The Southold Town Planning Board, as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared. Name of Action: Proposed site plan for Matt-A-Mar Marina SCTM#: 1000-114-3-1 Location: Wickham Ave.; Mattituck SEAR Status: Type I ( ) Unlisted ( X ) Conditioned Negative Declaration: Yes ( ) No ( X ) Description of Action: This proposed site plan is for the construction of a 715 square foot storage building. Page 2 SEQR Negative Declaration-Matt-A-Mar Marina April 6, 1998 Reasons Supporting This Determination: This project involves the construction of a 715 square foot storage building in Mattituck. A storage building is a permitted use in this Marine II (MII) zone, thus the proposed action is consistent as planned An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. There has not been any correspondence received from the New York State Department of Environmental Conservation in the allotted time. Therefore, it is assumed that there are no comments or objections from that agency. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply r and sewage disposal systems. Design and flow specification, subsurface soil conditions and site plan details will have to be approved by the Suffolk County Department of Health Services (SCDHS). This impact is not considered significant due to the anticipated project compliance with established requirements of the SCSC and the SCDHS and the required relevant permits. Box 1235 Mattituck, NY 11952 Re: SCTM # 114-3-1 Dear Mr., Cocks: The following action was taken by the Board of Town Trustees during its regular meeting held on September 28, 1995 regarding the above matter: WHEREAS, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated September 8, 1995, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 28, 1995, at which time all interested persons. were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code; WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of to construct chain link fence around property, approximately 350' of fence along retaining wall with berm (swale system) in front to contain runoff from parking area and building. Permit to construct project will expire two years from the date it is signed if not started. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. This could trap floatable debris and cause suffocation of the marsh vegetation. The possible loss of wetland vegetation is not consistent with' the intent of the Tidal Wetland Regulation (6NYCRR Part 661. 9 (b) (1) (i) . Therefore, the Department must object to the portion of the fence that extends into the wetland marsh vegetation to the mean high water mark. As stated in my April 26, 1995 letter to you, an approvable alternative would be to end the fence landward of the tidal wetland boundary and then tie into. the existing bulkhead to the west as originally—depicted-on the submitted survey. The following are our findings and recommendations. Department staff believe that if the fence is installed to the mean low water, it will trap debris and act like a groin causing material to build up along the fence and destroy marsh vegetation. The loss of marsh vegetation will lead to the destabilization of the bank and a loss of erosion control. We therefore must object to the portion of the fence that extends to mean low water, as the possible loss of wetland vegetation is not consistent with the intent of the Tidal Wetland Regulation (6NYCRR Part 661.9 (b) (1) (i) ) .
