The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, August 10, 2026:
WHEREAS, this proposed Resubdivision application is to transfer ± 6,639 sq. ft. from
SCTM#1000-102.-4-3.4 to SCTM#1000-102.4-10 resulting in the decrease of
SCTM#1000-102.-4-3.4 from ± 24,888 sq. ft. to ± 18,249 sq. ft. and the increase of
SCTM#1000-102.4-10 from ± 162,675sq. ft. to ± 169,314 sq. ft. in the A-C Zoning
District; and
WHEREAS, on January 12, 2026 the Southold Town Planning Board granted
Conditional Final Plat Approval on the plat entitled "Kensington Real Estate Holdings,
LLC Lot Line Modification" prepared by Howard W. Young, licensed land surveyor dated
April 15, 2025; and
WHEREAS, on January 28, 2026, the Zoning Board of Appeals (ZBA) granted an area
variance for the non-conforming lot size of Proposed Lot 1 per ZBA File #8059 which
satisfies Condition #1; and
WHEREAS, on April 29, 2026, the applicant submitted six copies of the Final Plat with
the required revisions which satisfies Condition 2; and

WHEREAS, on July 10, 2026, the applicant stated that the property monuments had
been installed and submitted Draft Deeds for review. The submission of these materials
which satisfy Conditions #3 and #4; and
WHEREAS, on July 28, 2026 the applicant requested an extension of approval as the
Conditional Final Plat Approval expired; and
WHEREAS, the Planning Board determines that the proposed action meets all the
necessary requirements of Town Code §240-57 for a Resubdivision application; and
WHEREAS, pursuant to Town Code §240-41, concrete monuments to mark the
property boundaries are required; be it therefore
RESOLVED, that the Southold Town Planning Board hereby waives the requirement to
receive approval from the Suffolk County Department of Health Services prior to
approval of this Resubdivision by the Southold Town Planning Board; and be it further
RESOLVED, the Southold Town Planning Board grants a six-month extension of
Conditional Final Plat Approval on the plat entitled "Kensington Real Estate Holdings,
LLC Lot Line Modification" prepared by Howard W. Young, licensed land surveyor dated
April 15, 2025; and be it further
RESOLVED, that the Southold Town Planning Board grants Final Plat Approval upon
the map entitled "Kensington Real Estate Holdings, LLC Lot Line Modification" prepared
by Howard W. Young, licensed land surveyor dated April 15, 2025 and last revised
March 24, 2026.
The deeds must be filed within 90 days of the date of this resolution or such
approval shall expire and be null and void. Submit proof of recording and a copy
of the recorded deeds to the Southold Town Planning-Department.

Please Note: The Southold Town Planning Board, in waiving the requirement for
SCDHS approval prior to their own approval, is simply waiving a technical requirement
of Final Plat Approval under the Town Code and makes no representations as to
whether SCDHS approval is required. SCDHS approval of this re-subdivision may be
necessary to be in compliance with the Suffolk County Sanitary Code, and to be eligible
for future construction or renovations.

resolution. The Chairman will endorse the approval resolution once the Health
Department waiver is signed by both property owners.

The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, August 10, 2026:
WHEREAS, this site plan application proposes the development of an agricultural site

Quality Review Act (SEQRA), has determined the proposed as a Type II Action as it
falls within the following description for 6 NYCRR, Part 617.5(c)(4) agricultural farm
management practices, including construction, maintenance and repair of farm buildings
and structures, and land use changes consistent with generally accepted principles of
farming; and be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is a Type 11 Action under SEQRA as described above; and be it further

sign & post will need to be picked up at the Planning Board Office at the Southold

The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, August 10, 2026:
WHEREAS, this proposal is for a clustered two-lot standard subdivision of 8.81 acres,
where Lot 1 is 1.8 acres and Lot 2 is 7.01 acres of open space in the R-120 Zoning
District; and
WHEREAS, on March 3, 2026, Karen Hoeg, authorized agent, submitted a Sketch Plan
application and fee; and
WHEREAS, on June 3, 2026, Karen Hoeg, authorized agent, submitted additional
Sketch Plan application materials for review; and
WHEREAS, on July 27, 2026, at their work session, the Planning Board found the
application complete, with required items that could be submitted during the Preliminary
Plat application review stage; and
WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Planning Board has
the ability to waive certain provisions of the subdivision code, if they are not requisite in
the interest of public health, safety, and general welfare; and

WHEREAS, on July 27, 2026, at their work session, the Planning Board found that the
requirement to submit an existing resources site analysis plan (ERSAP) and the primary
and secondary conservation area map could be waived because the subject parcel
contains no wetlands or other environmentally sensitive areas, and thus can be
analyzed without the need for an ERSAP or a conservation area map; and
WHEREAS, on July 27, 2026, at their work session, the Planning Board reviewed this
application to Town Code Chapter 240 and found it to be ready for a determination;
therefore be it
RESOLVED, that pursuant to §240-56 Waivers of certain provisions, the Southold Town
Planning Board hereby waives the following subdivision requirements;
1. Existing resources site analysis plan (ERSAP), and
2. Primary and secondary conservation area map; and be it further
RESOLVED, that the Southold Town Planning Board grants a Conditional Sketch
Plat Approval on the map entitled "Fishers Island Development Corporation" prepared
by Craig P. Bigger, Licensed Land Surveyor, dated February 19, 2026, with the
following conditions:
1. Submit a Preliminary Plat with the following edits to the Sketch Plana:
a. Change the Title: Clay Point Standard Subdivision. Preliminary Plat
b. Correct/Remove errant metes and bounds that are shown on the Sketch Plan
and not associated with existing or proposed lot boundaries.
c. Show the locations of proposed concrete monuments to mark the proposed
lot corners.
The next step to continue towards approval is to meet all conditions stated
above, and to submit a Preliminary Plat Application and Fee.
Sketch Plat Approval shall expire six months from the date the Planning Board
adopted its resolution of approval unless extended by further resolution of the
Planning Board.

The Southold Town Planning Board adopted the following resolutions at a meeting held
on Monday, August 10, 2026:
WHEREAS, on December 23, 2025, the applicant submitted a Resubdivision
application for review by the Southold Town Planning Board; and
WHEREAS, this proposed resubdivision application is to transfer ± 9,886 sq. ft. from
SCTM#1000-9.-5-14 to SCTM1000-9.-5-16.1 resulting in the decrease of SCTM1000-
9.-5-14 from ± 41,132 sq. ft. to ± 31,246 sq. ft. and the increase of SCTM1000-9.-5-

WHEREAS, at their work session on May 18, 2026, the Southold Town Planning Board
found the Resubdivision application complete; and
WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town
Planning Board shall have the authority to modify or waive, subject to appropriate
conditions, any provision of these subdivision regulations, if in its judgment they are not
requisite in the interest of the public health, safety and general welfare, except where
such authority would be contrary to other ordinances or state law; and
WHEREAS, the Southold Town Planning Board has determined that the following
provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the

interest of the public health, safety and general welfare because this Resubdivision
does not create any additional residential building lots, and the amount of land being
transferred from one lot to the other is small, and therefore are eligible for a waiver..

receiving approval by the Suffolk County Department of Health Services (SCDHS) as it
meets the following criterion set forth in that policy:
0 Where both lots are already developed,
* Where no new development potential will be created in the parcel to which the
land is transferred-, and
WHEREAS, this application is EXEMPT from review by the Local Waterfront
Revitalization Program as no new development potential will come as a result of this
Resubdivision; and
WHEREAS, on July 13, 2026, a Public Hearing was held and closed; and
WHEREAS, the Planning Board determines that the proposed action meets all the
necessary requirements of Town Code §240-57 for a Resubdivision application,
therefore, be it
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is a Type 11 Action under SEQRA according to 617.5(c)(16) "granting of individual
