The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective 6. Practical vegetative methods have been included in the project design and implementation. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed in-place replacement of seawall and bulkhead with sand fill and native vegetation is consistent with Policy 4.1 D(2) and 4.1 D(6) which states hard structural erosion protection measures can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because wave action would continue the erosion. The proposed backfill of sand complies with Town Code Chapter §275-11 B(I), only clean sand can be used for backfilling in eroded and excavated areas, as well as behind new and repaired bulkheads The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 f Glenn Goldsmith,President QF SOUNqTown Hall Annex A.Nicholas Krupski,Vice President ,`'C1 54375 Route 25 P.O.Box 1179 Eric Sepenoskif lt Southold,New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples 'ioll 0 Fax(631)765-6641 coUNTI' BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD This Section For Office Use Only Coastal Erosion Permit Application H —_ - Wetland Permit Application - --`' Administrative Permit Amendment/Transfer/Extensio Received Application: o EJU5 2026 Received Fee: $ Completed Application: I Southold Town Incomplete: Board of Trustees SEQRA Classification: Type I Type II Unlisted Negative Dec. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project proposes replacement of an existing concrete seawall with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with, and supported and protected from flooding and erosion by a seawall since prior to 1978,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon.Installation of a corrugated vinyl bulhead in place of the concrete seawall, which is prone to cracking and corrosion over time, will provide an effective long-term solution for flood and erosion protection. And the area landward of the bulkhead to be disturbed during construction will be restored with native plantings to maintain the landward embankment's role as a sink and filter for surface water runoff and potential contaminants contained therein. The project will thus effectively maintain the existing conditions along this bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated beach or tidal waters. r 617.20 Appendix B Short Environmental Assessment Form Instructions for Comnletin:r Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project seeks to replace an existing concrete seawall with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The site has been improved with and supported and protected from flooding and erosion by a seawall since prior to 1978,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Thus, consistent with Policy 4,the project will continue to effectively protect against the potential loss of the adjacent upland and residential structures without causing significant change to or adverse impacts on the adjacent beach, tidal waters,or adjoining properties. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III -Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable To the extent that it is applicable, the project is consistent with Policy 5 because the project will replace an aging concrete seawall with an untreated vinyl sheet bulkhead;the area landward of the bulkhead disturbed during construction will be restored with native plantings;and the covenanted 15-ft wide landscaped buffer along the top of the bank will be maintained, all enabling the natural area landward of the bulkhead to continue functioning as a sink and filter for potential runoff from the upland. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The project will effectively maintain the historically existing shoreline condition without of, a,'nificant change to,or adverse impacts on the adjacent, unvegetated beach and tidal waters.
