I. INTRODUCTION
Zoning Board of Appeals
Tasker Management LLC (the,"Applicant"), herein applies for a waiver of merger for
property located at 155 Tallwood Lane, Mattituck NY (SCTM No. 1000-113-7-13) (the
"Premises"). The Applicant received the attached Notice of Disapproval, dated January 13, 2026,
attached herein as Exhibit A, indicating that the subject lot has merged with the adjacent parcel
(SCTM No. 1000-113-7-14). Accordingly, the Applicant applies herein to the Zoning Board of
Appeals. The Applicant entity has two members, a husband and wife (Pietro Piacquadio and
Jacqueline Piacquadio (a/k/a Jacqueline Kassman)); the property has passed through Ms.
Piacquadio's family since 1960.
II. STATEMENT OF FACTS
The subject 12,500 sq ft/0.287 acre lot is located in the Residential R-40 District and fronts
on the private right of way (Tallwood Lane) to the north. It is surrounded on the east, west, and
south by residential properties. The parcel to the east,the adjacent lot in question,is improved with
a single-family residence, and has been since approximately 1961. The subject parcel is improved
with an existing dilapidated and out-of-use barn structure previously used for storage of
landscaping equipment by the Applicant's uncle, Michael Neuduck, for his business.
As shown in the provided single and separate search conducted by Fidelity National Title
(attached herein as Exhibit B),the subject parcel was purchased by Ms.Piacquado's grandparents,
Phillip and Lucy Neudeck in 1960 from William and Anne Chudiak. At the same time, they
purchased via separate deed, the neighboring property, again from William and Anne Chudiak.
Phillip passed away in 1973 and ownership to both lots was held by Lucy Neudeck as surviving
tenant. Per Town of Southold Town Code §280-10,the subject lot merged with Lot 14 in the short
period of time between July 1, 1983 and April 9, 1984, when Lucy transferred Lot 14 into co-
ownership with her son, Michael Neudeck. The subject parcel was later transferred to Michael
Neudeck and Robert Neudeck in 2003, shortly before Lucy passed away.
III. NATURE OF RELIEF REQUESTED
The Applicant requests a waiver of merger,per Town Code §280-11, in order to recognize
the original lot lines for the subject parcel.
IV. STANDARDS FOR THE GRANT OF WAIVER OF MERGER
Pursuant to Town of Southold Town Code §280-11 (A),the following must be true:
a) The lot proposed to be recognized has not been transferred to an unrelated
person or entity since the time the merger was effected [sp].
The following standards must be balanced,per §280-11 (B):
(1) The proposed waiver would recognize a lot that is comparable in size to a
majority of the improved lots in the neighborhood;

These standards are addressed as follows:
a) The lot proposed to be recognized has not been transferred to an unrelated person
or entily since the time the trier er was effectuated in 1983.
Following the transfer of the property to Michael and Robert Neudeck,the subject property
was transferred to Michael's Landscaping Construction, LLC, an entity with Michael Neudeck as
the sole member. The property was then transferred to Jacqueline Kassman (a/k/a Jacqueline
Piacquado), with a number of liens on the property and an existing mortgage. Subsequently,
Michael Neudeck, who had taken sole ownership of Lot 14 in 2004, was foreclosed upon for the
appurtenant mortgage. Ms. Piacquado allowed the subject lot's mortgage to be foreclosed upon so
that she and her husband could take ownership of the property as Tasker Management LLC,
following an auction. At no time has the property been transferred to an unrelated person or entity
for ownership since 1983, and has passed between Lucy Neudeck, Michael Neudeck and
Jacqueline Kassman(Michael's niece), in that timeframe.
(b)(1) The ro osed waiver would recognize a lot that is comparable in size to a
maiority of the improved lots in the neighborhood.
A number of nearby lots are of comparable size to the subject lot. Specifically, a number
of lots located across the street on Meday Avenue and Illinois Avenue are similarly sized. Included
herein (as Exhibit C is an annotated tax map listing the square footage of nearby lots of
approximately the same size as the subject parcel.
(b)(2) The lot proposed to be recognized is vacant and has historical! been treated
and maintained as a separate and independent residential lot since the date of its original
creation.
The subject lot, although not vacant, has been historically treated and maintained as a
separate lot since its creation in 1924. As shown in the single and separate search included as part
of the application, the subject property was transferred independently of the adjacent lot (and at
different times in the history of the two lots)until it came into the Neudeck family's ownership in
1960. Since the creation of the two lots, the lots have each always had a separate tax lot
designation.Both lots have been assigned different mailing addresses and have historically utilized
separate mailing addresses.Additionally,the lot has been separately assessed for taxation purposes
since its inception, separate and apart from the neighboring parcel. The Applicant is currently
paying the taxes for the lot as a single and separate, individual lot. The subject lot has an
independent utility easement for the installation of underground or overground utility lines,further
demonstrating its independence from the surrounding properties and the intent for the property to
operate separately from any surrounding uses, regardless of ownership (see attached Exhibit D
for the utility easement related to the property).

The subject lot has always maintained a separate means of ingress and egress from the
adjacent property and a fence has always separated the two lots. There is no means of accessing
one from the other without walking around the fence that runs along Tallwood Lane. The existing
improvement on the subject lot is permitted under current zoning, per Town Code § 280-17, as a
standalone use (i.e. barn, storage structure) without the need to be designated as accessory to a
residential dwelling and the subject lot operated as a storage space for the landscaping business
for the past 30 years, up until Mr.Neudeck's passing.

(b)(3) The proposed waiver and recognition will not create an adverse impact on the
h sical or environmental conditions in the neighborhood or district.
As noted, the subject lot has operated independently from the adjacent lot throughout its
existence. The Applicant, after resecuring ownership of the property following the foreclosure
proceedings, applied to construct a single-family dwelling on the subject property. There is space
on the subject property for a dwelling and the additional density of a new single-family dwelling
in the area will not change the character of the surrounding neighborhood, nor will it have an
adverse impact on the physical and environmental conditions of the neighborhood. The other
adjacent properties are heavily wooded and are either vacant or the existing improvements are
located so far from the proposed development on the subject lot that any impact is negligible, if
not non-existent. The approval of the waiver will allow the Applicant to make desirable use of
their property, commensurate with the value at which it has been assessed and in line with the
Applicant's expectations upon purchasing the property.

proposed use is commensurate with the existing R-40 zoning for the property and the surrounding
neighborhood. The proposed improvements are appropriately designed for the size of the lot and
the character and size of the surrounding dwellings as well.
V. CONCLUSION
The Applicant has expended significant time and financial resources already in their efforts
to develop the subject property. At the request of the Town of Southold, they had three separate
title searches completed for the single and separate determination, two of which were conducted
in 2025 alone. Plans have been prepared and the costs even to secure an approval for a proposal
for development of this property have been onerous. This has been a significant and consuming
undertaking for the Applicant and the approval of this waiver will provide the Applicant with what
they need to move forward with this property.
As demonstrated, the benefit to the Applicant outweighs any potential detriment to the
general health, safety, and welfare of the neighborhood and the Town as a whole. Based upon the
foregoing,we respectfully request that the subject parcel be recognized as a single and separate lot
and approve the waiver of merger.

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without

SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk
County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject rectangular-shaped, 12,500 square feet,.287 acre,parcel located
in the R-40 Zoning District measures 125.00 feet along a private right of way known as Tall Wood Lane,then runs
100.00 feet south, along a residentially developed parcel to the west, then runs 125.00 feet east along a vacant
residential lot and returns 100.00 feet north along a residentially developed lot to the east. The lot is developed with
a dilapidated barn with attached shed and a roofed over open area as shown on the survey prepared by Angelo Joseph
Cecere,Licensed Land Surveyor and dated January 11,2024.
BA 1S OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; Article XXXVI, Section
280-207; and the Building Inspector's August 16,2024, Amended September 3, 2024 Notice of Disapproval based
on an application for a permit to demolish an existing accessory structure and to construct a new single family
dwelling, an accessory garage and an accessory in-ground swimming pool; at 1) more than the code permitted
maximum lot coverage of 20%; 2)gross floor area exceeding permitted maximum square footage for lot containing
up to 20,000 square feet in area; located at: 155 Tall Wood Lane,Mattituck,NY. SCTM No. 1000-113-7-13.
RELIEF REQUESTED: The applicant requests variances for the demolition of a legally existing barn structure and
to construct a new, one-family dwelling, in its place,with an accessory 20 feet by 20 feet(418.33 square feet area)
garage and an inground swimming pool;measuring 20 feet by 40 feet, with a Gross Floor Area(GFA) of 2,824.56
square feet where the code limits such development to a maximum GFA of 2,412.50 square feet based on the
applicant's lot size. Additionally, the applicant also seeks relief for 22.82% lot coverage where a maximum lot
coverage of 20% is permitted by code.

AMENDED AP IC�TIO I During the hearing,the applicant was asked to bring the plan into more conformity
with the code. The applicant on February 14, 2025 submitted ar�a i�tilgew architectural plans
labeled T-1, A-1 through A-5 prepared by prepared by Emilio S Asa, 'eg�stdred Arc �tect dated February 13,
2025. These plans include general notes, site plan,foundation and floor plans, exterior elevations and sky plane
analysis,removing the trellis/pergola amenity and thereby reducing the lot coverage to 19.93%where a maximum
of 20% i.s permitted. This amendment removed the need for one of the two prior variances requested.
Additionally,the applicant amended the design of the residence and reduced the overall GFA from 2,824.56 square
feet to the `average' based on their research,as submitted,to 2,732.09 square feet where a maximum of 2,412.50
square feet is permitted for a lot of 12,500 square feet. The applicant in this amended application seeks one
variance for the excessive Gross Floor Area, an overage of 319.59 square feet. This plan brings the application into
more conformity with the code.
ADDITIONAL NA-INFORMATION.' Prior ZBA relief was denied for this lot under file#1860 on November 20, 1973,
whereby the applicant sought relief to construct a new dwelling with insufficient lot width and area accessed via an
unapproved right of way.
The legally existing `barn' structure is covered by Certificate of Occupancy#23641 and additions to the barn under
Certificate of Occupancy#22436 dated October 12,2016.
The applicant provided the ZBA with architectural plans labeled T-1, A-1 through A-5 prepared by Emilio Sousa,
Registered Architect dated August 20,2024,updated on February 13,2025 to reflect the amended application.
Having no residential development on this lot of any kind(only a dilapidated barn structure),the property is viewed
to be undeveloped. When asked why the applicant could not conform to the R40 Zoning District code,, specifically
relative to designing a residence that would conform to lot coverage and GFA, the applicant indicated that the
property owner wanted a home suitable for their personal needs which included a residence that exceeds the allowable
GFA.
The applicant provided the Zoning Board of Review with a table calculating the `average' Gross Floor Area(GFA)
within a 500 feet radius of the subject property consisting of 28 properties. This table indicates an average GFA of
2,743.33 square feet(330.83 square feet greater than what is permitted by the code for this lot size). While the table
took into account varying lot sizes,with an average of 63,707.95 square feet(basically 5 times the size of the subject
parcel!), the applicant did not follow the guidelines as recommended by the Zoning Board of Appeals to calculate
GFA averaging. These guidelines specifically ask for a maximum of 22 homes,when applicable,within the subject's
zoning district,R40(the table provided illustrates homes located outside of this district and in the AC and R80 Zoning
Districts)and consisting of 5 developed lots on the same side of the street in either direction and those immediately
opposite the subject property (5 developed lots in either direction)to be calculated,when applicable. Because the
average GFA of 2,743.33 square feet includes properties that do not meet the locational guidelines (adjacent and
opposite maximum 5 properties/similar zoning designation), the Board cannot consider the applicant's version of
`averaging' when applying the balancing;test to grant the minimum variance relief, since the `average' as provided
is not correctly calculated or offers a Bonafide `average'.
No member of the public or an immediate neighbor spoke in favor of or against this application.
FINDINGS OF FACT)REASONS OR l3O ACTION:.
The Zoning Board of Appeals held a public hearing on this application on February 6,2025 at which time written
and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:

1. Town Law 267-b 3 b 1 . Grant of the variance, as amended, will produce ar unlaesIrable can e m the
character of the neighborhood or a detriment to nearby properties. The right of way known as Tall Wood Lane is an
unimproved dirt road leading from Cox Neck Road(paved)to several homes all set in a rustic setting,the majority
of which are on larger lots than the subject. As a result of zoning, the immediate neighborhood and lot size varies
between the R40, R80 and AC zones with some homes sited on small, non-conforming lots similar to the applicant
along with homes sited on much larger lots, that also function as working farms. The subject, undeveloped parcel
can easily accommodate a home and accessory structures with the permitted 20% lot coverage and also, can
accommodate a Gross Floor Area,compliant with the code, not to exceed(as calculated based on lot size)2,412.50
square feet.
2, Town Law 267-b 3 b . The benefit sought by the applicant can be achieved°by some method,feasible for
the applicant to pursue,other than an area variance. The applicant owns a building lot of 12,500 square feet and may
comply with current residential zoning regulations of the R40 Zoning District and build a new home with various
accessory structures not to exceed the permitted 20% lot coverage. Additionally, a new home with the allowable
Gross Floor Area of 2,412.50 square feet(as calculated based upon the lot size)can contain numerous bedrooms and
all the amenities needed to live comfortably,in conformance with the Suffolk County Board of Health sanitary permit
associated with the proposed construction.
3. Town Law 267-b (b)(3). The variance requested herein, as amended, is mathematically substantial,
representing 13.2%relief from the code relative to excessive Gross Floor Area.
4. Town ll..aw 2674 3 b '4 . Evidence has been submitted to suggest that a variance in this residential community
will have an adverse impact on the physical or environmental conditions in the neighborhood. No evidence was
submitted that variance relief was sought in this neighborhood; and given the applicant's ability to construct a code
conforming dwelling on the subject undeveloped lot,the granting of relief would set an unnecessary and undesirable
precedent.
5. Town Law 267-b b . The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6.Town Law 6267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of the development of a vacant residential building lot with a residence and common
associated accessory structures while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.
