federal
law, and without restricting the Department's authority to investigate or enforce violations of the
Penal Law or other criminal statutes; and be it further
RESOLVED, that the Town Board and the Chief of Police will maintain written public safety
response procedures consistent with this resolution, which shall provide, at a minimum, that:

(a) when the Department is notified, by a call to 911 or police headquarters, of an outside
agency operation within the Town or the Village of Greenport, an officer will be dispatched to
verify the operation; and that upon verification, officers will provide a peacekeeping and calming
presence, with body-worn cameras activated in accordance with Department policy, will neither
obstruct nor assist the operation absent a judicial warrant or act as otherwise required by law and
will monitor and seek to de-escalate any confrontation involving bystanders, and will neither
direct, control, nor position themselves so as to impede the operation;
(b) upon verification of an operation affecting public safety, the Chief of Police or his or her
designee will notify the Town Supervisor or his or her designee, who will in turn notify the
members of the Town Board, the Mayor of the Village of Greenport, and the administrators of
affected schools, hospitals, and clinics, such notification is for situational awareness and
preparedness only;
(c) following verification and notification of an operation affecting public safety, the Chief of
Police or his or her designee will issue a timely public statement containing non-sensitive details
of the incident; and
(d) all sworn members of the Department will receive ongoing de-escalation training; and be it
further
RESOLVED, that in addition to the above verification and notification of an operation affecting
public safety, the Board of Police Commissioners, comprising the members of the Town Board,
will conduct a review of the public safety response with recommendations for further action if
circumstances warrant. Non-sensitive details of this review will be shared with the Public Safety
Committee at timely intervals, in a manner that ensures transparency while protecting ongoing
investigations and officer safety; and be it further
RESOLVED, that this resolution is adopted in conjunction with, and shall be read together with,
a standalone resolution of the Town Board that concludes the work of the Public Safety Task
Force established by Resolution 2026-167 and establishes in its place a Public Safety
Committee; and that the Public Safety Committee acting at the direction of the Town Board shall
serve as the principal vehicle for community education and communication regarding the public
safety procedures adopted by this resolution, including the development and dissemination of
educational materials explaining the procedures, what residents can expect from the Department
during outside agency operations, and how to report incidents through 911 or police
headquarters. The Public Safety Committee shall also communicate the non-sensitive details of
the Police Commissioner's periodic reviews of Public Safety Response.
