The proposed action has been reviewed to Chapter§268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 5: Protect and improve water quality and supply in the Town of Southold. 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by. 3. modifying existing sewage treatment facilities to provide improved nitrogen removal capacity Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats. 6.3 Protect and restore tidal and freshwater wetlands A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Policy 13. Promote appropriate use and development of energy and mineral resources. 13.4 Minimize adverse impacts from fuel storage facilities. C. Liquefied Natural Gas facilities must be safely sited, screened and operated. This proposed action is on a nonconforming lot with the wetland boundary of Orient Harbor where the pre-existing single family dwelling is closer than 100 ft from the wetland boundary. The proposed installation of an Innovative/Alternative Onsite Wastewater Treatment System (I/A OWTS) is consistent with Policy 5.1.C.3 which calls for the modification of existing sewage treatment facilities that improves nitrogen capacity removal and will reduce nutrient input to adjacent waters. The wetland boundary of the proposed action is Orient Harbor which is a designated Significant Coastal Fish and Wildlife Habitat. The proposed action is consistent with Policy 6.2 because all proposed alterations are located landward of Orient Harbor. The proposed action is consistent with Policy 6.3A because the building footprint is not being altered. The proposed I/A sanitary system complies with Town Code Chapter §275-3 which calls for a septic tank and sanitary leaching pool to be 75 ft and 100 ft from a wetland boundary. The proposed new propane tank is consistent with Policy 13.4.0 which calls for the minimization of adverse impacts from liquefied natural gas storage facilities and complies with Town Code Chapter 2754A.1 below: (i) The demolition, removal, repair and/or upgrading of existing residential fuel tanks, fuel lines and fuel dispensers, and the installation or burial of a residential 2 propane tank, including necessary site work, and provided that such activity will not have an undue adverse impact on the wetlands and tidal waters of the Town. Evaluate the project to the following policies by analyzing how the project will further support or not support-the policies. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. Yes ❑ No ❑ Not Applicable This project reflects the Town's interest in"preserving and enhancing the natural and built environment and providing opportunities for a level of growth and expansion of the economic base that is compatible with the existing scale of development, availability of water, existing sensitive environment of the Town and its historic heritage."The project will preserve the existing landscape of the site and the surrounding waterbody/wetlands(Orient Harbor). The contractor will install silt fencing around the work area to prevent sediment laden runoff from leaving the Site during construction.Furthermore, the existing cesspool will be properly abandoned and removed in accordance with SCDHS requirements, and an Innovative and Alternative Onsite Wastewater Treatment System(I/A OWTS)and sanitary leaching field are proposed. The new sanitary system will be properly sized, meet the necessary groundwater separation distances, and will significantly reduce nitrogen levels compared to the existing system. The new sanitary system will better protect the natural environment and waterways abutting the property. Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ❑ Not Applicable The New York State Office of Parks,Recre and Historic Preservation(OPRHP)Cultural Rest information System(CRIS)online database was utilized to determine that the project site does not contain, nor is substantially contiguous to,a historic building, archaeological site,or historic district which is listed on the National or State Register of Historic Places. The existing residence is visible on Suffolk County GIS aerials dating back to 2001. The integrity of the residence will be preserved while adding a basement egress window and two window wells.Historic maritime areas will not be impacted by the implementation of this project. Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III—Policies Pages 6 through 7 for evaluation criteria ❑✓ Yes ❑ No ❑ Not Applicable The Town of Southold seeks to protect its scenic components, which include maritime activities. This waterfront property abuts Orient Harbor which is a major contributor to the visual quality of the existing landscape found at the Site.As such,it is crucial to protect and preserve this scenic natural resource. The proposed improvements will not negatively impact the visual quality of this resource,as all proposed site utilities will be buried underground;other than the control panels for the VA OWTS,which will be located along a southern wall of the dwelling and will not obstruct the view harbor. The scenic views of the neighbors will not be affected. The mature vegetation found onsite will be kept in tact to the greatest extent possible. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria ❑I✓ Yes ❑ No ❑ Not Applicable The backyard of the Site abuts Orient Harbor. There is an existing bulkhead with piles along the west property line. This bulkhead acts a physical barrier that prevents site soils from being washed away by wave action during storms or flooding events. The existing bulkhead will not be disturbed as part of this project or during construction.Furthermore, the proposed site improvements will not be located any closer to the waters edge than the existing structures. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of.Southold. See LWRP Section III —Policies Pages 16 through 21 for evaluation criteria 2 Yes ❑ No ❑Not Applicable One of the considerations taken during the design of the proposed project was to protect the water quality of the surrounding harbor and to improve the water quality of groundwater. The existing cesspool(s)will be abandoned and removed in accordance with SCDHS requirements.Cesspools do not have a pretreatment unit that reduces nitrogen from sewage prior to discharging into the ground. The sanitary system,as it currently exists, has the potential to negatively impact groundwater quality. As part of this project,an I/A OWTS and two(2)sanitary leaching pools are proposed. The new system will be properly sized, meet the necessary groundwater separation distances, and will significantly reduce nitrogen levels compared to the existing sanitary structure(s).The location and design of the new sanitary system will reduce nitrogen discharges to groundwater and the surrounding harbor. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III—Policies; Pages 22 through 32 for evaluation criteria. Yes ❑No ❑ Not Applicable Though this Site does not abut a classified significant coastal fish and wildlife habitat, the implementation of this project will protect the quality and function of the surrounding ecosystems. As part of this project,Orient Harbor, the existing bulkhead, and the wooden staircase that leads down to the water will not be disturbed. The existing sanitary structure(s)found onsite do not provide advanced pretreatment of sewage. The new system that will be installed as part of this project incorporates an I/A OWTS that reduces nitrogen levels in the wastewater effluent well below the standard of 19 mg/L.The proposed leaching pools meet the required 3-foot separation to groundwater. This is important because it allows the sanitary effluent to further filter through site soils which provides additional treatment to the sanitary effluent prior to reaching groundwater, and ultimately,Orient Harbor. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III — Policies Pages 32 through 34 for evaluation criteria. ❑ Yes ❑No❑✓ Not Applicable Attach additional sheets if necessary Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes.
