The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with conditions with the policies of the LWRP as follows: Policy 6: Protect and restore the quality and function of the Town of Southold's ecosystem 6.3. Protect and restore tidal and freshwater wetlands. i A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed materials labeled with CCA listed on.Sheet 3 are inconsistent with the Policy 6.3.A, which states compliance with the Board of Trustees'jurisdiction because they do not comply with Town Code Chapter §275-11 Construction and Operation Standards, that state that CCA is a prohibited lumber preservative as stated below: B(1)(0 In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pretreated with any preservative, including, but not limited to, -chromated copper arsenate (also known as "CCA'), yenta products, alkaline copper quaternary (ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands, as well as on any part of a structure in low-tidal-flow wetland areas as determined by the Trustees. Any use of creosote is prohibited. Preservatives of any type, including, but not limited to, those listed above, cannot be applied to any bulkheads, retaining walls or revetments after installation. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used in sensitive areas. The proposed removal and replacement of the existing bulkhead is consistent with Policy 4.1 D(2). and 4.1 D(6) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because there is already a bulkhead there. In accordance with Policy 4.1 D(6), a 10 ft vegetated non turf buffer has been included in the project design; however, it is recommended to be expanded to a 15 ft vegetated non turf buffer to be effective and to be consistent with this policy because the entire parcel is located in the FEMAAE Flood Zone.
