S FOR BOARD ACTION The Zoning Board of Appeals held a public hearing on this application on April 2,2026 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1, o b l° rant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Orient village and the immediate"Iamdmark"neighborhood are characterized by one-story and two-story dwellings built over a nearly 400-year period since the founding of the Town of Southold and part of a streetscape is alder than the United States of America. These homes define the community and are constructed in a variety of styles reminiscent of colonial New England; many feature Victorian or maritime elements, including those homes more recently built in the mid-201 century or recently renovated,and all homes are developed on varying lot sizes,many of which have received variance relief for setbacks or lot coverage not conforming to the zoning code of the Town of Southold. The existing dwelling has, as it stands today and proposes to maintain,pre-existing,non-conforming setbacks relative to the secondary front yard and rear yard, and has exceedances of lot coverage and the Sky Plane. The{gross Floor Area(GFA)increase of 667 square feet relative to the existing house will not result in any undesirable change in the character of the neighborhood. To the contrary, Page 3,April 16,2026 #8090,Constant SCTM No. 1000-26-1-22 the relief, if granted, will allow the applicant to restore the home to its historic architectural style and character, as supported by the Town of Southold Historic Preservation Commission,without any detriment to the community. 2. Town-law 2E b b) , The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The applicant is seeking the benefit of expanded and upgraded . living space to meet the needs of their family. The recently adopted Gross Floor Area limits and Sky Plane regulations,the pre-existing, non-conforming rear and secondary front yard setbacks, and the constrained small lot area trigger the need for variance relief. The house, as it exists pre "demolition" renovation, does not conform to code and in order to maintain the existing conditions,requires the requested relief. It is virtually impossible to alter the house and properly maintain it without some form of relief being,granted. 3. T n a 7" b The variances granted herein are mathematically substantial,representing 64%relief from the code relative to the reduced front yard setback;92.47%relief from the code relative to the reduced rear yard setback;42.5%relief from the code relative to excessive lot coverage,23%relief from the code for GFA,and 100% relief from the code relative to penetration of the Sky Plane.However,the applicant is not proposing to increase the existing secondary front yard or rear yard setbacks,which presently exist and are recognized and codified by the Pre- Certificate of Occupancy on file with the Town of Southold. Relative to excessive lot coverage,the existing residence has 25.9%©lot coverage;the proposed project will increase it by 2.6 percentage points or 225 square feet in footprint, in a compliant location. While lots of this size are limited to an overall Gross Floor Area of 2,100 square feet maximum of living space, the excessive amount requested, an addition of 667 square feet, is in keeping with the community character and scale of ether homes on constrained lots within this neighborhood. Lastly,complying with IEMA standards necessitates elevating the existing dwelling to a first-floor elevation of 9.6 feet. Doing so, while maintaining the pre-existing nonconforming front and rear yard setbacks, unavoidably results in the dwelling penetrating the Sky Plane. 4. Town7 ( � No evidence has been submitted to suggest that a variance in this residential community will have an adverse a impact an the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install a Suffolk County Board of Health approved Innovative and Alternative Wastewater Treatment System. 5. a 2� 7 � � �.. The applicant purchased the parcel after the .honing Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.
