Thank you, however, these plans are slightly different. I attached what I received to help explain. 1: There are no more retaining walls on this plan against the house but there is one along the parking area. You had applied for a 200 ft. long retaining wall which I am assuming is no longer being applied for? Please advise. 2. There is a smaller retaining wall now along the parking area. I need to know the length and height of this wall for the application. 3. There is now a detached outdoor shower and equipment area. I need to know the dimensions of this. 4. On the attached Architectural plans prepared by Alexander Kruhly the dimensions of the retaining wall along the parking area and the outdoor shower/equipment area need to be added to his site plan A0.1 5. The distance from the house to the edge of freshwater wetlands around the pond is not depicted on this new site plan which needs to be added. 6. The Trustees may want to see side view elevations of the detached garage and retaining wall. If plans were already drawn up please have someone mail me four copies of these plans. 7. If the CHA Septic Plan is still to be used for the septic I need four updated copies of it. I can no longer use this plan as it depicts two long retaining walls along the seaward and landward side of the house, the garage is different, there is no retaining wall for the parking area and no outdoor shower/equipment area, etc. Also, given the weather forecasted for this Wednesday, I do not thing the Trustees are going to Fishers Island. I am in communication with them for a new inspection date. There is a chance this application may have to be rescheduled. I will keep you updated on the details. In looking at this application, unfortunately Ms. Herricks check#1073 for the application fee was never cashed and is now too old to deposit. It was written on 12/13/24. Could you please have a new check written for the application fee and sent to our office. Check made payable to:Town of Southold. Also, because this is a proposed new house/garage,full construction plans for the project need to be submitted including proposed elevation views for the house, garage and an elevation showing the height of the retaining wall. The office would need four sets of everything, one to-scale/full size and three 11"x17" sets please. If you think you can get the construction plans mailed out soon, I can tentatively add this to our August 12th public hearing. If you need more time, the next meeting is on September 16, 2026. You let me know when you are back on your feet. The Trustees are going to do a field inspection regardless of when this is put onto a meeting agenda. Best. I wanted to update you that the Board has set a date to perform site inspections on Fishers Island. They will be going out on Wednesday,July 29, 2026 via personal vessel so this will be weather permitting. Is it possible to confirm the staking of the proposed house is still at Lucinda Herrick's property? The Board wants to view this project at the site that day. If there is anything else on Fishers Island you may be putting together let me know. Be well. The reasons for this determination are that this resubdivision does not convey any significant additional development potential to either parcel, therefore the following provisions can be waived: a. Article V. Sketch Plat Review; b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP); c. §240-10 (B):Yield Plan; d. §240-10 (C): Primary & Secondary Conservation Area Plan; e. Article VI: Preliminary Plat Review; f. §240-19 (C-2): Preliminary and Final Public Hearings; and WHEREAS, pursuant to Town Code §240-41 concrete monuments to mark the new property boundaries are required; and WHEREAS, on April 21, 2025, at their work session, the Planning Board found that this application meets all the necessary requirements of Town Code Chapter 240 for a resubdivision; therefore, be it RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of certain provisions, hereby waives the following provisions of subdivision: a. Article V.- Sketch Plat Review; b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP); c. §240-10 (B): Yield Plan; d. §240-10 (C): Primary& Secondary Conservation Area Plan; e. Submit proof of recording and a copy of the recorded deeds to the Southold Town Planning Department. espectfully, 4.-., H. , 2- James H. Rich, III Chairman Please Note: The Southold Town Planning Board, in waiving the requirement for SCDHS approval prior to their own approval!, is simply waiving a technical requirement of Final Plat Approval under the Town Code and makes no representations as to whether SCDHS approval is required. SCDHS approval of this re-subdivision may be necessary to be in compliance with the Suffolk County Sanitary Code, and to be eligible for future construction or renovations. The statement below must be signed by the property owners to validate this approval resolution. The Chairman will endorse the approval resolution once the Health Department waiver is signed by both property owners. I understand that Southold Town Planning Board approval of this Resubdivision does not grant, guarantee or waive an approval, if required, from the Suffolk County Department of Health Services (SCDHS). I understand that I will need to apply separately to the SCDHS for any applicable approvals. HER-RICK & CO. L.P. By Lucinda J. Herrick, General Partner Signature of( rop rty wner 1). I have to advise you that how it is currently shown on the site plan, the application cannot move forward. Either the two lots need to be merged into one lot or all structures be moved onto the one lot, including the garage. The owner cannot apply for an accessory structure (garage)on a vacant lot, without first having a primary structure on the lot. If you have any questions about this, don't hesitate to call me. In looking quickly at your application I believe the Board will want to have a site visit for this proposed house. I did a very quick review of your project and there are issues that pop out which are listed below. Also, is the tennis court staying or being removed? There is no mention of it on the site plan or the project description that I can see. With this Board, when you propose a new dwelling or other structure (e.g.garage, raised pool), this Board requires the full construction plans and elevations for review. Please send one full-sized stamped set of plans and one 11"x17" set of stamped plans for the file. The site plan is not detailed and is confusing to look at. Are there any patios/decks proposed against the dwelling? Most applicants do not realize that this office requires permits for on-grade patios so I just want to make sure they are applying for everything. The retaining walls need to be more detailed. The Trustees will want to have both on the plans and the written description the length and height of each wall. Hopefully the construction plans depict more. HERRICK REVOCABLE TRUST, SCTM# 1000-9.-11-7.16 This application is to construct a 5,280 sq. ft. two-story dwelling with a stormwater drainage system for roof runoff; install an I/A OWTS system; construct a 20'x28' detached dry garage; install water and electric service; construct approximately 200' of retaining wall; construct a driveway; and to regrade and stabilize all disturbed areas. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. Policy 6.1 Protect and restore the quality and function of the Town of Southold ecosystem. B. Protect and restore ecological quality by adhering to the following measures. through the Town of Southold 2. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed action is inconsistent with Policy 6 because it does not protect the quality and function of the wetland ecosystem on the parcel. The proposed action is inconsistent with Policy 6.1 B(2) because the proposed construction is too close to the wetland and doesn't do enough to protect the ecological quality of the land adjacent to the wetlands. The proposed two-story dwelling is inconsistent with Policy 6.3A because it does not comply with Town Code Chapter §275-3(D)(1)(a)[2] that states the setback for a residence is 100ft from the wetland boundary. To be deemed consistent, the proposed home and all associated construction should be shifted back to the 100ft wetland setback to comply with Policy 6.1 B(2) and Policy 6.3A.
