Krupski, Jr., to execute an agreement extending the contract with the North Fork Animal Welfare League, as first extended from March 1, 2026 through June 30, 2026, and now further extended through October 31, 2026, at a rate of$24,801.75 per month, subject to the approval of the Town Attorney,budget line A3510-540450. 2026-680 Category: Donation Department: Town Attorney Accept Donation Rheem Energy Star HVAC system WHEREAS, the Town Board of the Town of Southold, pursuant to New York Agriculture and Markets law, is required to provide Animal Shelter services for the Town of Southold, which includes proper shelter, proper ventilation, temperature controls, and other standards; and WHEREAS, the Town Board also agrees to be responsible for the mechanicals at the shelter, to include,heating, ventilation, and air conditioning services (HVAC). Tanner Vaccarella (1st year) $21.83 2026-687 Category: Employment-FIFD Department: Accounting Approve Resolution Number 2026-085 RESOLVED that the Town Board of the Town of Southold hereby ratifies and approves Resolution Number 2026-085 of the Fishers Island Ferry District, adopted August 3, 2026, which reads as follows: WHEREAS Frederick Stanley has performed with merit in the duties of a full-time deckhand, and WHEREAS the manager has recommended that said deckhand's wages be increased Therefore, it is RESOLVED that Frederick Stanley's hourly wage be increased from $20.00 per hour to $21.00 per hour with effect August 13, 2026. 2026-688 Category: Legal Department: Town Attorney New York State Freedom of Information Law (FOIL) WHEREAS, pursuant to the provisions of the New York State Freedom of Information Law (FOIL),public agencies are required to designate a person or body to hear and determine appeals regarding the denial of access to public records under Public Officers Law § 89(4)(a); and WHEREAS, the Town Board of the Town of Southold is currently designated as the FOIL Appellate Body for the Town; and WHEREAS, to streamline administrative efficiency and ensure specialized legal oversight in evaluating complex records disclosure appeals, the Town Board desires to transfer the authority to hear and determine such appeals to the Office of the Town Attorney; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southold hereby appoints the Southold Town Attorney, Benjamin F. Johnson, as the official FOIL Appeals Officer for the Town of Southold; and BE IT FURTHER RESOLVED, that the Appeals Officer is fully authorized and directed to hear, review, and issue final determinations on all written FOIL appeals within the ten (10) business days' timeframe mandated by New York State Law; and BE IT FURTHER RESOLVED, that the Southold Town Clerk's Office and the Town Records Page 9 of 79 Management Officer are hereby directed to update all relevant public forms, applications, and town websites to reflect that subsequent FOIL appeals must be directed in writing to: Benjamin F. BOX 1179 Southold,New York 11971 BE IT FURTHER RESOLVED, that this designation shall take effect immediately and shall remain in effect until otherwise amended by a subsequent resolution of this Board. 2026-689 Category: Enact Local Law Department: Town Attorney Amend Resolution 2026-613 - Enact LL Change of Zone-Pickett Power RESOLVED, that the Town Board of the Town of Southold hereby amends Resolution No. 2026-613, adopted July 14, 2026, to read in its entirety as follows: WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County,New York, on the 16th day of June 2026, a Local Law entitled "A Local Law to amend the Zoning Map of the Town of Southold by Changing the Zoning Designation identified on the Suffolk County Tax Map as Lot#1000-012-2-6.013, The Fishers Island Waste Management District, Fishers Island, from R-120 to Light Industrial (LI)"; and WHEREAS, in the project narrative, the applicant has stated that the only use in the Light Industrial zoning district that is requested is a commercial solar energy facility, along with the ability in the future, subject to further review and approvals, to add complementary battery energy storage; and WHEREAS, the Town Board of the Town of Southold held a duly noticed public hearing on the aforesaid Local Law, at which time all interested persons were given an opportunity to be heard; and WHEREAS, the Town Board of the Town of Southold,pursuant to the State Environmental Quality Review Act (SEQRA), acting as lead agency, granted a negative declaration at the June 16, 2026 public hearing; and WHEREAS, the SEQRA Negative Declaration was based on the restriction of uses allowed in the Light Industrial zoning district to commercial solar energy production only, with the location on and next to the capped landfill outside the wetlands on site; and WHEREAS, the restrictions upon the uses permitted on the subject property, as set forth herein, are integral components of the action as proposed and reviewed by the Town Board acting as lead agency, and are not conditions imposed to avoid or mitigate an otherwise significant adverse environmental impact; and WHEREAS, the Town Board of the Town of Southold found this application to be consistent with the Local Waterfront Revitalization Program at its June 16, 2026 public hearing; and WHEREAS, the Town Board of the Town of Southold finds that this change of zone is made in accordance with a comprehensive plan as required by Town Law §263, and is consistent with the goals and policies of the Town's Comprehensive Plan; and WHEREAS, the Southold Town Planning Board, in its memo dated June 15, 2026, recommended this change of zone be approved for the purpose of solar energy production because it is a beneficial use of a capped landfill; and Page 10 of 79 WHEREAS, the Town Board of the Town of Southold referred the Local Law to the Suffolk County Planning Commission, and at the time of the public hearing those comments were not received, and the hearing was held open to receive the comments; and WHEREAS, the Suffolk County Planning Commission has issued its report regarding the proposed Local Law after a public hearing, approving the proposed Local Law subject to four conditions: (1) should the zoning be approved and a site plan for a solar energy array be submitted, the plans would be subject to Suffolk County Planning Commission review; (2) approval of a special exception must be obtained before the plan can be approved, subject to review by the Suffolk County Planning Commission; (3) the applicant should provide a"proof of concept letter" from the local utility company acknowledging that the solar farm will be interconnected to the utility grid to sell electricity to the public utility; and (4) any application must be accompanied by a decommissioning plan; now therefor be it RESOLVED, the Town Board of the Town of Southold,having considered the report and recommendation of the Suffolk County Planning Commission, hereby adopts and incorporates the conditions recommended by the Commission, as reflected in Section 2 of this Local Law, and further finds that the Commission's recommendation that any subsequent site plan and special exception application be referred to the Commission for review is satisfied by operation of General Municipal Law §239-m at those subsequent stages of review; and be it further RESOLVED, that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled "A Local Law to amend the Zoning Map of the Town of Southold by Changing the Zoning Designation identified on the Suffolk County Tax Map as Lot#1000-012- 2-6.013, The Fishers Island Waste Management District, Fishers Island, from R-120 to Light Industrial (LI)." LOCAL LAW OF 2026 Section 1. Purpose. The purpose of this Local Law is to amend the Zoning Map of the Town of Southold to provide a location on Fishers Island for commercial solar energy production, to enhance access to alternative energy, in accordance with the Town's Comprehensive Plan and Local Waterfront Revitalization Program,by changing the zoning designation of the property identified on the Suffolk County Tax Map as Lot#1000-012-2-6.013 to a zoning district that will allow that use. Section 2. Code Amendment. The Zoning Map of the Town of Southold is hereby amended by changing the zoning designation of the parcel known as SCTM#1000-012-2-6.013 from R-120 to Light Industrial (LI), subject to the following conditions: 1. The only permitted uses allowed on the subject property are commercial solar energy production, with a possible future complementary battery energy storage system (BESS) allowed only if it meets any and all standards and regulations enacted by the Town of Southold for BESS, including being subject to any moratoria on BESS, and including the possibility that BESS may not be allowed at all by Town regulations. a. A covenant containing this condition, in a form approved by the Town Attorney and running with the land so as to bind the owner's successors and assigns, must be recorded in the Office of the Suffolk County Clerk prior to any site plan approval by the Town Planning Board. 2. All development must be conducted within the area shown as the project area on the map entitled"Fishers Island Solar Proposed Project Area Map," dated March 24, 2026, prepared by Crawford and Associates. Minor changes to the project area may be approved by the Planning Board in its review of the special exception and site plan applications. Any such minor changes shall be limited to de minimis adjustments that do Page 11 of 79 not expand the project area or the limits of disturbance shown on the aforesaid map and do not authorize any development, clearing, or encroachment within the wetlands or wetland adjacent areas. No development in the wetlands is allowed. 3. Approval of this zone change does not automatically grant approvals required by other boards. 4. As a component of any site plan and/or special exception application for the subject property, the applicant shall submit to the Town a decommissioning plan for the commercial solar energy facility. 5. As a component of any site plan and/or special exception application, the applicant shall provide a"proof of concept" letter from the local utility company acknowledging that the solar energy facility will be interconnected to the utility grid for the sale of electricity to the public utility. 6.No development or use of the subject property shall commence except upon the grant of all special exception, site plan, and other approvals required by the Town Code and applicable law, and any such application shall be referred to the Suffolk County Planning Commission to the extent required by General Municipal Law §239-m. Section 3. Effective Date. LOCAL LAW OF 2026 Section 1. Purpose. The purpose of this Local Law is to amend the Zoning Map of the Town of Southold to provide a location on Fishers Island for commercial solar energy production, to enhance access to alternative energy, in accordance with the Town's Comprehensive Plan and Local Waterfront Revitalization Program, by changing the zoning designation of the property identified on the Suffolk County Tax Map as Lot#1000-012-2-6.013 to a zoning district that will allow that use. Section 2. Code Amendment. The Zoning Map of the Town of Southold is hereby amended by changing the zoning designation of the parcel known as SCTM #1000-012-2-6.013 from R-120 to Light Industrial(LI), subject to the following conditions: 1. The only permitted uses allowed on the subject property are commercial solar energy production, with a possible future complementary battery energy storage system (BESS) allowed only if it meets any and all standards and regulations enacted by the Town of Southold for BESS, including being subject to any moratoria on BESS, and including the possibility that BESS may not be allowed at all by Town regulations. A covenant containing this condition, in a form approved by the Town Attorney and running with the land so as to bind the owner's successors and assigns, must be recorded in the Office of the Suffolk County Clerk prior to any site plan approval by the Town Planning Board. 2. All development must be conducted within the area shown as the project area on the map entitled"Fishers Island Solar Proposed Project Area Map," dated March 24, 2026, prepared by Crawford and Associates. Minor changes to the project area may be approved by the Planning Board in its review of the special exception and site plan applications. Any such minor changes shall be limited to de minimis adjustments that do not expand the project area or the limits of disturbance shown on the aforesaid map and do not authorize any development, clearing, or encroachment within the wetlands or wetland adjacent areas. No development in the wetlands is allowed. 3. Approval of this zone change does not automatically grant approvals required by other boards. 4. As a component of any site plan and/or special exception application for the subject property, the applicant shall submit to the Town a decommissioning plan for the commercial solar energy facility. 5. As a component of any site plan and/or special exception application, the applicant shall provide a"proof of concept" letter from the local utility company acknowledging that the solar energy facility will be interconnected to the utility grid for the sale of electricity to the public utility. 6.No development or use of the subject property shall commence except upon the grant of all special exception, site plan, and other approvals required by the Town Code and applicable law, and any such application shall be referred to the Suffolk County Planning Commission to the extent required by General Municipal Law §239-m. Section 3. Effective Date. This Local Law shall take effect immediately upon its filing with the Secretary of State in accordance with Municipal Home Rule Law §27. Protection and defense of municipal home rule,recognizing that towns, as the level of government closest to the people, are best positioned to balance competing interests and make decisions that shape daily life; 2. Local control of land use and zoning, free from statewide zoning rules that override the voice of resident taxpayers and the officials they elect; 3. Freedom from unfunded mandates, so that local taxpayers are not made to bear the cost of orders imposed by State and federal authorities without the resources to carry them out; 4. Modernized transparency, accessibility, and engagement, including reform of outdated public-notice requirements that consume scarce municipal dollars on print notices often missed Page 76 of 79 by the public; and 5. A meaningful voice in State decisions affecting the hometowns that towns govern, so that town government is treated as a true partner rather than an afterthought or a hurdle to clear; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby endorses and adopts the New York Association of Towns Bill of Rights and affirms its commitment to the principles set forth therein; and be it further RESOLVED, that the Town Board calls upon the Governor and the New York State Legislature to respect and uphold these principles in the enactment of legislation and the administration of State programs affecting towns; and be it further RESOLVED, that the Town Clerk is hereby directed to transmit certified copies of this resolution to the Governor of the State of New York, the Temporary President of the Senate, the Speaker of the Assembly, the State Senator(s) and Member(s) of the Assembly representing the Town of Southold, and the New York Association of Towns.
