Minutes & Discussion Notes from Meeting held
Tuesday, June 23, 2026 at 7:00 p.m.
This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold
Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York.
The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did
not have access to a computer or smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected that
the Committee will enter into Executive Session*at some point after opening the Regular Meeting for the
purpose of discussing applications regarding proposed acquisitions of real property where publicity
would substantially affect the value thereof. The public is not allowed to attend, view, or listen to
Executive Session.

SCTM# 1000-108.-4-1.4— Easement Violation Remediation [Follow up from 10/28]
The Committee reviewed photos and notes from a June 22 site visit on the property to ascertain
the landowner's progress toward remediating easement violations, including the removal of
topsoil and the creation of a recreational pond on the easement area. The landowner evened out
the topography in the swale area and refilled the burn pits using excavated soil onsite. They also
removed the berm along the western boundary of the swale area and drilled through the clay to
create sand-filled wicks to reestablish drainage. The area still requires revegetation, and the
landowner's representatives proposed several cover crops to be planted by a neighboring
farmer. The Committee directed Lilly to update the Town Attorney's office, indicating that the
landowner has made good progress, is making a good faith effort to remediate the easement
violations. The Committee also directed Lilly to inform the landowner that remediation will be
considered complete when the swale area is revegetated and County Soil &Water confirm the
work performed on the property is consistent with its guidance.
Committee members also observed that the previous landowner appears to have removed a
significant amount of topsoil from the property, which limits the current landowner's ability to
restore the easement area. The Committee directed Lilly to inquire about the possibility of
additional enforcement in light of the significant negative impact on land subject to a Town
easement.
• Easement Monitoring & Enforcement
Lilly briefly discussed the draft Chapter 70 amendments related to easement enforcement, last
discussed in December 2024. The Committee members discussed the need for a meaningful
enforcement mechanism and requested that Lilly recirculate the draft for review and
advancement toward Code Committee.

Board that the Town commission an appraisal for Application Number 2026-3, for the purposes
of providing the market value of a development rights easement, in accordance with a design as
discussed by the Land Preservation Committee while in Executive Session,
