In reviewing this application there are a few issues with the plans/project description. At this time this application
cannot move forward as;,submitted. The concerns are as follows:
1. If you are relocating the fence you need to depict a distance line from top of.bluff to new fence location. Please
be advised that in 2025 the Board of Trustees added to the code that fencing must be no closer than 20 feet
from edge of wetlands,top of bank or bluff. This fence should be depicted at least 20 feet from top of buff.
2: The existing bluff stair and platform.with dimensions are not depicted on the site plan nor in the written
description which is required.
3. The existing deck at top of bluff&dimensions are not depicted nor are dimensions depicted in the written
description. Also,there is no deck at top of bluff on the survey.
4. Dimensions of the proposed platform and stairs to beach need to be added to both pages of your.project plans.

This application is to request a Wetland Permit and a Coastal Erosion Permit to

plant disturbed areas with Cape American beach grass plugs 12" on-center; install a 3'
tall by 4' wide berm at top of bluff to be planted with native long grasses;; remove

of bluff.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the policies of the
LWRP as follows:
4.2 Protect and restore natural protective features.
Natural protective geologic features provide valuable protection and should be
protected, restored and enhanced. Destruction or degradation of these features should
be discouraged or prohibited.
A. No development is permitted in natural protective feature areas, except as
specifically allowed under the relevant portions of 6 NYCRR 505.8.
This proposed action is on a waterfront parcel along the wetland boundary of the Long
Island Sound. The existing 9ft x 8ft deck and the rocks set in concrete underneath are
located on the bluff face, a natural protective feature. This structure is inconsistent with
Policy 4.2A which calls for no development in natural protective feature areas.
The proposed action of filling in 100 cubic yards of clean sand on the bluff is consistent
with Policy 4.1.C.1, which allows for the enhancement of protective capabilities by using
fill and must comply with 4.1.C.1.a, which calls for the usage of only clean sand with a
grain size equivalent to or slightly larger than the native material at the project site.
The proposed construction of a 100 linear foot long rock revetment with two 5' to 7' long
returns along toe of bluff is consistent with Policy 4.1 D(2) and 4.1 D(6) which states that
a revetment can be found consistent if vegetative approaches to control erosion are not
effective. The bluff is located in the FEMA VE Flood Zone and a Coastal Erosion Hazard
Area. The existing vegetation is not effectively preventing erosion caused by wave
action. In accordance with Policy 4.1 D(6), Cape American beach grass plugs along the
bluff and 3' tall by 4' wide berm at top of bluff has been included in the project design.
The proposed bluff restoration is consistent with Policy 4.2 because it restores the bluff,
a natural protective feature, by adding a rock revetment, clean sand and revegetation.
Pool fences are not defined as a pool related structure and fall under the broader
definition of a fence. The proposed relocation of the fence to a minimum of 20ft from the
top of bluff is consistent with Policy 6.3A, which states the compliance with the Southold
Town Board of Trustees' laws and regulations because the proposed fencing is
proposed to 20ft or more from the top of the bluff and complies with Town Code Chapter
§275-11A(4)(f) fences shall not be permitted within 20 feet of any wetland boundary.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.

NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Southold Town Board of Trustees at the
Town Hall, 53095 Main Road, Southold, New York, concerning this property.
OWNER(S) OF RECORD: 555 SOUNDVIEW REALTY, LLC
SUBJECT OF PUBLIC HEARING: For a Wetland Permit and a Coastal Erosion Permit to
construct a 100 linear foot long rock revetment with two 5' to 7' long returns along
toe of bluff with a maximum of 150 tons of stone; provide 100 cubic yards of clean
sand fill; install 2"x12" un-treated terracing boards placed at 6' on-center along bluff
face and plant disturbed areas with Cape American beach grass plugs 12" on-center;
install a 3' tall by 4' wide berm at top of bluff to be planted with native long grasses;;
remove existing 3.5'x10' steps to beach and install a 4'x6' platform with 4'x12' stairs
parallel to bluff face; and to maintain and not disturb existing 3.5'x8.5' .steps and 9'x8'
timber deck with benches; and to relocate existing pool fence to a minimum of 20'
