Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed in-place replacement of a bulkhead and return with sand fill and native vegetation is consistent with Policy 4.1 D(2) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. Directly behind the bulkhead is a nonturf buffer which will not work alone because wave action would continue the erosion. The proposed backfill of sand complies with Town Code Chapter §275-11 B(I), only clean sand can be used for backfilling in eroded and excavated areas, as well as behind new and repaired bulkheads The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Glenn Goldsmith,President a`Of SUr Town Hall Annex A.Nicholas Krupski,Vice President A%, ® 54375 Route 25 P.O.Box 1179 Eric Sepenoski 7I [ Southold,New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples ' ► ® Fax(631)765-6641 COUNt'1,t ` BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD This Section For Office Use Only j ( — - E lL7 E V E Coastal Erosion Permit Application I Wetland Permit Application Administrative Permit =N5 Amendment/Transfer/Exte sign Received Application: Received Fee: S I 5 Southold Town Completed Application: o Board of Trustees Incomplete: SEQRA Classification: Type I Type II Unlisted Negative Dec. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project proposes replacement of an existing timber bulkhead with vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with, and supported and protected from flooding and erosion bye a seawall since prior to 1954,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location.Without replacement and maintenance of the bulkhead, the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. The project will provide the ecological benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing, and the continued maintenance of the existing 7-ft wide non-turf buffer landward of the bulkhead. The project will thus effectively maintain the historically existing conditions along the bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated beach or tidal waters of Great Peconic Bay. vie ` 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. ❑Yes No ® Not Applicable Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III- Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria ❑Yes ❑ No ® Not Applicable Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project seeks to replace an existing timber bulkhead with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1954,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Thus, consistent with Policy 4,the project will continue to effectively protect against the potential loss of the adjacent upland and residential structures without causing significant change to or adverse impacts on the adjacent beach, tidal waters,or adjoining properties. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III -Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable To the extent that it is applicable, the project is consistent with Policy 5 because the project will replace a treated timber bulkhead with an untreated vinyl sheet bulkhead, and the existing 7-ft wide non-turf buffer landward of the bulkhead will continue to be maintained, thus enabling the area landward of the bulkhead to continue functioning as a sink and filter for potential runoff from the upland. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The project will effectively maintain the historically existing shoreline condition without any significant change to,or adverse impacts on the adjacent, unvegetated beach and tidal waters. But consistent with the Policy 6 goal of protecting and restoring the quality and function of Town of Southold ecosystems, the project will provide the ecological benefits associated with replacing a treated timber bulkhead with an untreated vinyl sheet bulkhead, and the existing 7-ft wide non-turf buffer landward of the bulkhead will continue to be maintained, thus enabling the area landward of the bulkhead to continue functioning as a sink and filter for potential runoff from the upland. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III - Policies Pages 32 through 34 for evaluation criteria. ❑ Yes ❑ No® Not Applicable Attach additional sheets if necessary Policy 8.
