Box 672 1 Bootleg Alley Greenport NY 11944 Re: Narrow River Marina SCTM #27-2-4 Dear Mr. Wiggin, The following action was taken by the Board of Trustees during its regular meeting held on October 27, 1994 regarding the above matter: RESOLVED, that the Board of Trustees DENY without prejudice, the application of NARROW RIVER MARINA to remove at the. high spots at entrance to marina that was originally included and authorized for maintenance dredging on Permit #3805 issued Feb. 23, 1990. Permit was extended to Feb. 23 , 1994, but for reasons of: 1) owner' s original decision not to have the contractor return to complete work, (owner changed his mind after receiving complaints of boats striking the bottom in area of low tide) , 2) contractors availability for such a small job and difficult access, & 3) ice conditions that prevented work being done in January 1994 as scheduled by the contractor. Total dredged, 90 c.y.. all as per description on sheet 1 of survey only. Located Narrow River Road, approx. 1. 0 miles' south of Route 25 in Orient. Presently the Narrow River Marina has permission from our Board to place "temporary channel markers" either posts or floats, which must be removed by October 31, 1994.. Under the terms of our latest agreement, the Southold Town Board of Trustees will this winter review all channels into Hallocks Bay to determine which one, if any, should be marked. Application to the United States Coast Guard for revision to their previously issued permit for channel markers, requesting that they change from all day beacons to a mix of day beacons and floating buoys. 2. Soundings taken on June 25, 1994. See the updated, as dredged, surveys with location outlined. The estimated quantity to be dredged to complete the original work has not changed as a result of the recent soundings. As previously indicated, the proposed work would only be to remove the high spots where the water depth is less than 3.8 feet at low tide. Narrow River Marina - Channel Markers - Coast Guard Approval Dated 8/26/1991 Dear Mr. Smith: As previously discussed with you by telephone, enclosed is proposed revisions to the previously approved channel markers (day beacons) identifying the channel and rock hazards from Orient Harbor into Hallocks Bay and to Narrow River Marina. As per previous notification, last year's severe ice conditions either broke, damaged, or moved off station,the majority of the day beacons. In accordance with your directive day beacons number 1, 3, 4, 6, 7, and 9 have been replaced, and previous day beacons 10, 12, 13, 14, and 15 have been replaced with temporary channel markers. You will note that in the attached application we have added a proposed additional channel marker, number 5, at the North end of the submerged rocks so as to provide a more safe entrance into the channel and have renumbered the channel markers accordingly. As we discussed, we feel that the use of day beacons up to Brown's Point are required because of the narrowness of the channel to this Point, and also because of the extent of the rock hazards that were placed as part of the original channel stabilization. Also, the tide current in this area is much greater than to the North of Brown's Point. Southold Town .Board of Trustees on Thursday, May 26, 1994: WHEREAS, the Narrow River Marina has applied to the Town Trustees for permission to place private aids to navigation in Hallocks Bay, Orient on Trustee underwater lands under the provisions of the Town Wetland ordinance and Chapter 32 of the Town Code, and, WHEREAS, the Trustees took action on July 7, 1993 regarding this request and, WHEREAS, the applicant appeared before the Trustees on April 26, 1994 requesting clarification of the Trustee's approval. Therefore be it, RESOLVED, that the Southold Town Trustees approve placement of temporary channel markers for one season, to be removed by October 31, 1994. The channel markers may be either floating markers or stakes. Only channel markers numbers 1 and 3 as shown in the amended drawing dated March 20, 1993 , may be permanent markers. The urgency for immediate accomplishment is not as great as it was earlier because we are getting near the end of the boating season, although the Applicant reported that he has lost two (2) more customers this last week because of the blockage in the channel. Also, as the local scallop season starts on October 4th, I am of the opinion that the Town of Southold would prefer that the dredging be delayed until November or December. PERMIT EXTENSION TO COMPLETE DREDGING In order to resume dredging of incomplete or storm damaged sections previously authorized by permit #3809 you will .have to justify need by providing this office with an acceptable marine survey of the bottom. Such dredge work, if authorized, would. have to be completed by February 23, 1994. In any instance, a final survey shall be submitted within 90 days of completion of the work or no later than 90 days after the permit expiration date. At this point it could be argued that a violation of permit #3809 exists in that it expired -by more than 90 days. and we have yet to receive the final survey as required. It is the policy of this Board to provide permit extensions for no more than 2 years after the original permit expiration date. Extensions requested after the original permit has expired may be granted within the 2 year period at the discretion of the Board, usually for good cause and when no controversy or change in circumstances surround such request.
