The persons doing the construction are Frank and Barbara Cieplinski of Clearview Road. I understand that they have proper permits for the work. I believe the permits were issued in error for the following reasons: 1 . Cedar Beach Harbor is a round shallow body of water with a narrow channel running along the north western shore. At low tide, the center of the harbor is a mud flat with an 1 .5 to 2 ft deep channel about 15-25 ft wide, immediately adjacent to the shore. This channel runs parallel to the shore, within 5-ft of the shore. This narrow channel running close inshore is the only way in or out of the eastern fingers of Cedar Beach Harbor. 2 . The dock that is under construction is supposed to be 93 ft long with ramp and float extending from the end. Construction has begun and the channel is already partly blocked. 3. It is clear that the proposed dock, ramp and float will completely block the only channel from Cedar Beach Harbor to Peconic Bay. 4. There are 10-15 boatsmen with docks and boats that will be cutoff from our only outlet into the Peconic bays if the proposed dock is built as planned. My home is on Canoe Inlet. My boat is a 24 ft walkaround that draws 20" . As it stands, in the center of the channel I touch bottom at low tide. There is no way to navigate outside the channel. Other sail and power boats are kept in Dryad's Bay, also upstream of the dock under construction. ..3 5 . Also cutoff will be the Suffolk County Marine Institute at Cedar Beach. 6. It would appear that whoever designed the dock for the Cieplinskis was not familiar with the nature of this harbor. The same appears true of the official who issued the permit. The dock will be useless for them as well, as its end will be right in the middle of the mud flat, unfit for docking a boat of any type. I petition the Board of Trustees to immediately halt construction before our only channel is entirely blocked and withdraw the permit. The site should be surveyed (sounded) so that the Cieplinski dock can be scaled back to a dimension that will permit passing traffic and which will place their own boat in navigable water. This will likely be only 3-5 ft. . . a MUCH less costly construction than they have presently planned. Additionally, pilings already sunk into the channel must be removed. Alternatively, a new channel must be dredged to route boat traffic around this 93 ft fixed dock (plus ramp and float) . Than you for your attention to this matter. Denial is recommended because, although the location of the pool itself is not within Trustees' jurisdiction, the required fence would be within Trustees' jurisdiction according to information supplied by the. applicant. Due to the fence's proposed location a Wetland Application should be required and the application should show the Coastal Zone Hazard line. 2170 The Strand, East Marion Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF REQUESTS TO AMEND PERMITS A-5 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the request to amend the permit of BARBARA CIEPLINSKI 89-3-9 & p/o 8. to relocate structure slightly northward and reoriented to reach a 3' depth in accordance with NYS DEC requirements. As stated in the CAC's original recommendation concerning this application, approval is recommended provided the project does not block the navigation of the neighbors. The persons doing the construction are Frank and Barbara Cieplinski of Clearview Road. I understand that they have proper permits for the work. I believe the permits were issued in error for the following reasons: 1. Cedar Beach Harbor is a round shallow body of water with a narrow channel running along the north western shore. At low tide, the center of the harbor is a mud flat with an 1.5 to 2 ft deep channel about 15-25 ft wide, immediately adjacent to the shore. This channel runs parallel to the shore, within 5-ft of the shore. This narrow channel running close inshore is the only way in or out of the eastern fingers of Cedar Beach Harbor. 2 . The dock that is under construction is supposed to be 93 ft long with ramp and float extending from the end. Construction has begun and the channel is already partly blocked. 3. It is clear that the proposed dock, ramp and float will completely block the only channel from Cedar Beach Harbor to Peconic Bay. 4. There are 10-15 boatsmen with docks and boats that will be cutoff from our only outlet into the Peconic bays if the proposed dock is built as planned. My home is on Canoe Inlet. My boat is a 24 ft walkaround that draws 20" . As it stands, in the center of the channel I touch bottom at low tide. There is no way to navigate outside the channel. Other sail and power boats are kept in Dryad's Bay, also upstream of the dock under construction. , 5. Also cutoff will be the Suffolk County Marine Institute at Cedar Beach. 6. ' It would appear that whoever designed the dock for the Cieplinskis was not familiar with the nature of this harbor. The same appears true of the official who issued the permit. The dock will be useless for them as well, as its end will be right in the middle of the mud flat, unfit for docking a boat of any type. I petition the Board of Trustees to immediately halt construction before our only channel is entirely blocked and withdraw the permit. The site should be surveyed (sounded) so that the Cieplinski dock can be scaled back to a dimension that will permit passing traffic and which will place their own boat in navigable water. This will likely be only 3-5 ft. . . a MUCH less costly. construction than they have presently planned. Additionally, pilings already sunk into the channel must be removed. Alternatively, a new channel must be dredged to route boat traffic around this 93 ft fixed dock (plus ramp and float) . Than you for your attention to this matter. A copy of this permit, including all conditions and approved plans, shall be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. B. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated. as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. C. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey. E. For projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall'notify the Regional Permit Administrator in writing at least 48 hours prior to recommencing work in subsequent years. F. The granting of this permit does not relieve the permittee of the responsibility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, Office of General Services, Tower Building, Empire State Plaza, Albany, NY 12242 (516) 474-2195, which may be required for any encroachment upon State-owned lands underwater.
