All samples must be sent for laboratory testing by a NYSDOH ELAP approved laboratory for analysis using EPA Test Methods 8260 (VOC's), 8270 (Semi- VOC's)and RCRA 8 Metals(for waste oil tanks). 5. If soil or groundwater is observed to be contaminated,or if oil spills or leaks occur during the tank closure process,it must be.reported to NYSDEC's Spill Hotline at(800)457-7362 within 2 hours. 6. If a spill is documented,, an inspection by a NYSDEC representative will be required prior to backfilling unless directed otherwise. 7. Additional sampling or remediation may be required by NYSDEC for any spills identified during the closure activities. To finalize the project, a Closure Report must be submitted to this office for approval within 90 days of physical closure of the tank(s). The Closure Report shall be prepared and signed by a New York State licensed professional engineer or a qualified environmental professional.The Closure Report shall include at a minimum,a brief description of closure activities performed, a description of any deviations from the approved work plan, the quantity and locations of any samples collected, a table showing sample results compared to Standards, Criteria and Guidance(SCG), and any NYSDEC spill'number associated with the tank closure. An updated tank registration must also be submitted which indicates a change of status within 30 days of the closure of all USTs. Please'note that engineering plans must be submitted to this office and a permit to construct must be obtained prior to any new tank(s)being installed. Therefore, no permit is required for work landward of this structure. Be advised, no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or disturbance within Article 25 jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the jurisdictional boundary and your project (i.e. a 15'wide construction area) or erecting a temporary fence, barrier, or hay bale berm. In addition, please be advised that DEC has documented the summer occurrence of the Northern Long Eared Bat (NLEB) (Myotis septentrionalis), a species listed as "endangered" by both New York State and the US Fish &Wildlife Service, within 3 miles of the project location. We.have determined that tree cutting at this location between March 1 and November 30 of any calendar year may result in the "take" of these endangered/threated species or their habitat within the meaning of Environmental Conservation Law (ECL) §11-535.The term "take" is defined in part as the direct killing or injury of individual members of a protected species, interference with critical breeding, foraging, migratory or other essential behaviors, or the adverse modification of the species' habitat. The "take" of a species listed as endangered or threatened is prohibited in the absence of a permit from this Department issued pursuant to ECL§11-535.
