Y. 11971 Dear Mr. Smith: I am writing this letter to summarize a dangerous situation with respect to the operation of boats in and around the federal anchorage. As you know, the arrival of the summer season brings with it a vast increase in the number of boats using the federal anchorage. In the past there have been confrontations between Matt-A-Mar and private boaters not registered at the Marina. I refer to the article in Suffolk Life (1983) and the complaint received by the Chamber of Commerce during the same year. It is these situa- tions which I hope may be alleviated in the near future. In the past, the Marina has hired a full time watchman to prevent and control boaters entering the Marina. It is not that the Marina wants to preclude operators of dingies from entering the Marina, but rather it is out of necessity as there is no place to tie up dingies. If the Marina were to let...'the boaters tie up the dingies at random, a hazardous and dangerous situation could arise for other boaters. If there were adequate facilities for these dingies, the above situation could be alleviated. It is with this in mind that the Marina requested permis- sion to build a floating dock. As you know, building a floating dock is expensive both in the actual construction and future maintenance. It is not an undertaking primarily geared to generate income, but rather to provide safety for boaters by decreasing the chance of accident. The docks, which are remov- able, would have no environmental impact as there would be no facilities on them (water, electricity, gas,. etc.) . They would simply be .used for tieing up small boats during the summer season. At the end of the summer season, the docks would be removed and stored. Y. 11790 Re : Matt-A-Mar Application #TW-S72-0l01-CPW-WQ Dear Judge Irving: At the regular monthly meeting of the Southold Board of Town Trustees, they unanimously directed me to write you concerning the above application. The Board feels that this expansion of the existing marina would not be in the best interests of the people they represent for the following reasons : 1. Expansion usually means more boats and this usually means more pollution. The marina is situated far from the mouth of the creek and therefore receives practically no tidal flushing. The DEC, in the past, has closed this area to shellfishing because of pollution. 2 . There are strong objections by local residents against this expansion. They have come before this Board in protest of, previous expansions and again this month to voice their objection to this latest expansion. 3. The marina changed hands a few years ago and it is the con- census of this Board that the owners knew well what they were buying: 4. Navigation in town waters is one of the main concerns of this Board and the expansion would, create additional congestion to an already overcrowded anchorage during our busy summer months. Mattituck Inlet, in which Matt-A-Mar Marina is located, is the only harbor on the North Shore between Port Jefferson and Greenport, It is a very heavily used area. 5. Residents on the opposite shore have complained to this Board that the additional traffic created by this expansion would add to their already severe problem of erosion from boat Ia'ra 2 Please consider our concerns when making your decision. As you will see, I have suggested to him that this application must be denied if we are to preserve the environ- ment. The Marina which has reportedly exceeded its last exception , continues to build -- drawing even more boats whose owners discard debris overboard. More important is the traffic and speed at which they travel. The erosion of land has been accelera ed enormously -- even in the last ! ; three years ! Every expansion he does is to the detriment of the environment, the wetlands, the water, and not in keeping; with the general character of the are�� which is residential . V,e are in complete accord with the present Southold Town Board of Trustees in their letter to you of January 7th, 1982 , regard- ing their rejection of this, yet another application for further expansion. ;hen is this going to stop?`' and where?? The owner has been granted one permit after the other, with a. total disregard for the disapproval of the many residential families who surround him. He has totally wiped out the beauti- ful pristine beaches which one surrounded this peninsula, and a are irretrievably lost, by bulkheading and backfilling the wet lands and beaches, adding approximately 20, 000 additional feet to his real estate, which truly belong to the people of the To,-:.-n of Southold. He- has dredged the creek ?11 around, to backfill up to these bulkheads, disturbing the i-.:a.ter table which at this location is only 1P , ft. deep, and destroying the marine biology. as well . Residents are having problems with their_ water for the very first time . All checking is done AFTER THE FACT, and the things he does are very hard to prove once they are done and he knows it . Just who is checking to see how deep he goes, or what he :is doing until it is all comuleted? He always takes more than he should, some- times without the required permit . I am enclosing a sketch which while crude, should clearly indicate the devastating affect this facility has on our creek and area. It is like a creeping cancer, taking over the creek in all directions. There was a Gentleman' s Agreement made that it would remain a very small, limited, unobstrusive business if this group would "BACK OFF. " ?Tnfort::unately there was nothing in writing ( A VERY FOOLISH AND COSTLY MISTAKE ) and obviously the new owner never intendedto comply with this verbal agreement. We constantly hearthat one cannot stop a man from "MAINTAINING HIS .BUSINESS, " but I would like to remind everyone concerned that THERE NEVER SHOULD HAVE BEEN A_ BUSII,;ESS HERE FOR ANY REASOE 'V.FHAT- SOEVER, IN A STRICTLY RESIDHNTIAL AREA-ILLEGALLY REZONED. The individual who owns this property does not live in this area, which is obvious in his lack of concern for his neighbors . The Board feels that this expansion of the existing marina would not be in the best interests of the people they represent for the following reasons : 1. Expansion usually means more boats and this usually means more pollution. The marina is situated far from the mouth of the creek and therefore receives practically no tidal flushing. The DEC, in the past, has closed this area to shellfishing because of pollution. - 2. There are strong objections by local residents against this expansion. They have come before this Board in protest of previous expansions and again this month to voice their objection to this latest expansion. 3. The marina changed hands a few years ago and it is the con- census of this Board that the owners knew well what they were buying. 4. Navigation in town waters is one of the main concerns of this Board and the expansion would create additional congestion to an already overcrowded anchorage during our busy summer months. Mattituck Inlet, in which Matt-A-Mar Marina is located, is the only harbor on the North Shore between Port 'Jefferson and Greenport, It: is a very heavily used area. 5. Residents on the opposite shore have complained to this Board that the additional traffic created by this expansion would add to their already severe problem of erosion from boat wake z along their shore. 2 I�lease consider our concerns when making your decision. Before this area was dredged there was a long piece of land extending out toward the south. It was agreed upon by Alvah Goldsmith(the then president of the Board of Trustees ) and myself, that if I dredged this unusual piece of land. and made a ninety degree turn in the bulkhead at that point , as per Army Corps of Engineers Permit # 1507-24 dated 15 February 1965 , I could put in an extra dock at that spot. This was approved by the entire Board of Trustees as is evidenced by permit # 356 which gives the entire number of feet of floating dock and for which a fee of $1265 was paid. The following changes are proposed: 1. remove 16 mooring piles 2. change from approved (14) 24'x30" finger piers each with pile on end to (11) 27'x48" finger piers each with pile on end: 3. width of' bays will be thus changed from 25' to 30' . 4. eliminate 3' wide "bib". Due to change (4) , overall length will not change. The work will reduce the capacity of facilities on north side of marina from 28 to 23 boats but each boat will have more room to maneuver. It has also been found that 30" wide piers are too narrow and are not safe. It is hoped that the above modifications can be handled by means of a letter from you so that they may be in place by the upcoming season. The changes are quite minor and will actually result in a reduction in boat capacity. In addition to the above, general repairs to piers and piles damaged and lifted by ice will be conducted prior to the boating season. Requests to other regulatory agencies have also been made.
