Specifically, please include the overall condition of the two channels, which channel you consider safest to use, a report of your general experience in navigating this body of water, in addition to anything else you consider pertinent information. Additionally, if you could also prepare a written report in regards to the mooring surveys you completed in the past year (of all creeks) , it would be extremely helpful to us. The storm caused severe damage and our office has been inundated with numerous and frantic phone calls from Both. North and South Fork businesses and residences. The damage was extensive and an excessive amount of property was lest (includ- ing dwellings) . As a result, our office has had to undertake emergency procedures to secure permitz to protect xa merous properties. Due to the above circumstances, we do not fordee starting your job until the first or second week in Februaxry, hopefully sooner. our office has been working with Town and State officials and they are very much aware of the stomas effects. 1 am sure that they will understand our delay in starting. your project as being unavoidable. we sincerely apologize for any inconvenience this may have caused you. To confirm our telephone conversation of this afternoon: The Hallock Bay Daybeacons are listed in the current sight List as year-round aids; the buoys are seasonal aids maintained from April l through Oct. 1. 2. Under federal law, the daybeacons must be maintained 365 days a year. The buoys may be maintained beyond the dates listed, but they must be maintained during the advertised period. Hence, a buoy remaining on station after Oct. 1 or placed on station before April 1 is perfectly legal, but failing to maintain a buoy during the advertised period is a violation of federal law. S. I hope this has clarified for you the federal rules governing these aids. Additional state requirements consistent with this regime can be imposed (and for our purposes municipal=state) but when such requirements directly conflict with the federal rules, the federal rules supercede any local requirements. Please contact me if you have any further questions. 4. Mr. Dacimo and his attorney guaranteed that the markers would be removed by mid-January and showed us. a signed contract with contractors to -remove them: The Board was very lenient in allowing the channel markers to remain until mid-January, for reasons stated in the file. The Board has expended a tremendous amount of patience in ,dealing with this matter, which is, in reality, very simple and straightforward. Pursuant to our agreement with Mr. Dacimo, I will direct our Bay Constable to begin issuing Wetland Violations on January 23, 1995 and everyday afterwards. I advise you to urge your client to honor his obligation to remove the channel markers. Board of Trustees on Thursday, May 26, 1994: WHEREAS, the Narrow River Marina has applied to the Town Trustees for permission to place private aids to navigation in Hallocks Bay, Orient on Trustee underwater lands under the provisions of the Town Wetland ordinance and Chapter 32 of the Town Code, and, WHEREAS, the Trustees took action on July 7, 1993 regarding this request and, WHEREAS, the applicant appeared before the Trustees on April 26, 1994 requesting clarification of the Trustee's approval. Therefore be it, RESOLVED, that the Southold Town Trustees approve placement of temporary channel markers for one season, to be removed by October 31, 1994. He also said the permit could be ammended to seasonal as opposed to year round. Because there is a valid permit for channel markers, Smith said the marina could place the floating aids and file for the ammendment with his office. Based on telephone conversations with your office and our records, we interpret your letter of February 23rd to be in regard to Southold Town Permit No. 3809, issued February 23, 1990, and expiring in February 1992. All of the work on this Permit had been completed except for a small missed area near the entrance to the Marina channel. Originally, the Owner felt that it might not be necessary to go back and complete this area,_ but,after.several boats had run aground here decided that he would like to complete the work to the parameters in the original permit. Our records indicate that extension was given up to February 23, 1994 to accomplish this. Unfortunately, because of weather delays and other work, the Contractor was not available to do the work prior to the deadline. As we also understand that the maximum extension was for two years an additional extension was not requested. In a recent discussion with the Owner, they indicated a desire to make application to complete the original work, and it is the intent to submit a request accordingly. The.D.E.C. permit for this work does not expire until 1995, and the Corps of Engineers has ruled that their additional work would fall under their ten year maintenance condition of the original permit. Needless to say, I was stunned by your interpretation of the facts. My recollection of what occurred on Narrow River Marina's application to the Trustees is not subject to the brief description provided in the first sentence of your letter. What occurred, as I am sure your investigation of the file will reveal, is that the Trustees erred in the processing of our application, failing to note what was approved as the channel marker system now in place. Your investigation of the file will also reveal the August 3, 1993 letter from BMC Joseph A. Minter, the officer in charge of aids to navigation in our district for the United States Coast Guard at East Moriches. That letter expressly disapproves floating aids. The letter, which I read as an expert opinion on the subject of navigation markers, rejects the installation of floating aids for numerous reasons, including safety of boaters. The channel across Hallock's Bay to Narrow River Marina and the T own's boat launching ramp is not merely a natural narrow channel. The bottom of the narrow channel is bordered by large stones and stone dikes. This channel was built between 1887 and 1904, and has been in constant use since then. The channel is a considerable distance from any nearby upland and an accident arising by reason of the placement of floating aids in distinction to the existing daybeacons, we should assume, will place boaters at distinct risk of personal injury, property damage and, if one reads the letter of the United States Coast Guard with the respect it deserves, a genuine risk of loss of life. I am not willing to accept the risks that are identified as likely if the markers are changed or removed. The existing daybeacons have created no problem for anyone and they have in fact permitted safe passage for boaters without incident. If the Trustees feel on a considered analysis of this matter that there was no error in the Albert J. I will not accept the identified risks. We do not have unlimited resources to expend on insurance premiums, and, as a boater, I value, as I am sure each of you value, the capacity of open waters to challenge the most skilled as well as the least skilled boaters. I do not wish to add to the challenges after an organization as expert as the United States Coast Guard tells me in language that we can each understand clearly that we are placing boaters at risk when distant from any adjacent shore by installation of floating aids. have tried for a period of now exceeding four years to work with you in a cooperative and businesslike fashion. I have expended tens of thousands of dollars in complying with the important concerns expressed by you and other regulatory bodies. I am upset that your February 14, 1994 letter seeks not only to revise actual historical fact, but also seeks to diminish the role of the Trustees in unilaterally creating any issue that now brings us at odds with each other and at the same time ignores the functional significance--indeed the only functional significance--of those channel markers. They are there to protect the public in taking access to an interior body of water over a narrowly prescribed known-to-be risky channel. I do not intend to deny or diminish the seriousness of the issue, and I do not intend to place my family and my marina at risk as a result of what we can all agree was an error by the Trustees in failing to properly handle my application. If you wish to discuss this matter, please let me know. If you wish to insist upon the removal of the permanent markers in favor of diminishing public safety, then I believe that I would prefer to obtain the view of a Supreme Court Justice before I next speak to my insurance broker. Letter from Southold Town Trustees to the writer requesting reapplication of Aids to Navigation for this particular channel. The background of this is as follows: This channel was originally constructed by the Hallock family just prior to the turn of the century for interstate commerce including shipping of vegetables and farm products . to New England, and the shipping of horse manure from New York to Orient to be put on the farm lands. A partial list of ships using this is enclosed. The Channel was originally marked with stake markers and their locations are shown on the Peconic Survey drawings and on Chart No. 12358, llth Edition, dated August 711 1976 (copy enclosed). These stake markers, or piles, have pretty much disappeared except some of the stubs that were discovered during the survey. The presently installed markers were installed in accordance with the Coast Guard Private Aids to Navigation Handbookand the Coast Guart Permit. The present channel, except for points of silting in during the last December Storm, is approximately fifty (50) to sixty (60) feet wide at the top and thirty (30) to forty (40) feet wide as the bottom of the Channel, with varying depths of four (4) feet to eleven (11) feet, with the four (4) feet bein the controlling one. Do not remove or change existing daybeacons. The preferred method of marking narrow shallow waterways are fixed aids exactly like the daybeacons already in place. Floating aids with attached sinkers and chain are more likely to become a hazard than an aid in this restricted waterway. (B) . Floating aids are subject to movement due to ice, currents, collisions, and vandalism. Private aid owners are responsible for establishing an aid position, placing the aid on its assigned position and ensuring its reliability year round. The aid owner may be liable for any accidents or groundings that can be attributed to an aid to navigation being off station or missing. Floating aids are more likely to be damaged, moved, or missing than a fixed structure. (C) . 'The Coast Guard is responsible for inspecting the Private Aids to Navigation system but we do not usually make recommendations on specific marking systems. The owner of the waterway is responsible for ensuring the waterway is safely marked. When an application is made we review it and make sure it meets with 'the requirements of the IALA system and does not conflict with the Federal Aids in the area. (D) . In. the Light List Volume I Atlantic Coast Hallock Bay daybeacons are listed as year round aids. Unless the aid owners can ensure the reliability of the aid system throughout the year the aids must be seasonal. Resolution to approve amendment to Permit #3809 to provide for placement of private aids to navigation in the "North" channel of Hallocks Bay, Orient: WHEREAS, the Narrow River Marina has applied to the Town Trustees for permission to place private aids to navigation in Hallocks Bay, Orient on Trustee underwater lands under the provisions of the Town Wetland Ordinance and Chapter 32 of the Town Code, WHEREAS, the Trustees have caused a Public Hearing to be held on April 29, 1993 to provide for public input into said application, WHEREAS, as a result of the public comment at said hearing the Board of Trustees directed the Bay Constables to mark an alternate route suggested by the public, WHEREAS, the public requested floating markers to enhance the safety of marking the channel WHEREAS, said alternate route was subsequently found to lack sufficient depth for safe navigation at safe speeds, RESOLVED, The Southold Town Trustees approve the amended application of Peconic Associates on behalf of Narrow River Marina to place private aids to navigation on Trustee land in Hallocks Bay Orient as provided in the amended drawing dated March 20, 1993 (revision) subject to the following conditions which shall be in force while these aids to navigation are on public lands of the Town of Southold Trustees: 1• All markers shall conform to the standards of the U.S. Army Corps of Engineers (USCOE) and the U:S. Coast Guard. 2. Written proof of an application submitted by Narrow River Marina, Inc. to the USCOE and the U.S. Coast Guard requesting conversion of all stake markers to floating aids to navigation shall be submitted to this office within 30 days of receipt of this permit. 3 . Subject to the approval of the USCOE and U.S. Coast. Guard, all stakes shall be converted to floating aids to navigation excepting stakes number 1 and 3 which may remain to post public notifications for the bay. 4. It is the responsibility of Narrow River Marina Inc. to provide a copy of the current Coast Guard Permit to the Trustee Office and inform the Trustees of any change in status of their Coast Guard Permit. 5. An insurance liability policy in the amount of $1,000,000. 00 naming the Southold Town Trustees as insured shall be maintained with copies provided to the- Southold Town Trustees establishing that said policy is current. 6. Immediately upon receipt of a Coast Guard permit (if any) to convert the 'fixed aids to navigation to floats as outlined in number (2) above, the Narrow River Marina shall notify the Trustees of said permit and shall perform the conversion on a timetable established by the Trustees which shall afford Narrow River Marina not less than 60 days for the conversion in question. RESOLUTION, to rescind Town placement of of aids to navigation in South Channel of Hallocks Bay, Orient: WHEREAS, there is insufficient depth to navigate at a safe Posted speed in sections of the channel thus creating a hazard and liabilities for the Town, WHEREAS, there are insufficient funds to accomplish maintenanc dredging in the shallow area in question, e WHEREAS, there are questions surrounding who owns the bottom in the shallow area and who could give permission to maintain it, WHEREAS, marking a channel into the interior of Hallocks Bay would unnecessarily attract larger vessels which might contain deleterios materials, WHEREAS, such an internal channel would create an attractive and problematic enforcement problem for recreational skiers going to close to the channel, RESOLVED, the Southold Town Trustees rescind placement of temporary channel markers - "aids to navigation" in the "South" channel and direct the Bay Constable to remove all such markers and withdraw any pending permit applications with the Coast Guard. The channel from Brown's Point into the Marina is O.K. , but the area from Hallock's Bay to Brown's Point, "North Channel" , is a problem. The water from Gids Bay comes out, fast under certain conditions and sometimes deposits sand in this area and sometimes digs holes. The 'area is not dependable as a channel. It is even now shoaling up between buoy' s 6 and 7. We measured depths in this area and also in the South channel which runs along Long Beach. Measurements where made in both channels about an hour after low tide. The North Channel measurements between markers 4 and 7 showed five and six feet of water, except at marker 6 there was four feet and about half way between marker 6 & 7 it shoaled to 31 . This would probably be about 2 ' at low tide. At marker 7 there was 61 , but .the flat has worked its way towards #7 and the channel at this point is- quite narrow. Going to the South Channel there is 12 ' of water. This decreased to 5 ' and continues in a straight line at 5 ' until you get to a point were a left' turn would be made to go to the Marina. At this point the depth increases to 91 . The South Channel shows no indication of changing depths as there is no reason why it should since there is a steady flow to and from Little Bay. I recommend using the South Channel with a. large marker at the West end and two floating markers in a straight line to the turning point. A marker here and 2 or 3 floating markers to direct traffic to the entrance of the Marina. Request subject permit be extended for a period of two (2) years (to February 23, 1994) to permit the Owner to complete the authorized channel dredging at the entrance to the Marina. Based on the as-dredged survey of September 30, 1991, you will note that the low tide water depths are from 3.3 feet to 3.8 feet at the entrance channel, or 0.2 feet to 0.7 feet shallower than that authorized. Consideration was given by the Owner not to complete the authorized dredging but boats occasionally hitting bottom in this area during real low tides has resulted in a re-evaluation of the need to complete the previously authorized work. Estimated quantities of dredging for the above is Two Hundred (200) Cubic Yards. As we discussed, the permit request that resulted in Permit # 3809 had included the channel markers referenced in your letter of February 8, 1993. It is requested that subject permit be amended to include the channel markers in the locations recorded on the approved Coast Guard Permit - copy enclosed. Please note that each channel marker has been given a number by the Coast Guard. Also enclosed is a copy of the Corps of Engineers Permit which authorized the channel markers as approved by the Coast Guard and installed in accordance with their requirements. It is realized that the Town Trustees have had discussions over the justification of placement of private aids to navibation. The Coast Guard is quite specific regarding their jurisdiction. The following is quoted from their regulations: "No person, company or government agency other than the Armed Forces may place private aids to navigation anywhere in the navigable waters of the United States without first obtaining the permission of the Commandant of the Coast Guard or the District Commander in the appropriate Coast Guard District (14 USC 83, 33 CFR 66.01-1, 33 CFR 66.01-3). The Navigable Waters of the United States include coastal waters below the mean high water mark or waters subject to the ebb and flow of the tide and inland waters not subject to tidal influence which are used, or have historically been used, or may be improved at a reasonable cost so that they may in the foreseeable future be used to carry interstate or foreign commerce (33 CFR 2.05-25)." The Coast Guard also states: "In order to ensure safe passage through the navigable waters of the United States--which include nearly every°bay, cove, inlet, river, creek, or stream that can be reached by a boat--the Coast Guard regulates the placement and operation of these private aids to navigation." Also, please note that the Coast Guard has classified these aids as Class II, which means they are used for general navigation. With the placement of these aids also goes specific responsibilities. The Owner must maintain them at all times and are subject to inspection by the Coast Guard at any time and without prior notice. Because of the importance placed on these aids by the Coast Guard, any discrepancies must be reported immediately by telegram or other rapid means of communication so that a Notice to Mariners may be issued. Also, these aids once place and approved by the Coast Guard, which these are, cannot be removed without authorization by the Coast Guard. Would like to suggest that any question of jurisdiction regarding these aids to navigation between the Town and the Coast Guard be an item of discussion between you and the Coast Guard, and that we be advised of the results of these discussions.
