That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. A permit issued for work not including a demolition as per the definition in the Town Code, but subsequent to issuance,the work results in a demolition,the permit is voided and a new application must be submitted. 6. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 7. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 8. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 9. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 10. That the said Board will be notified by the Permittee of the completion of the work authorized. 11. We have been neighbors of Patricia Bogen and Mark Wiesenfeld since we moved into our newly constructed home in 2022. They were very welcoming to us, and we consider them to be good neighbors. Old Wood Path is a private road with a very special character. Patricia and Mark showed Lis their plans, and the proposed house fits nicely into the character of the neighborhood in both size and design. As the property is situated on wetlands, the plans also appear to further protect and preserve those wetlands. We completely support this project and have no objection to the Trustees approving it. I have been a resident of Old Wood Path for over 70 years. 1 have known Patricia and Mark since they moved next door over 25 years ago. When Patricia made a decision to move forward with this project, she came to me to let me know what she was planning to do. She was being a good neighbor as she and Mark have been over the years. I am very much in favor of her desire to improve her property by rebuilding a new house. We have an idyllic block with wonderful creek views. The enhancements on the property will help preserve the wetlands and surroundings for many years to come. WETLANDS PERMIT APPLICATION ADDENDUM(STATEMENT OF EFFECT) FOR PATRICIA BOGEN REVOCABLE TRUST 375 OLD WOOD PATH,SOUTHOLD,NY SCTM#1000-87-1-3.3 Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12, the proposed replacement of the existing dwelling and accessory garage with a new dwelling and attached garage would not adversely affect Town wetlands but should in fact have a net beneficial impact on the environmental condition of the property and adjacent tidal wetlands. Specifically, as a result of the below described design elements and incorporated mitigation measures, the project would result in increased flood and erosion protection for the dwelling and related structures;increased separation distance between the dwelling structures and wetland boundary;potentially reduced runoff and improved runoff quality; and improved groundwater and surface water quality,thereby consistent with, and furthering the LWRP Policy 4 goal of minimizing loss due to flooding and erosion, and the LWRP Policy 5 and 6 goals of protecting and improving water quality, and protecting and restoring the quality and function of Town of Southold ecosystems,respectively. A) Project Design(Shoreline Retreat) 1) The proposed dwelling and accessory garage will be removed and replaced with a new, landward- repositioned dwelling and attached garage. Specifically, the portion.of the existing dwelling situated closest to wetlands,the waterside deck, is located 69 feet from the wetland boundary, and the portion of the proposed dwelling structure situated nearest the wetlands,the waterside deck, is located 77 feet from the wetland boundary,thereby increasing the dwelling's compliance with the Town of Southold's required H wetland setbacks and bringing it into compliance with New York State's required wetland setback. 2) The existing dwelling to be removed is positioned seaward of the"pier line"established by the neighboring dwellings to the west and east, and as a result of its landward relocation, the new dwelling would be situated landward of the pier line,thereby bringing the dwelling structure into compliance with Town Code Section 275-11(A)(3). 3) The existing dwelling is also located within a FEMA-designated "shaded" Zone X flood zone, which pursuant to the recently adopted changes to New York State's Residential Code requires a minimum flood protection elevation 42 inches above the FEMA-mandated base flood elevation of the adjacent flood zone. The new dwelling has thus been relocated also to keep it outside the shaded Zone X,with the waterside deck, which is located partially within the shaded X zone, constructed as a free-standing, structurally independent structure. 4) The proposed dwelling is also compliant with all Town zoning requirements, including lot line setbacks, lot coverage,gross floor area(GFA), and sky plane restrictions. B) Mitigation Measures 1) The existing conventional, nonconforming septic system located less than 100 feet from the wetlands boundary would be replaced with a low-nitrogen, innovative/alternative sanitary system (1/A OWTS) located more than 100 feet from both wetlands. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. ❑ Yes FIN o® Not Applicable Attach additional sheets if necessary WORKING COAST POLICIES LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR PATRICIA BOGEN REVOCABLE TRUST 375 OLD WOOD PATH,SOUTHOLD,NY SCTM#1000-87-1-3.3 Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12, the proposed replacement of the existing dwelling and accessory garage with a new dwelling and attached garage would not adversely affect Town wetlands but should in fact have a net beneficial impact on the environmental condition of the property and adjacent tidal wetlands. Specifically, as a result of the below described design elements and incorporated mitigation measures, the project would result in increased flood and erosion protection for the dwelling and related structures;increased separation distance between the dwelling structures and wetland boundary;potentially reduced runoff and improved runoff quality; and improved groundwater and surface water quality,thereby consistent with, and furthering the LWRP Policy 4 goal of minimizing loss due to flooding and erosion, and the LWRP Policy 5 and 6 goals of protecting and improving water quality, and protecting and restoring the quality and function of Town of Southold ecosystems,respectively. A) Project Design(Shoreline Retreat) 1) The proposed dwelling and accessory garage will be removed and replaced with a new, landward- repositioned dwelling and attached garage. Specifically, the portion of the existing dwelling situated closest to wetlands,the waterside deck, is located 69 feet from the wetland boundary, and the portion of the proposed dwelling structure situated nearest the wetlands,the waterside deck, is located 77 feet from the wetland boundary,thereby increasing the dwelling's compliance with the Town of Southold's required wetland setbacks and bringing it into compliance with New York State's required wetland setback. 2) The existing dwelling to be removed is positioned seaward of the"pier line"established by the neighboring dwellings to the west and east, and as a result of its landward relocation, the new dwelling would be situated landward of the pier line,thereby bringing the dwelling structure into compliance with Town Code Section 275-11(A)(3). 3) The existing dwelling is also located within a FEMA-designated "shaded" Zone X flood zone, which pursuant to the recently adopted changes to New York State's Residential Code requires a minimum flood protection elevation 42 inches above the FEMA-mandated base flood elevation of the adjacent flood zone. The new dwelling has thus been relocated also to keep it outside the shaded Zone X, with the waterside deck, which is located partially within the shaded X zone, constructed as a free-standing, structurally independent structure. 4) The proposed dwelling is also compliant with all Town zoning requirements, including lot line setbacks, lot coverage,gross floor area(GFA),and sky plane restrictions. B) Mitigation Measures 1) The existing conventional, nonconforming septic system located less than 100 feet from the wetlands boundary would be replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located more than 100 feet from both wetlands. Unlike conventional septic systems, I/A OWTS sanitary systems are designed to significantly reduce nitrogen loading into the groundwater table. 2) A stormwater drainage system consisting of leaders, gutters, and drywells is proposed to collect and recharge roof runoff and backwash from the existing swimming pool to remain. 3) A 15-ft wide,vegetated non-turf buffer area is proposed to be established and perpetually maintained in place of existing maintained lawn area adjacent to the wetland boundary, reducing existing, potentially treated lawn areas,increasing setbacks from treated lawn areas to the wetlands,and creating a natural sink and filter for excess nutrients potentially contained in runoff before it can reach the wetlands and adjacent surface waters. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction.
