The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with conditions with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective 6. Practical vegetative methods have been included in the project design and implementation. The proposed removal and replacement of the existing bulkhead is consistent with Policy 4.1 D(2) and 4.1 D(6) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. In this case, there was an existing bulkhead. A vegetative approach would not work because the parcel is within three FEMA Flood Zones, AE (West), AO and VE (East). In accordance with Policy 4.1 D(6), a wide vegetated non-turf buffer along the landward edge of the new bulkhead has been included in the project design; To be deemed consistent, the materials used must comply with Town Code Chapter §275-11 Construction and Operation Standards, as stated below: B(1)(0 In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pretreated with any preservative, including, but not limited to, chromated copper arsenate (also known as "CCA'), penta products, alkaline copper quaternary (ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands, as well as on any part of a structure in low-tidal-flow wetland areas as determined by the Trustees. Any use of creosote is prohibited. Preservatives of any type, including, but not limited to, those listed above, cannot be applied to any bulkheads, retaining walls or revetments after installation. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used in sensitive areas.
