Krupski, President Southold Town Board of Town Trustees Board of Trustees Town of Southold Southold, NY 11971 Re: 580 Basin Road Dear Mr. Krupski: Yesterday, a contractor for the Paradise Point Association rebuilt a portion of the illegal docks attached to my property at 580 Basin Road based on oral permission given by you "to affix the docks with chains" to prevent a "navigational hazard." There is no provision in Chapter 97 for oral approval of operations on wetlands. The work done was to rebuild the docks with wood and flotation devices. A permit was required under 97-20 (A) but was not obtained. As the property owner my consent was obviously required under 97-21 (A) (1) and was not given. There is no exemption under 97-13(A) (5) since no permit exists on the docks. I note that the materials used are in violation of 97-27 (C) (2) (a) (3). Last week, the Association performed dredging in the canal although the Trustees had denied its application to dredge last year. The permit granted to the Association in 2000 was for one year only and no further dredging was to be performed until the erosion problem in the canal was fixed. This has not been done. Again, as the owner of one half of the shoreline of the canal and basin was not provided with notice. The Trustees choose to allow illegal docks to remain on Andros lands which affect my property rights. Why is their request honored and mine as the property owner not honored? During my twenty-seven years of service in the New York State Senate, I have always !, prided myself on the fact that my office is known for its responsiveness to constituents. In this vein, we have helped .any number -of people or groups .navigate their way through the government system. The case of Paradise Point is no exception. I was contacted by the Paradise Point Association, and asked if I could seek clarification regarding ownership of a property registered as SCTM# 1000-81-1-16.10. The Association holds the deed, however, they informed me that questions had been raised as to ownership. As they have been paying taxes on the parcel for many years, they were interested in a legal opinion from the state. Included in the Association's paperwork was a letter from you to the New York State Department of Environmental Conservation (DEC) thanking them for verifying that the state owned this parcel. WhI en my staff contacted the DEC to ask for clarification in writing on DEC letterhead, we were informed that the DEC has no authority to make such a determination. Additionally, the June 17, 2003 DEC letter which you reference did not include any opinion. It served only to clarify the agency's role and recommended that I put the Association in contact with the N.Y.S. Office of General Services. On June 25, 2003, I wrote to the Commissioner of the N.Y.S. Office of General Services explaining that I had been contacted by the Paradise Point Association in the Town of Southold and was looking for clarification. as .to ,ownership of the above mentioned parcel. This determination is, based solely on factual information_related,to .state.,maintained maps and re.cords.'T6 date, Lain awaiting a response. -more- S -2- ZUPA July 8, 2003 f To address your concerns about calls to the Southold Town Trustees in May 2002, I instructed my staff to call the trustees in regard to a March 8, 2000 letter from the NYS Office of General Services (OGS) sent to me by the Paradise Point Association. Again, the Association was asking for clarification of ownership of the above mentioned parcel. OGS stated in their letter that "limits of the state ownership would run from headland to headland at the mouth of the canal." Since the Town Trustees are charged with monitoring the waters and bay bottoms within the town, my staff discussed what area was the state's responsibility, what area was the town's responsibility and what area was the Association's responsibility. Again, I referred the Association to OGS for further clarification. Residents of Paradise Point including you, Mr. Zupa are all my constituents. My office does not routinely seek to inject itself in a neighborhood dispute, however, if a constituent asks for a service my office is able to provide, I am always happy to oblige. When a matter is not within my authority I refer it to the appropriate agencies as was done in this case. I would have taken the same steps regardless of who made the inquiry. d I stand by my offices record of public service. GENERAL CONDITIONS General Condition 1: Facility inspection by the Department The permitted site or facility,including relevant records,is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee Is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany)the Department's representative tluring an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for Inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. $ 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly,without leaving large refuse piles.,ridges across the bed of a waterway or floodplain or deep holes that mdy have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable Interference with navigation by the work herein authorized. . 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. a� 8. At least 48 hours prior to commencement of the project, the permlttee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. All dredged material shall be disposed on an approved upland site and be retained so as to not re-enter any water body, tidal wetland or protected buffer area. 2. Dredged material must be transported by barge to Town of Southold Harbor for off loading. 3. During the dredging operation,the permittee and his contractor shall prevent spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam shell or other closed"bucket"equipment. 4. Excavated sediments shall be placed directly into the approved disposal site or conveyance vehicle. No sidecesting (double dipping)or temporary storage of dredge material is authorized. 5. Dredging Is prohibited from June 1 -September 30 of each year to protect spawning shellfish and/or spawning finfish. 6. All side slopes of the dredged channel shall have a maximum of 1:3 slope. 7. The use of a dragline for dredging is strictly prohibited. 8. Dredging shall be undertaken no more than once in any calendar year unless specifically authorized by the Department. 9. For maintenance dredging projects, permittee shall submit a Notice of Commencement prior to each dredging occurrence, specifying the disposal site(including an updated site plan). Upon completion, a Notice of Completion specifying the amount of dredged material deposited at the approved disposal site must be submitted. No. 1000-81-1-16.10 Dear Mr. Krupski: 1 am presently writing you in response to your request for additional information for this project at last Wednesday night's public hearing. As discussed we are seeking to obtain an emergency permit to maintenance dredge an area located at the entrance to the existing basin. As requested I returned to the site this Monday morning, at low tide, and took additional depth measurements at the entrance to the basin. For your review 1 have enclosed additional plans 1 have prepared for the area which we are seeking to maintenance dredge. In reviewing Sheet 1 of 2 you will note that there is an area of deeper water along the bulkhead on the east side of the entrance to the basin and in the center and west side of the entrance there is a shoal. At this time we are seeking to obtain an emergency permit to maintenance dredge a 20 x 60 area to 4 ALW. This would result in approximately 85 c.y. of material being removed. The material which consists mostly of sand shall be removed to an upland disposal site. I have also enclosed a copy of a S.C.T.M_ No. 1000-81 on which I have highlighted the basin as well as parcel 1000-081-1-16.11 which abuts the western shore of the area we wish to dredge, which is also owned by the Paradise Point Association. In the past, I have observed new pilings installed in the Basin without permits. Last night during a Trustees hearing this matter was discussed and the. president of the Paradise Point Association stated that the barge was placed in the Basin to install new pilings or reinstall existing pilings damaged by ice for the Association's docks. The Trustees stated that this work should not be done without a permit and asked me to contact you today to investigate this. Additionally, it should be noted that the legality of issuing any permit, even one for repairing ice damaged pilings is being questioned, as is the continued existence of the Association's illegal and unpermitted docks in the Basin.
