SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated April 16,2026 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 22, 2026. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available,it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. REQUEST MADE BY APPLICANT: Applicant requests a Special Exception under Article III, Section 280-13B (13). The Applicant is owner of the subject property requesting authorization to construct and establish an Accessory Apartment in an accessory structure; at: 12600 New Suffolk Avenue, (Adj.to the Peconic Bay) Cutchogue,NY. SCTM#1000-116-6-13. PROPERTY FACTS/DESCRIPTION: The subject property is a rectangular, conforming 80,729 square foot (1.853 acre)parcel in the R-40 Residential District with 173.25 feet fronting New Suffolk Avenue, an easterly boundary of 477.67 feet adjacent to a residential property to the east, a 174.82 foot southerly boundary along the Great Peconic Bay, and a 454.27 foot westerly boundary adjacent to a residential parcel to the west.The parcel is developed with a one and one-half story frame house with attached three-car garage, outdoor shower, several wood decks on the front, rear, and east sides, a free-standing two-car frame garage, an inground swimming pool with hot tub, and a sports court currently under construction. All as shown on a survey prepared by Nathan Taft Corwin III, L.L.S., last updated September 26, 2022 and a site plan prepared by West Creek Builders dated March 2,2026. Page 2,July 16,2026 981127SE,NOFO NDS LLC/Vito Tanzi, Member SCTM No. 1000-116-6-13 ADDITIONAL INFORMATION: The Southold Town Building Department provided a"Verification of Livable Floor Area" dated March 12, 2026, indicating the proposed accessory apartment will contain approximately 531 square feet and is conforming to Section 280-13B(13)(a) of the Code. The application included a Suffolk County Department of Health Services Permit based on a survey prepared by Daniel R. Falasco, RE, P.C., last updated March 18, 2026, for an accessory apartment with a 3- bedroom I/A onsite waste treatment system. The subject parcel is covered by five certificates of occupancy: No. 46802 dated January 20, 2026 pursuant to Building Permit 49303 dated May 23, 2023 for an additions and alterations including a front covered porch,two rear covered porches, and one rear enclosed porch to existing single-family dwelling. No. 35243 dated September 26, 2011 pursuant to Building Permit 35508 dated April 26, 2010 for alterations and additions, including screened porch and attached three car garage with bathroom and storage above, to an existing one family dwelling. No. Z-34872 dated March 17, 2011 pursuant to Building Permit 35514-Z dated April 27, 2010 for an unheated nonhabitable accessory two car garage with attached screened porch(relocated and renovated). No. Z-33986 dated October 1, 2009 pursuant to Building Permit 34010-Z dated June 24, 2008 for alterations and additions, including outdoor shower stall, decks and covered porch,to an existing one family dwelling. No. Z-2044 dated November 19, 1964 pursuant to Building Permit 2550-Z dated October 10, 1964 for private one family dwelling. The parcel has two open Building Permits: No. 52850 dated April 9,2026 to construct additions and alternations to an existing accessory garage, amended May 6,2026 to add a half bath and utility sink on the first floor. No. 52058 dated July 2, 2025 to construct an accessory sports court. At the public hearing one neighbor inquired if the accessory apartment could be used as a short-term rental. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 2, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13)to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: Page 3,July 16,2026 #81127SE,NOFO NDS LLC/Vito Tanzi, Member SCTM No. 1000-116-6-13 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural plans prepared by West Creek Designs, pages A 1 through A8 and dated March 2, 2026, propose an accessory apartment with one full bathroom entirely on the second floor of the accessory structure with a conforming 450 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area" response, dated March 12, 2026, to the request by the ZBA, which estimated the livable floor area to be approximately 531 square feet (where the difference between the two area values can be attributed to how the area under the dormer roof line is counted). 2. The dwelling unit complies with the definition of same in §280-4 of the code. 3. The applicant herein owns and resides at the property as documented by a copy of the bargain and sale deed for the parcel dated August 23,2022 conveying the property to NOFO NDS LLC; a copy of the Limited Liability Company Agreement of NOFO NDS LLC identifying Vito Tanzi as a member with 100% capital percentage; and a utility bill from PSEG Long Island addressed to Vito Tanzi for the subject property for service period January 22,2026 to February 19, 2026. The applicant confirms that the occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole,exclusive occupancy of the owner or family member,as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be Salvatore Tanzi as evidenced by a two-year lease signed by Salvatore Tanzi. The applicant's representative testified that Salvatore Tanzi is the brother of Vito Tanzi. The application included a signed and notarized affidavit indicating that the tenant who will occupy the accessory apartment is an immediate family member. 4. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal dwelling and one for the accessory apartment, as shown on the site plan prepared by West Creek Designs and dated March 2, 2026. 5. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof, shall be permitted in or on premises for which an accessory apartment is authorized or exists. 6. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 7.No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations, determinations and findings required in Chapters 280-142 (General Standards) and 280-143 (Matters to be Considered) specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Steinbugler, seconded by Member Acampora, and duly carried,to GRANT the Special Exception Permit as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to obtaining a Certificate of Occupancy on the accessory apartment, the applicant shall provide the Zoning Board of Appeals with a copy of a completed, signed, and notarized lease between the property owner,NOFO NDS LLC/Vito Tanzi,and the tenant, Salvatore Tanzi,along with a copy of the associated rental permit. 2. The first floor of the garage shall remain unconditioned space and there shall be no access from the garage first floor to the second floor. 3. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 4. This Special Exception permit cannot be transferred to new owners. 5. The subject property(house or accessory apartment)is not eligible to be rented,outside of the Special Exception permit,as described herein. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Subiect to the Following Conditions: 1. Prior to obtaining a Certificate of Occupancy on the accessory apartment, the applicant shall provide the Zoning Board of Appeals with a copy of a completed, signed, and notarized lease between the property owner, NOFO NDS LLC / Vito Tanzi, and the tenant, Salvatore Tanzi, along with a copy of the associated rental permit. 2. The first floor of the garage shall remain unconditioned space and there shall be no access from the garage first floor to the second floor. 3. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 4. This Special Exception permit cannot be transferred to new owners. 5. The subject property (house or accessory apartment) is not eligible to be rented, outside of the Special Exception permit, as described herein.
