The meeting was called to order at 1: 30 P.M. with the following present: Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice Clark: seconded by Councilman Demarest: RESOLVED: That the minutes of the meeting of September 13, 1960 be and they are hereby duly approved as read. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark.. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly meeting of the Town Board be held .at the office of the Supervisor, 16 South Street, Greenport,N.Y. on Monday, . Oct. 10, 1960, at 1:30 P.M. Vote of Town Board: Ayes-Superviscr Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Mr. William Krause appeared before the Board as a representative of the Auxiliary Police asking that the Town Board consider a car for their use on duty at church, etc. The Board would consider tha t matter at a later date. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the report of Ralph P. Cox, Dog Warden, for the month of September be accepted by the Town Board and placed on file. . NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and. he hereby is directed to transmit this petition to the Planning Board in accordance with the Section 901, Subdivision C of Article IX of the Building Zone Ordinance of the Town of Southold. Tuthill, Mattituck, N.Y. be and hereby is granted for year round n occupancy for a two year period. Voorhis &- Sons, Inc. consulting Engineers. on City Planning urged that consideration be given them as the Town' s Consultants on matchers of engineering and community planning. At 2:30 P.M. the Supervisor opened the public hearing authorized pur- suant to a resolution' of this Board on the 13th day of September,. .1960, on the following ordinance: Ordinance Regulating the Use of Boats within the Town of Southold. Bloom by petition verified the llth day of July 1960 petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and AGric- ultural District to "B" Business District, and WHEREAS, the said petition was referred to the Planning Board for its official recommendations and report and WHEREAS, the Town Board pursuant to due notice thereof held_'_a hearing on said petition on Oct. 4, 1960, at which time all interested persons were 3gsverl an opportunity to be heard, NOW, THEREFORE, BE. "B" .Business District. and WHEREAS, the said petition wao(referred to the Planning Board for its official recommendations and report, and WHEREAS, the Town Board pursuant to due notice thereof, held a hearing on said- petition on Oct. 4, 1960, at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED; That the 'Southold Town Building Zone Ordinance including the Southold Town Building Zone Maps be amended, by changing from "A" Residential and AGricultural' District to "B" . Business District the following described property: . ALL that certain- bract or parcel of land situated at .Laurel, in the. Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: 335 BEGINNING at the intersection of the northwesterly line of Main (State) Road with the southwesterly line of Aldrich Lane and running thence south- westerly along said northwesterly line of Main (State) Road 750 feet to a point 50 feet southwesterly from a store building; thence westerly on a line about at right angles to said' Road line, 200 feet to the boundary line between land of Mary E. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the Southold Town Building Zone Ordinance be amended to read as follows: I . By 'amending Article 11, Section 200, to read as follows: SECTION 200-USE DISTRICT REGULATIONS-- For the purpose of this Ordinance, the Town of Southold, outside of the incorporated. villages, is hereby divided into four (4) classes of distaicts which shall be designated as follows; "A" RESIDENTIAL AND AGRICULTURAL DISTRICTS "M" MULTIPLE RESIDENCE DISTRICTS "B" BUSINESS DISTRICTS "C INDUSTRIAL DISTRICTS II." By amending Article III, Section 300, Subdivision 9, to read as. follows: 9.--The sale at retail".of farm, garden or nursery products produced or 'grown on the premises or of animals raised on the premises. (1) advertising sign, either single or double faced, not larger than four (4) feet by six (6) feet in size, advertising the sale of farm, ,; garden or nursery products produced or grown on the premises or of animals raised on the premises. III. By amending Article III,. Section 300, Subdivision .10, to read as follows: 10--One (1) real estate sign, either single or double faced, not larger than three (3) feet by four (4) feet in size, on any one . (1) or more lots, advertising the sale or lease of only the premises on which it is maintained and set back not' less than the required front yard- distance and not less than ten (10) feet from each side line. IV. •By amending Article IIIA, Section 350, by adding thereto. a new subdivision to be Subdivision 1A' to read as follows: lA-- Two (2) Family Dwellings. V. By amending Article IIIA, Section 360, Subdivision 2, to read as follows: (2) On premises used for hotel, motel, boarding and tourist, house purposes, unless otherwise provided as a special exception by the Board of. Appeals' as hereinafter provided, one (1) advertising% . sign, either single or double faced, not exceeding fifty (50) square feet in area, the lower edge of which shall be not less than four (4) feet above the ground, and the ubper edge of which shall not exceed more than thirty-five (35) feet above the ground. Such sign shall ad- vertise only the business conducted on the premises, and shall be set back not less than five (5) feet from all street and property lines. VI. By amending Article IV, Section 400, Subdivision 7, to read as follows: 7--Places of amusement when approved as a special exception by the Board of Appeals as hereinafter provided. VII. By amending Article IV, Section 400, Subdivision 9, to Lead as follows: 9--Public garages, motor vehicle service stations and park- ing lot areas for the storage of new or used motor .vehicles for sale or hire, when approbed as a special exception by the Board of Appeals as hereinafter provided. After much discussion, the petition of George Alec from "A" Residential and Agricultural. District to "C"- Industrial District was held over: for . a .later date. Moved by Councilman Demarest; seconded by Just±ce Tuthill: WHEREAS, the Town" Board of the Town of Soulh old held a public- hear'ng at the Supervisor' s Office, 16 South STreet, Greenport, N.Y. on -Oct. 4, 1960, at 2: 30 P.M. on said day 'on the question of the enactment. of an Ordinance entitled "An Ordinance Regulating the Use of Boats Within the Town of -Southold" at which time and place all interested persons _ were given opportunity to be heard, and WHEREAS, the Town Board of the.. Town of Southold deems it in the public interest that said proposed ordinance should be enacted, NOW, THEREFORE, BE IT RESOLVSLI° and ORDAINED that the Town of Southold enact the following ordinance to wit:- AN ORDINANCE REGULATING THE USE OF BOATS WITHIN THE TOWN OF SUUTHOLD. Section 1. Short Title. This Ordinance shall be known as the "Boat Ordinance . of the Town of Southold" . Section 2. Areas Covered The following rules, and regulations shall apply to all waters within the Town of Southold and to all waters bounding the Town of Southold to a distance of 1, 500 feet from the :shore; provided that they shall- not apply to waters within or bounding an incorporated village of the Town to a distance of 1, 500 feet from the ,shore. Section 3 . definitions The term "boat" shall-.�mean and include every vessel propelled in any manner, except. vessels having,•a valid marine document - issued by .the.. Federal Bureau of Customs or any foreign government. Section 4. Sanitation The dumping, of oil', refuse", garbage, sewage or waste is prohibited except that toilets may be discharged in any areas not .within .1, 000 feet of any .shor"e line. SEction 5 . Hazards to Navigation (a) Any boat which be comes a menace to. navigation or unseaworthy. or sinks, grounds or otherwise becomes disabled or incapable of navigation shall be removed or restored to navigable condition by the registered owner upon notice .'from the Southold Town Board. or its designated agent which notice shall- be either by personal service or registered mail, , addressed to the registered owner ' s last known address as• given by him or as stated in his certificate of registration. (b) If such boat is not removed or restored to navigable cond-ition ,by - the said owner`fl6neweek afterthe mailing of said notice, the Southold Town Board or its designated agent may direct the removal or destruction of the boat, and the cost of said removal including storage charges shall attach to and shall become a lien upon said• boat, and said boat may be sold upon direction of. the Court at public auction to defray i§aid expenses, any surplus being returned to the" owner of record. The Town shall not be liable for any damage done to- said boat during its removal, storage and sale. Section 6. Operation near Bathers No boat propelled other than by hand shall cruise or be operatedd within 100 feet of anjr. life lines .or bathing ,float or if, there be no- life. lines or.- bathing float, then within 100• feet of any public or semi-public beach regularly used for bathing or swimming, except. that such boat may approach• or depart perpendicularly to such beach at less than five miles per hour solely for the purpoae .of commencing or ending the ride. Section 7 . Water Skiers (a) No person shall- operate a boat for towing a person on water skis, a surf-board, or similar device unless. there is in such boat or vessel a person other than the operator in a _position to observe the progress of the person being towed. (b) No person shall ride on water skis, a surf-board, or similar device or use or operate a boat to tow- a person thereon between the period from one hour after sunset- to one hour •before sunrise. (c) No person shall ride on water skis, a surf-board, or similar device or use or operate a boat to tow a person thereon within 150 feet of any public or semi-public bathing beach or public dock or within 50 feet of any swimmer or bather . Nor shall any such person engaged in such activities come within 300 feet of the shore line unless they approach or depart perpendicularly to the shore line and solely for the purpose of commencing or ending the ride. -SECTION 8. Operation of Boats or Vessels (a) The Town Board of the Town of Southold may by resolution limit the speed of boats in any waters in which this Ordinance applies and shall cause notice of such speed limit to be posted at appropriate places in the areas effected. Any person who shall operate a boat in such areas at a greatersspeed than_'.thec:speed specified in such notice shall be deemed to have violated this Ordinance. (b) Every person operating a boat shall at all times operate the same in a careful and prudent manner and at such a rate of speed as not to unreasonably interfere with the free and proper use of the waters or unreasonably endanger any person or property. Section 9. Mufflers No person shall operate a boat propelled wholly or partly by an engine operated by the explosion of gas, gasoline, naptha, or other substance without having the exhaust from the engine run through a muffling device so constructed and used as to muffle the noise of the exhaust in-a reasonable manner . Section 10. Aquatic Events Nothing herein contained shall prohibit the Town Board of the Town of Southold from issuing special permits far aquatic events, boat races, or otherwise under proper supervision in limited areas for limited periods. Section 11. Penalties Any person who violates any provision of this Ordinance shall be guilty of an offense, and upon conviction shall be subject to a fine of not more than $100.00 or imprisonment for not more than six months or by both such fine and imprisonment. Section 12. Repeal of Conflicting Ordinances All ordinances or parts of ordinances inconsistent or conflicting with the provisions of this Ordinance are hereby repealed insofar as the,�:same affect this Ordinance; provided, however, that such repeal shall be only to the extent of such inconsistency and conflict, and in all other respects this Ordinance shall be in addition to other ordinances regulating:`..and governing the subject matter covered by this Ordinance. Section 13 . Severability If any section or provision or part thereof of this Ordinance shall be adjudged invalid such invalidity shall not affect the validity of this Ordinance as a whole or of any other section or provision thereof. Section 14. Effective Date This Ordinance shall take effect immediately. BE IT FURTHER RESOLVED, that ,the Town Clerk cause the foregoing ordin- ance to be entered in the minutes of the Town Board, and cause a copy specifying the date of adoption thereof to be centered in the ordinance book of the Town of Southold, and that said Clerk further causeca copy of said ordinance to be published omce in the Long Island Traveler- Mattituck Watchman, a newspaper published in the Town of Southold, and a copy thereof to be posted on the signboard maintained by the Town Clerk, and than affidavits of such publica"hd)on and posting be filed with the Town Clerk, and BE IT FURTHER RESOLVED, that the Town Clerk cause a copy of the forego- ing ordinance to be submitted to and approved In' writing by the Conser- vation Commissioner of the State of New York, pursuant to the provisions of Section 130 of the Town Law. Wentworth Horton, former Supervisor of the Town of Southold,. and former Senator of the New York State Legislature, and WHEREAS, in his service to the people of the Town of Southold as Supervisor from January 1934 through 1948 and to the people of the State of New York as New York State Senator from 1946 to 1956, Senator Horton distinguished himself as a thorough and conscientious public servant, RESOLVED: That the Town Board of the Town of Southold hereby gives formal expression of its loss in the death of Senator Horton, a man esteemed by his associates and respected by all, and BE IT FURTHER RESOLVED. that when the Town Board adjourns this day, it do so out of respect to the memory of the Honorable S. Wentworth Horton, and BE 'IT FURTHER RESOLVED, that a copy of this resolution be spread upon the minutes of this meeting and 'a copy be transmitted to Mrs.' Horton that we may extend to her and to the members of the family our sincere sympathy.
