replace 133' of storm damaged bulkhead. Remove 84' of 'storm
damaged bulkhead and construct 34' of new bulkhead to replace the
84' of bulkhead to be removed. Dredge approximately 150 c.y.
Relocate 30' of storm damaged wave break. Relocate existing dock 10'
to the north and extend it 20' to the west. Install six 2 1/2' x 8'
finger floats. Replace 14 storm damaged or lost pilings.

Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617 . 10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, , as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type II
DESCRIPTION OF ACTION: Peconic Association on behalf of Narrow River
Marina to replace 83 ' of bulkhead and extend bulkhead 341 . Extend
floating dock to new bulkhead location. Remove damaged bulkhead and
fill to water depth of 41 . Relocate existing floating docks and
pilings. Replace and relocate 30 ' of wave break and replace 50' of
bulkhead (wave Break) . Install 2 1/2 ' X 8 ' finger piers. Note:
reconfigured layout equals 12 slips, replacing existing 14 slips all
per survey and plan dated January 18, 1993. Located Narrow River

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board .of Trustees, has indicated that
. no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

SUBJECT: Narrow River Marina - Storm Damage
Dear Mr. Bredemeyer:
In preparation of starting the work approved for storm damage under Permit Number
E-27-2-4, it was discovered that the existing bulkhead on the South side of the jut out
into the Marina (see Plan) was also failing.
In lieu of also requesting a Permit to replace this section as well, it is requested that the
Storm Damage Permit be modified to extend the 83 Ft. section of bulkhead an
additional 34 Ft. Therefore, the Permit request would substitute the Section A of 130
Ft. to be changed to Section A 117 Ft.
As part of this modification, it is also requested that the exterior sections of the
bulkhead be removed and the remainder of the fill left inside of it to be removed to a
water depth of 4 Ft.
Your early review and consideration this will be greatly appreciated.

The decision whether to issue a permit will be based on an
evaluation of. the probable impact, including cumulative .impacts,
of the proposed activity on the public interest. That decision
will reflect the national concern for both protection and
utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be
balanced against its reasonably foreseeable detriments. All
factors which may be relevant to the proposal will be considered
including the cumulative effects thereof; ' among those are
conservation, economics, aesthetics, general environmental
concerns, •wetlands, historic properties, fish and wildlife
values, flood hazards, floodplain values, land use, ' navigation,
shoreline erosion and accretion, recreation, water supply and
conservation, water quality, . energy needs, safety, food, and fiber
production, mineral needs, considerations of property ownership
and in- general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the
public; Federal, state, and local agencies and officials; Indian

Tribes; and other interested parties in order to consider and
evaluate the impacts of . this proposed. activity. Any comments
received will be considered by the Corps .of Engineers to

quality, general environmental effects, and the other public
interest factors listed above. Comments are. us.ed in preparation

Pursuant to Section 7 of the Endangered Species Act (16
U.S.C. 1531) and based upon a review of the latest published
version of the threatened and endangered species listing, a
preliminary determination is that the activity under
consideration will not affect those species listed or their
critical habitat.
Based upon a .review .of the properties listed or eligible for
listing in the latest available version of the National Register.
of Historic Places, there appears to be no sites included in the
Register within the permit area. Presently unknown
archaeological, scientific, pre-historic or historical data may
be lost by work accomplished under the required permit.
Review :.of activities pursuant to Section 404 of the Clean
Water Act will include application of the guidelines promulgated
by the Administrator,' U.S. Environmental Protection Agency, under
authority of Section 404 (b) of the Clean Water Act and the
applicant will obtain a water quality certificate or waiver from
the appropriate state agency in accordance with Section 401 of

Pursuant to Section 307 (c) of the Coastal Zone Management

the applicant has certified in the permit application that the
activity complies with, and will be conducted in a manner that is
consistent with, the approved state - coastal zone management
program: By this public notice, we are requesting the state' s
concurrence with, objections to, or waiver of the applicant's
certification. No permit decision will be made until one of .

WORK DESCRIPTION
The applicant, Narrow River Marina/Fred. Dacimo, has requested
Department of the Army authorization to remove, restore and
construct bulkheads, relocate. an existing wave break and pier,.
install finger floats and maintenance dredge with upland disposal .
in Hallock' S Bay, Gardiners Bay at Orient, Town of Southold,
Suffolk County, New'York. .
The work would involve replacement; in-kind and in-place, of
approximately 133 linear feet of storm-damaged bulkhead, removal
of approximately 84 linear feet of storm damaged bulkhead and
construction of approximately 34 feet of new bulkhead to be tied
in with the replacement 'bulkhead .on the west" side .of the
property. The applicant proposes to relocate 3U feet of storm-
damaged wave break and rel•ocate .an existing floating pier 10 feet:
to the north and .extend it 20 feet to the west so as to tie in to
the new 34-foot bulkhead. The floats would be accessed by a
replacemetn 3 - foot by 10 foot hinged walk ramp. Six 2 1/2 .f"oot
by 8 foot finger floats would be installed, 14 storm damaged
pilings would be .replaced and two rows of total of 24 pilings
would be relocated 10' feet to the north. The applicant also
proposes to excavate and subsequently dredge, with ten years
maintenance, .the section along the 83 foot. replacement bulkhead
and the rectangular shaped area from which the bulkhead would be
removed to a depth of 4 feet below mean low water, removing
approximately 150 cubic yards of material. Two future dredging
.events would be undertaken during the life of the permit,
removing approximately 25 cubic yards per event, which would be
disposed of at the town landfill, in the same manner as the
material dredged. in the first event. All dredged material would
be suitably retained so as to prevent reentry into any waterway.
The stated purpose of the proposed work is to provide adequate
mooring facilities and erosion prevention.

Pursuant to Section 7 of the Endangered Species Act (16
U.S.C. 15-31) and based upon a review of the latest published
version of the threatened and endangered species listing, a
preliminary determination is that the activity under
consideration will not affect those species listed or their
critical habitat.
Based upon a review of the properties listed or eligible for
listing in the latest available version of the National Register
of Historic Places, there appears to be no sites included in the
Register within the permit area. Presently unknown
archaeological, scientific, pre-historic or historical data may
be lost by work accomplished under the required permit..
Review of activities pursuant to Section 404 of the Clean
Water Act will include application of the guidelines promulgated
by the Administrator, U.S. Environmental Protection Agency, under
authority of Section 404 (b) of the Clean Water Act and the

WORK DESCRIPTION
The applicant, Narrow Rioter Marina/Fred Dacimo, has requested
Department .of the Army authorization to remove, restore and
construct .bulkheads, relocate an existing wave break and pier,
install finger floats and maintenance dredge with upland disposal
in .Hallock' s Bay, Gardiners Bay: at Orient, Town of Southold,
Suffolk County, New York.
The work would involve replacement, in-kind and in-place, of
approximately 133 linear`fee;t _of storm-damaged bulkhead, removal
of approximately.:84. linear feet of storm damaged bulkhead and
construction of approximately 34 feet of new bulkhead to be tied
in with the replacement bulkhead on the west side of the.::
property.. The .applicant proposes to relocate 30 feet of storm-
damaged wave break and relocate an existing floating pier 10 feet
to the north and extend ,it 2.0 feet to the west so as to tie in to
the new 34-foot bulkhead. The floats would be accessed by a
r.eplacemetn 3 foot .by 10 foot hinged walk ramp. , Six _2 1/2 foot
by 8 foot finger floats would be installed, 14 , storm damaged
pilings would be replaced and two rows of total of 24 pilings
would be relocated 10 feet to the north. The applicant also
proposes to excavate and subs..equently. dredge, with ten years
maintenance, the section .along :the 83 foot replacement bulkhead
and the rectangular .shaped :area .from which the bulkhead .would be
removed to a depth of 4 feet below mean low water, removing
approximately 150 cubic yards of material. Two: future dredging
events would be undertaken during the life of the permit,
.removing approximately 25 -cub.ic yards. per event,. which would be
disposed of at the town landfill, in the same manner as the
material dredged in the first event. All dredged material would
be suitably retained so as -to prevent reentry into any waterway.
The stated purpose .of the proposed work is to provide adequate
mooring facilities and erosion prevention.

the construction of a private single dock or jetty, then this

certified by - a registered land surveyor or professional-
engineer. The horizontal control of the survey shall be base(
upon an approval coordinate system. The vertical control fo1
elevation and soundings shall be based upon U.S. Coast anc'
Geodetic Survey an-Vor U.S. Geological Survey datum. For sucr,
projects, the Trustees may request a more detailed description of
the project site asdescribed in Article II, Section 97-27
Subdivision D.
F. Upon approval of this application, the Clerk to the Trustees
• shall issue the appropriate permit(s) to the applicant. Such
permits shall be available for inspection at any time upor
request. Trustee permit numbers must be displayed on all
structures in clearly visible characters 3 inches high.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a projet
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequen
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determin
significance may have little or no formal knowledge of the environment or may be technically expert in environment;
analysis. In addition, many who have knowledge in one particular area may not be aware.of the broader concerns affectir
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determinatio
process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a project or actior
