SE RA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY AD^w" NISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply
dated June 20, 2025 stating that this application is considered a matter for local determination as there appear to be
no significant county-wide or inter-community impacts.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated August 18, 2025, Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available,
it is recommended that the. proposed action is INCONSISTENT with LWRP policy standards and therefore is
IT:CO?`: withSISTE:`;T ,th the L1i'RP.
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves
open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse
effiects of development.
1. Structures that do not meet regulatory setbacks, gross floor area(size) or. small waterfront parcels do not
support or enhance community character or minimize the effect of development on the environment_
Policy-Y. Afinitrize the loss of life, structures, and naiwal resources f5-orn flooding and erosion.
2. The existing structure is located in Flood Zone X with a 0.2 Percent Annual Chance Flood Hazard, and
much of the parcel is located in Flood Zone AE, with a 1% Annual Chance Flood Hazard. In addition, sea
level rise is expected to continue and will increase future flooding potential.
Structures within these flood zones are subject to potential loss from stonrm surge-induced events and this
will increase overtime as sea level rises. Expansion of the gross floor area runs counter to the Town's policy
to minimize the loss of structures from flooding and erosion.
However, with the conditions imposed herein, the Board now finds the proposed action to be CONSISTENT with
the LWRP.

PROPERTY FACT5ID3 SCR IPTION: The subject property is a trapezoid-shaped 37,773 square-foot(33,966 square
feet buildable)non-conforming waterfront parcel in the A-C Zoning District with 120.00 feet fronting Meadow Beach
Lane,a 20-foot wide easement on the west; 226.44 feet adjoining a neighboring residential parcel to the north: 173.66
feet along the tie line at Halls Creek to the east; and 202.31 feet adjoining an adjacent residential parcel to the south.
The property is developed with a two-story frame dwelling with a two-car attached garage and brick driveway, an
additional stone driveway,a rear wood deck with hot tub,concrete and brick walkways, and a slate walk to a catwalk
and dock on Halls Creek, all as depicted on the survey prepared by Jeffrey W. Haderer, Licensed Surveyor, last
revised May 14, 2025.
BA51S OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; Article XXXVI, Section
280-207A(b); and the Building Inspector's May 28,2025 Notice of Disapproval based on an application for a permit
to construct additions and alterations to an existing single family dwelling; at 1) less than the code required minimum
front yard setback of 40 feet; 2) gross floor area (GFA) exceeding permitted maximum square footage for lot
containing up to 40,000 square feet in area; located at: 1657 Meadow Beach Lane, (Adj. to Halls Creek) Mattituck,
NY. SCTM No. 1000-1 16-4-15.
RELIEF RE VESTED: The applicant requests front yard and Gross Floor Area (GFA) variances to expand the
existing screened porch and construct a one-story addition to the rear(east side)of the dwelling;to construct a kitchen
addition on the south and east side of the dwelling; and to construct an addition to the garage on the west side of the
dwelling for total added habitable area of approximately 520 square feet. The kitchen addition maintains an existing
front yard setback of 34.9 feet where the code requires a minimum of 40 feet, and in total the additional living space
results in a Gross Floor Area (GFA) of 5,140 square feet where a maximum of 4,648 square feet is permitted based
on the Town Code.
ADDITIONAL INFOK-4 kTION:
The property is covered by the following Certificates of Occupancy:
No. Z-21017 dated September 15, 1992 pursuant to Building Permit No. 20170-Z dated September 27, 1991 for
a new one family dwelling with attached wood deck and accessory one-car garage:
No. Z-27268 dated August 22. 2000 pursuant to Building Permit No. 25856 dated July 8, 1999 for first and
second floor addition to existing one family dwelling; and
No.Z-31921 dated October l 8, 2006 pursuant to Building Permit No. 31900-Z dated April 11,2006 for a second-
floor addition to an existing single-family dwelling.
The application included an architect's signed and stamped GFA analysis of properties"around 1657 Meadow Beach
Lane" indicating the area average is 5,119 square feet. In the written application and at the public hearing the
applicant's representative asserted that the three homes included in the GFA analysis constitute the neighborhood
and that the homes further north on Meadow Beach Lane, beyond the one immediately adjacent, should not be
included in the analysis.
The applicant's parcel is the beneficiary of prior Board relief and included a copy of Zoning Board of Appeals file
#1679 dated September 25, 1972 which granted a variance allowing the location of accessory buildings in the side
yard (not less than 15 feet from the northern property line)and not less than 40 feet from the westerly property line,
with the same 40-foot setback to apply to the main residence.
During the hearing the applicant's representative,indicated the applicant would eliminate the 42 square foot garage
addition which would bring the proposed GFA to 5,098 square feet which is below the architect's calculation of
5,119 square feet for the average GFA of the properties "around 1657 Meadow Beach Lane.'

The application stated that the applicant intends to apply for a Board of Trustees wetland permit subsequent to their
Zoning Board of Appeals application.
One neighbor submitted a letter in support of the application.
FINDINGS OF FACT/ REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on September 4, 2025 at which time written
and oral evidence were presented. Based upon all testimony. documentation, personal inspection of the property
and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. 7own Law &267-b 3lf Grant of the front yard setback variance will not produce an undesirable change in
the character of the neighborhood or a detriment to nearby properties. The 34.9-foot front yard setback has existed
since the house was built in 1991, hence is part of the character of the neighborhood. However, granting the relief
relative to excessive GFA will produce an undesirable change in the character of the neighborhood and a detriment
to nearby properties. Any excessive GFA over the neighborhood average is precedent setting and not only
ide implications. The applicant's analysis of averaging
detrimental to the immediate community but has town w
for other dwellings in the neighborhood considered just three homes in the immediate area and did not account for
the neighboring homes further to the north. contrary to the method suggested by the Board's GFA averaging
guidelines. The applicant motes that the homes further to the north are in a separate subdivision. Harbor Farms. and.
are covered by that subdivision`s design standards and covenants and restrictions. The applicant testified that either
the Zoning Code or the ZBA's averaging guidelines state that if the subject area is distinct from an adjoining.,
development. the GFA averaging may omit the adjoining development. The Board finds no such language or basis
in either the Zoning Code nor in the Board's GFA averaging guidelines to omit nearby homes from GFA averaging
analysis on these grounds and finds that the homes omitted from the analysis share,with the subject dwelling,having
an address on Meadow Beach Lane and that they are architecturally similar to the homes included, all being two-
story frame dwellings of traditional design with several also being waterfront properties. Further. the Board notes
that it is not uncommon for GFA averaging analysis to encompass homes that are quite diverse from one another,
such as having different architectural styles and/or different numbers of floors, originating from different time
periods. and varying in degree of renovation. Absent a thorough analysis of GFA in the neighborhood consistent
with the Zoning Code or the Board GFA averaging guidelines,the Board compares the proposed GFA of 5.098 feet
to the code-permitted maximum of 4,648 square feet and finds that granting of the GFA variance will produce an
undesirable change in the character of the neighborhood by allowing the creation of an over-sized home in the area.
2. Town Law &267-b ;l b 2 . The benefit sought by the applicant cannot be achieved by some method. feasible
for the applicant to pursue, other than a setback variance. Since the existing dwelling has a 34.9-foot front yard
setback,any addition to either side of the house will require some form of variance relief. The benefit sought by the
applicant can be achieved by some method, feasible for the applicant to pursue. other than a GFA variance. The
existing house includes two first floor bedrooms and there appear to be design degrees of freedom available to enable
reconfiguring the space to achieve the stated objective.
3. Town Law 267-b 3 b 3 . The front yard setback variance granted herein is mathematically substantial.

representing 12.73°/a relief from the code. However.the
of the existing dwelling; the proposed addition does not introduce any further encroachment. The GFA variance is
also substantial.representing 10.58%relief over the code-permitted maximum,and the evidence to establish that the
GFA is less than the neighborhood average is incomplete.
4. Town Law §2674(3)(tIL41 No evidence has been submitted to suggest that the requested front yard variance in
this residential community will have an adverse impact on the physical or environmental conditions in the

neighborhood. However, evidence was presented that allowving an excessive GFA will have an adverse impact on
the physical or environmental conditions pursuant to the Town Code. The applicant must comply with Chapter 236
of the Town's Storm Water Management Code.
5. Town Law &267-b(3)fb)f51. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6.Town Law§267-b. Grant of the requested front yard setback relief is the minimum action necessary and adequate
to enable the applicant to enjoy the benefit of a reconfigured house while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community. Grant of the requested GFA relief IS NOT
the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded and
reconfigured house while preserving and protecting the character of the neighborhood and the health, safety and
welfare of the community. There appears to be potential to reconfigure the existing first floor bedrooms and/or to
expand living space into the garage (as depicted in the proposed plans).

TIME LIMITS ON THIS APPROVAL; Pursuant to Chapter 280-146(B) of the Code of the Town of
Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of
Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County
Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon
written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one (1)
year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSIU'RE COMPLIANCE WITH

construct a functional system) required to replace soils unsuited to the proper functioning of the new I/A
OWTS and topsoil necessary to landscape the completed installation area.

- The use of a wellpoint system for the temporary dewatering necessary to control the groundwater level
in the excavated area during construction and the discharge of the groundwater to the existing municipal
street drainage system or surface waters as detailed in Long Island Well Temporary Dewatering Permit
Conditions 1-10.
- Maintenance and repair tasks; including associated excavation,backfilling and dewatering,for the
installed system such as the replacement of filter media or the repair/replacement of failed components.

GENERAL CONDITIONS, APPLY TO ALL AUTHORIZED PERMITS
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
2. Notice of Commencement At least 48 hours prior to commencement of the project,the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project,the bottom portion of the form must also be_signed and returned,along with photographs of
the completed work.
3. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Twin Forks Land Surveying, last revised 6/11/2025 and stamped
"NYSDEC Approved" on 6/25/2025.
4. Authorized Systems This permit authorizes the installation of any models of Innovative/Alternative
Onsite Wastewater Treatment Systems (I/A OWTS)which have received the approval of the Suffolk
County Department of Health Services (SCDHS). If SCDHS rescinds its approval of one or more of
these models during the term of this permit, DEC will no longer approve new installations of that model.

5. Installed System Must Be Properly Maintained The permittee must maintain, service and repair
the installed I/A OWTS in accordance with the maintenance schedule set forth in the SCDHS permit
issued for the system.

6. Install and Maintain Erosion Controls Staked hay or straw bales or other DEC-approved erosion
control measures are to be installed on the downslope edge of any disturbed areas. This barrier to
sediments is to be put in place before any disturbance of the ground occurs and is to be maintained in a
functional condition until all disturbed land is heavily vegetated.
7. Contain Stockpile and Disturbed Areas All disturbed areas where soil will be temporarily
exposed or stockpiled for longer than one week shall be contained by a continuous line of staked hay
bales/silt curtain(or other department-approved method)placed on the seaward side between the fill and
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
8. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area(upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
9. No Disturbance to Vegetated Wetlands There shall be no disturbance to vegetated wetland areas
as a result of the permitted activities.
10. Concrete Leachate During construction,no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete
trucks,mixers,or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
11. Prohibited Toxic Materials The introduction of materials toxic to aquatic life, such as pesticides,
cleaning fluids, oils and chlorinated liquids is strictly prohibited in the absence of permit authorization.
12. No Equipment in Wetland Heavy equipment,including bulldozers, backhoes,payloaders,etc.,
shall not be operated in the wetland.
13. Equipment Storage 1100' from Wetland,Water Body All equipment and machinery shall be
stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the
end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the
regulated area.
14. Storage of Equipment,Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 100 linear feet from the wetland
boundary.
15. Clean Fill Only All fill shall consist of clean soil, sand and/or gravel that is free of the following
substances:asphalt,slag, flyash,broken concrete, demolition debris, garbage,household refuse,tires,
woody materials including tree or landscape debris, and metal objects. The introduction of materials
toxic to aquatic life is expressly prohibited.
16. Seed,Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be
seeded with an appropriate perennial grass,and mulched with straw immediately upon completion of the
project, within two days of final grading,or by the expiration of the permit,whichever is fixst.
17. Temporary Mulch, Final Seeding If seeding is impracticable due to the time of year, a temporary
mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather
conditions favor germination and growth but not more than six months after project completion.

18. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
19. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized,or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State,the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit,the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall,without
expense to the State,and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
2o. State May Require Site Restoration If upon the expiration or revocation of this permit,the
project hereby authorized has not been completed,the applicant shall,without expense to the State,and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require,remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
21. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation(the Department)to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps,drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.

2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals,Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal,modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal,modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transfer are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following.permit authorizations: Tidal Wetlands.
5. Permit Modifications,Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions,relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions,orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and.Agrees to Indemnification
The permittee,excepting state or federal agencies,expressly agrees to indemnify and held harmless the
Department of Environmental Conservation of the State of New York,its representatives, employees,
and agents("DEC")for all claims,snits,actions,and damages,to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with,or operation and maintenance of,the facility or facilities authorized.by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims,suits,actions,or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions,or to any claims,suits,or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Mules or any citizen suit or civil Tights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit and assigns of
The permittee is responsible for informing its independent contractors, employees, ag agents gn
their responsibility to comply with this permit,including all special conditions while acting as the
pemaittee's agent with respect to the permitted activities,and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits,approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the perr ttee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impairment of
any rights,title,or interest in real or personal property held or vested in a person not a party to the
permit.

Project Description: Conduct construction activity within 1 00' from the
landward edge of the wetlands consisting of a 204sq.ft., a 274sq.ft. and a 42sq.ft.
addition onto existing 2,934sq.ft. dwelling; remove a portion of existing screened
porch and expand it to be 268sq.ft.; a southerly 4.8'xl2' wood landing with
93sq.ft. steps; a seaward 6.8'xl2.5' wood deck with a 6.4'x7.4' hot tub; remove
existing sanitary system and install an I/A OWTS sanitary system; and remove
arbor and a portion of deck for an 893sq.ft. seaward deck.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
site plan prepared by Twin Forks Land Surveying, received on December 1,
2025, and stamped approved on December 17, 2025.
Special Conditions: None,
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

WHEREAS, Petitioners commenced this hybrid CPLR Article 78 proceeding
and action for declaratory relief seeking, inter alia, to annul so much of the
determination of the Southold Zoning Board of Appeals dated September 18, 2025,
as denied Petitioners' application for a variance from the gross floor area provisions
of the Southold Town Code in connection with improvements to property located at
1657 Meadow Beach Lane, Mattituck, New York, bearing Suffolk County Tax Map
No. 1000-116-4-15; and
WHEREAS, the variance application was made under ZBA File No. 8033 and
sought approval to permit a gross floor area of approximately 5,098 square feet; and
WHEREAS, the parties have reached an agreement resolving this proceeding
without further litigation;

NOW, THEREFORE, it is hereby
STIPULATED AND AGREED, by and between the undersigned counsel for the
respective parties, that:
1. Grant of Variance Respondent Southold Zoning Board of Appeals hereby
agrees to grant Petitioners the gross floor area variance as applied for under
ZBA File No. 8033, permitting the proposed improvements resulting in a
gross floor area of approximately 6,098 square feet, subject to the same
conditions (if any) applicable to the remainder of the approved application.
2. Direction to Issue Permit Upon entry of this Stipulation as a So-Ordered
stipulation by the Court, Petitioner will file the necessary plans and
information for the Southold Town Building Department to review for
compliance with applicable codes and regulations consistent with the granted
floor area variance . Subject to such compliance, within 60 days of receipt of
such plans, Respondents, including the Town of Southold and its Building
Department, shall take all necessary administrative action to process and
issue the building permit requested by Petitioners consistent with the
granted gross floor area variance and the approved plans submitted in
connection with ZBA File No. 8033.
3. Discontinuance of Proceeding Upon entry of this Stipulation as a So-Ordered
stipulation by the Court, this proceeding and action shall be discontinued in
