This application is a request for a variance from Article XXIII Section §280-124. The
Building Inspector's February 20, 2026 Notice of Disapproval based on an application to
demolish a dwelling and construct a new single-family dwelling at 425 Lake Drive,
Southold, NY.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the policies of the
LWRP as follows:
Policy 1. Foster a pattern of development in the Town of Southold that enhances
community character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.
Policy 5: Protect and improve water quality and supply in the Town of Southold.
5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention
of water quality standards.
C. Ensure effective treatment of sanitary sewage and industrial discharges by:
3. modifying existing sewage treatment facilities to provide improved
nitrogen removal capacity
Policy 6: Protect and restore the quality and function of the Town of Southold's
ecosystem
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
The proposed action is on a waterfront parcel, located along Great Pond.
The proposed action is inconsistent with Policy 1 because it does not enhance
community character, make beneficial use of a coastal location or minimize adverse
effects of development.
Based on the site plan, page G1, the proposed action expands the building footprint of
the single-family dwelling to over double its size, as well as almost tripling (2.75x) the
size of the attached deck, combined with other proposed construction to exceed the
20% maximum lot coverage in the R-40 zoning district pursuant to the Town Code
Chapter §280 Attachment 3 Bulk Schedule. This increase in lot coverage increases the
adverse effects of development on the waterfront parcel.
While the proposed installation of an Innovative/Alternative Onsite Wastewater
Treatment System (I/A OWTS) is stated in the ZBA application on the Coastal
Assessment Form, there is no description of the I/A septic replacement on any
submitted plans. Replacing the existing septic system with an I/A system is consistent
with Policy 5, however the system must be noted on the plans.
In addition to the Zoning Board of Appeals variance, please note the proposed action is
within the jurisdiction of the Board of Trustees and will require review and approval of a
wetland permit.

The proposed action is inconsistent with Policy 6.3A which calls for compliance with the
Town of Southold Board of Trustees laws and regulations because there are no wetland
setbacks noted on the submitted site plans. It can be seen on site plan, S1, that the
proposed deck expansion will bring the residence closer to the wetland boundary. The
wetland setbacks must be properly labeled on a submitted site plan to determine if each
structure meets the wetland setback requirements.
The proposed action can be deemed consistent with the LWRP policies by reducing the
proposed lot coverage to meet Town Code, confirmation that an I/A OWTS will replace
the existing septic system, and that proposed structures meet the required setbacks
from wetlands.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.
