The following is the resolution as passed by the Board of
Town Trustees at a regular meeting held December 4, 1979. As this
matter was being presented by Dr. Samuels, the information was
forwarded to his office. '
RESOLVED that the application of Matt-A-Mar to dredge 6,620
cubic. yards to correct shoaling conditions in- slips and under
floats at private property at Mattituck Creek be approved subject
to receipt of a lette. from.-the-owner, with- signature notarized,
st-ating that he will not now or in the future further dredge the
area in front of the retaining wall which runs from the lift pit
to Wickham Avenue.
I do not personally have the authority to draft a letter for
you but would assume that 'it should include the wording in -the
resolution.

The following is the resolution passed by the Board of
Town Trustees at its regular meeting held December 4, 1979.
RESOLVED that the application of Matt-A-Mar to dredge
approximately 6,620 cubic yards to correct shoaling conditions in
slips and under floats at private property at Mattituck Creek be
approved subject to receipt of a letter from the owner, with the
signature notarized, stating that he will not. now or in the future
further dredge the area in front of the retaining wall which runs
from the lift pit to Wickham Avenue.
Your letter has been reviewed by.%the Trustees at the
January 2nd meeting and the Board does not feel that the wording
is strong enough. The permit will not be issued until the letter
is received with the proper wording.

Dear Chairman Kujawski and Members:
Our request is very simple. We feel it is more than time
that our ordinances, both wetland and building are strictly
adhered to. This has not been the case.
Variance after variance is granted, making our ordinances
totally ineffective, and a mockery. The concerns of 67
families are involved here, and while our efforts have been
futile in the past, we hope they will not be in the future.
Ordinance breakers must be made to undo deliberate violations.
This is the only way we can stop these practices in the
future.
We hope our position at the Trustee' s meeting on November 5th
regarding this will be seriously considered.
We are enclosing copies of pertinent correspondence to fill
you in on our past endeavors.

Dear. Mr. Benn:
Fbease refer .to my letters of August 21st, and October 17th, 1978
written to James Mansky to eliminate unecessary duplication.
We are now dealing with the final devastating onslaught of a once
beautiful, well treed, .low -lying peninsula, which is almost
entirely .bulkheaded, and will be soon.
The last remnant of wetlands and public beach are to be dredged to
backfill the already completed and waiting bulkhead, a practice
which has occurred on this entire peninsula, and always with the
approval of the Corps of Engineers. Just who and what do you truly
represent?? I want to know, since nothing is ever done about
problems of this nature.
AN ENVIRONMENTAL IMPACT STATELTINT .IS. MOST BEFINITELY REQUIRED.
The quality- of the entire creek hhs already been affected .by the
impact of so many boatowners dumping- .their wastes into the creek..
There is not one word of recommendation or praise for what �.is being
done. It is a very lucrative. business we are talking about. - with
a total disregard for the ultimate result on the creek, the; wildlife,
the marine biology, and last but ,riot 'least the wishes of the
surrounding families.
The water table has already beenrns)�,riously affected by the ..increase
in moorings, docking and boating: facilities, in a strictly .resi-
dential area. This area was illegally rezonedbusiness in 1966
with restrictions which the owner= never honored.
67 families have fought this continued destruction without success,
since our local government is far more concerned with business than
the feelings of the individual, or. the complete destruction and .
further pollution of what once was. a pure and lovely creek::
I am enclosing two articles from the Suffolk Times last Thursday
which might interest you, and support our position. Perhaps you
will be more responsive than James Mansky.

Dear Sir:
As a member of the Mattituck Creek Watchdogs , I attended`:the
Trustee 's meeting on November 5th regarding Matt-a-Mar Marina' s
application for dredging. I am especially concerned because I
live directly across the street from this Marina.
The very first item on the agenda was a "surprise" request by
Dr. . Thomas E. Samuels for an additional depth of 2 ft. of
dredging because he "MADE AN ERRORI' ' in his original request.
This was not what he requested in his application to you. The .
exact amount of' additional fill will have to be determined by
you. I figure it to be double 6,, 600 cu :Pds. This was challenged
by our group, and the permit was not granted at this time.
I was already deeply concerned with the ultimate effect on the .
water table and the quality of the drinking water. This additional
fill request makes it even more important. F116ase refer to the
copy of enclosed letter I received from the County of Suffolk in
connection with my water sample. We have very recently put in a
new well. And relocated the well 75 feet from the contaminated
one,to-�a deepth of 18 feet. 'Re have to use surface water in our
area, otherwise the water is --brown in color, foul in smell and
totally unfit to drink. Other residents in this area have also
had problems with their wells.
An enviromental impact study is necessary, especially in view
of the request for considerably more filly Your attention to
this vital and serious matter would be appreciated.

Dear Mrs. Harvey:
Analysis of water samples collected from your home on June 6 , 1979
and June 13 , 1979 have been completed .
Results indicate that at the time of collection , the manganese and
MBAS (detergents) were in excess of recommended standards as was
the bacteriological analysis.
MBAS and elevated free ammonia indicate that cesspool waste is
reaching your well. Manganese is not considered harmful to health
but will cause off tastes , staining, and discoloration.
In addition , the chloride and sodium levels were elevated . Sodium
in these concentrations may prove harmful to persons on restricted
diets due to heart or kidney ailments.
The bacteriological problem should be corrected immediately using
the attached directions. However, only relocation and/or deepening
the well will correct the cesspool problem. Until these problems
are remedied , this office recommends the use of an approved
bottled water supply for potable uses.
Should you have any questions , please feel free to contact this
office.

the present owner began his dredging and filling operations.
The only erosion, is the inevitable washout of his spol1
areas . if he would leave the vegetation undisturbed, there
would be no further erosion.
The shoreline involved, is part. of ourvital .wetlandsl How,
much shoreline can -,re afford to lose? Horn havi3. r�oi°oitnso
much of our wetlands? Have they not been lost "A LITTLE AT
u TIME?" In each case, has it not been said the loss is

we dedicated to the preservation of this vital resource , or

Dear Nr. Gustafson:
The printing of the short, incomplete article in the
last edition of the paper was extremely unfortunate at best ;
The upland retaining wall, which is the focus of the cor_tro--
versy, Baas constructed to retain dredged material on th.e
upland, thereby preventing damage to the .marsh fringe between
the wall and the water in the creek. It is a very light marine `
structure with penetration into the sub surface four feet at `
ma)Mum. The marsh fringe will protect this wall from toe
scour. Indeed, if the marsh were to be removed by natural €
means, or man-made means, the wall would fail totally.
The three agencies (Corps of Engineers, N.Y.S.D.E.C. t
and Southold Town Trustees) involved in waterfront construction
normally require that dredge material be retained in some
manner so that it cannot re-enter the waterway. '?'he above
agencies and all the environmentalists who have been contacted
agree that this wall is environmentally sound, and indeed nee--
essary to protect the wetlands.
The residents in the immediate area have legitimate concerns
about the development of this marina. Their views must be r
considered, aad I believe the agencies have done so and will
continue to do so. The owner also has needs and rights.
Marinas are necessary in Southold Toi.tn and this fact is aopar-
eat from N,Y.S. Coastal Zone TTanag emen-t rules and regulations
to Town government rules and regulations. Within this frar-s- I
work, the marina will be sensibly developed.
I believe that the printing of the aforementioned article
in the last edition did not make the slightest attempt to

A detailed description and plans of the proposed work are inclosed to
assist in your review of the proposal.
The decision whether to issue a permit will be based on an evaluation
of the probable impact of, the proposed activity on the public interest.
That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposed work must be balanced against its'
reasonably foreseeable, detriments. All factors which may be relevant to
the proposed work will be considered; among those are conservation, eco-
nomics, aesthetics, general environmental concerns, historic values,
fish and wildlife values,. flood damage prevention, land use, navigation,
recreation, water supply, water quality, energy needs, safety, food pro-
duction and, in general , the needs and welfare of the, people.

A preliminary review of the application indicates that an Environmental.
Impact Statement will .not be prepared. A review of the latest publish=
ed version of the National Register of Historic Places and of the prey,
Bence or absence of registered properties or properties listed in the
latest published version of the Register as ,being eligible for. inclu-
sion, therein, has been made. Presently unknown archeological; sc en-
tific, prehistorical or historical data may be lost or destroyed by
work to be accomplished under the required permit.
The following government authorizations have been obtained or will be
obtained prior to the issuance of a Department of the Army permit-:
.Permit from the New York State Department of Environmental
Conservation.
Any criticisms or protests regarding the- proposed work should .be
PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE prior to
18 November 1979 otherwise it will be presumed that there are no- ob-
jections.
It is requested that you communicate the foregoing information con-
cerning the proposed work to any persons known by you to be inter-

DESCRIPTION OF WORK
It „is proposed to maintenance dredge in the existing marina in the area
shown on the attached drawing. Dredging will be conducted to a maximum
depth. of 4 feet below mean low water. Approximately 6600 cubic yards: of
sand will be.removed initially. It is anticipated that additional dredging
will be required .one more .time within the life of the permit,. ,10,.years, if
issued. All dredged material will be placed on an upland, non-wetland site
where' ft will be suitably retained to prevent its return to the waterway.
The purpose of this work- is to remove the shoal areas beneath the floats and
in the slip.

The Southold Town Baymen's Association, at its last meeting,
discussed the permit issued to Matt-A-Mar by the Army Corps
of Engineers. The terms of this permit issued gives the applicant
the right to bulkhead all of his remaining property. The Town
Trustees prevailed upon the owner to reduce his project by 507
or they would be placed in the unpleasant position of rejecting
his application in its entirety.

Gentlemen:
It has come to our attention that the Mat-A-Mar Marina
has engaged in certain dredging operations and in certain pile driving
operations at the southerly end of Mattituck Inlet for which it has
neither a permit from the Board of Trustees of the Town of Southold,
nor does it have a permit from the Corps of Engineers, U. S.' Army
and Department of Environmental Conservation of the State of New
York.
The above association demands that the Board of Trustees
take immediate action to stop any further activities in this respect.
Enclosed herein please find copy of a letter sent this day to the Town
Attorney of Southold Town, indicating legal reasons why any additional
expansion of the Mat-A-Mar Marina must be halted or must be
brought before the Board of Trustees for a public hearing before
any construction takes place.
The Mattituck Inlet Watch Dogs Association believes
that the Board of Trustees has failed to live up to its responsibility
in that we are advised that certain construction has taken place
below the mean high water mark at the Mat-A-Mar Marine and that
such construction escaped the notice of the Board of Trustees.

Dear Mr. Tasker:
I examined the Trustees file of the Mat-A-Mar Marina
and was quite surprised to discover that their application for bulkhead-
ing and pile driving is dated June 6, 1966. No new application for
additional work has yet been made to the Board of Trustees. It is
significant, however, that Mat-A-Mar has made application to the
Corpsof Engineers and with the Department of Environmental Con-
servation. This action by Mat-A-Mar indicates that Mat-A-Mar is
aware of the fact that considerable changes have taken place in the
last twelve years.
It is these changes which mandate a reapplication
to the Board of Trustees. As you well know, the equitable doctrine
of latches clearly applies in this matter and evidence that it clearly
applies is provided by the action of Mat-A-Mar in securing new
approval by the Corps of Engineers and by the Department of En-
vironmental Conservation.
I believe that there are at least two salient legal
reasons why Mat-A-Mar must apply for a new permit prior to the
commencement of any additions or extensions;
a. The original permit dated June 6, 1966 was issued
improperly and contrary to law.
b. In the event that the said grant proves to have been
legal and properly issued, then and in that event the equitable doctrine
of latches applies. Mat-A-Mar has delayed twelve years in implement
ing its previous Board of Trustees permit. Significant changes having
occurred during the previous twelve years, Mat-A-Mar would now be
estopped from proceeding without a new permit and a new public hearing.

I believe that a Court of Law that is approached for
equitable relief will balance the detriment occurring to a large group
more heavily than it will weigh the benefit derived by a single
individual. It is my belief that if this question were submitted on
an equitable basis, the Supreme Court would require a new filing by
Mat-A-Mar and new public hearings. Twelve year delay is clearly
excessive.
I defer to your superior knowledge in matters of
Town Law since you are far more knowledgeable in this sphere than
I am. I would appreciate your thoughts on the subject.

INSTRUCTIONS PERTINENT TO THE FILING OF AN APPLICATION
1. All applicants should read and become familiar with the Town Ordinances which govern the
use of WETLANDS or PUBLIC LANDS OF THE TOWN. Extracts and complete Ordinances are
available from ther Secretary of this Board or from the Town Clerk's Office.
2. A completed application will normally require a SINGLE COPY of each of the following items:
(a) An application FORM A/1, A/2, A/3, A/4, or A/5) with all 'rhe questions answered.
(b) An Area Map to show location of project. (supplied by Secretary).
(c) A Licensed Engineer's Survey of the property involved.
(d) A copy of the Contractor's Plans & Specifications. This may be supplied after approval
of the application but a Permit will not be issued until the Secretary of this Board receives this item.
(e) An applicant's diagram drawn to SCALE or the reverse side of the Area Map, showing
the size, shape, and overall dimensions of the structure or work as well as its relation to Ordinary
High Water Mark.
3. A completed application must be filed with the Secretary of this Board, before it can be reviewed
by the Board at the earliest meeting after its date of filing.
4. In complicated cases, or at the request ofthe Secretary, it may be necessary for the applicant
to present the completed application in person in order to supply additional or more complete in-
formation than the Forms provide for.
5. After review by the Board, the applicant will be notified of the action taken, and if approved,
such notice will also include the amount of the Fee required for the issuance of the Permit.
6. The following schedule of charges will apply:
(a) A minimum fee of $5.00 will be charged against all applications
amj!This fee is payable at time of filing and is not returnable regardless of action taken.
(b) Fee for Mooring (Form A/D — at the rate of $1.00 per piling, stake, or other anchor-
ing device.
(c) Fee for Docks (Form A/2) — at the rate of 10c per Sq. Ft. of dock surface offshore of
Ordinary High Water Mark plus $1.00 per piling used to secure a. float or boat.
(d) Fee for Bulkheads (Form A/3) — at the rare of $1.00 per lineal foot of construction
offshore of Ordinary High Water Mark.
(e) Fee for Dredging/Filling (Form A/4) — at the rate of 10c per cu. yd. based on the
estimated maximum from computing the application.
(f) Fees for Special Purposes (Form A/5') — at a rate depending on the type of work.
7. The Permit Fee, made payable to the Board of Southold Town Trustees, must be paid either in
person or by mail prior to the issuance of the Permit. IF PAID IN PERSON, THE PERMIT IS OB-
TAINABLE AT THE TIME PAYMENT IS :MADE.
8. NOI IFICATION OF APPROVAL of an application is NOT a PERMIT.
9. A Permit is usually issued for a period of construction to cover 12 mos., but may be for a shorter
or a longer period of time as the case may warrant. The Permit should be retained, however, for as
long as the construction will be maintained, as a proof of original authorization.
10. A Permit may be extended by request to the Board, or it may be revoked by subsequent revolu-
tion of the Board.

No person shall place any piles, stakes, buoys, piers,
docks, bulkheads or other objects in or on any town waters or
public lands under or adjacent to town waters in the Town of
Southold, nor shall any person remove any sand, gravel or other

Dear Mr. Bitses:
Receipt is acknowledged of your letter of July 14, 1978.
I have reviewed the file in this matter and I find that the Trustees issued a per-
mit to Mat -A-Mar in 1966 which contained .no limitation as to time when the work
was to be accomplished. The provisions of the Southold own Code by which the
Trustees issue permits likewise contains no provisQz a to..li,mi motion of time in
a permit issued by the Trustees." In view_of the .foregoing, it is my opinion that
the permit is still in effect.
In your letter you state that the 1966 permit was issued "improperly and contrary
to law". However, you did not indicate what the impropriety was nor did you set
forth the provisions of law which were violated by the issuance of the permit.
It is my understanding that Mat-A-Mar has applied to the DEC and the Corps of
Engineers for permits. It would seem to me that you should present whatever
arguments you may have for the denial of the permits to these agencies.

Gentlemen:
Please be advised that we have in our file a Permit No. 356, from
the Town Trustees, to bulkhead dredge and build floating docks, all
in accordance with a revised plan submitted in 1966.
This plan showed a launching pit located on the eastern end of Peter's
Creek, on the south side of my property. It is our intention to con-
struct this launching pit westerly of the location shown on the "revised"
plan so as not to interfere with the, tidal wetlands. The proposed new
location is reflected on a plan which is enclosed herewith and said pit
would not be in the tidal wetlands area.
We have a permit from the Army Corps of Engineers, dated Decem-
ber 6, 1978, as well as a permit from the New York State Depart-
ment of Environmental Conservation, dated 717,178, both copies of
which we are enclosing herewith for your records.
Our reason for writing is to advise you gentlemen of the change so that
if any questions did arise during construction, your office would be
knowledgeable to what was going on.
Kindly confirm receipt of this letter to our office for our records.

A copy of the plans of the proposed work is shown on the reverse of
this sheet. The applicant proposes to construct a timber sheet pile bulkhead
1,610 .feet long, with a top elevation of 2Z feet above the plane of mean high
water. The area just offshore of the proposed bulkhead will be dredged to a
depth of 7 feet below mean loin water, with the dredged material, approximately
20,000 cubic yards, being placed behind the bulkhead. It is also proposed to
install a float extending 80 feet offshore of the bullhead. It is further
proposed to install mooring piles along a line, parallel to, and 25 feet off-
shore of the proposed bulkhead. The tops of .all piles to be installed will
be 6 feet above the plane of mean high water.
The decision as to whether or not a permit will be issued must rest
primarily upon the effect of the proposed work on navigation, giving con-
sideration, however, to such other factors as may affect the public interest
