(631) 765-1809 PL` Southold Town Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF DUNE 18,2026 ZBA FILE: #8109 NAME OF APPLICANT: Angela Levas PROPERTY LOCATION: 5335 The Long Way(adj. to Long Island Sound), East Marion,NY SCTM No. 1000-21-5-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 16, 2026 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 13, 2026. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with the LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. This Board has determined that this improvement is CONSISTENT with LWRP based upon the fact that the swimming pool has been in existence for many years (since approximately 1986) and that the Board of Trustees has deemed the improvement as Consistent with LWRP policy standards subject to the condition of the creation of a 10 feet non-turf buffer. BOARD OF SOUTHOLD TOWN TRUSTEES: On April 16, 2026 the Southold Board of Trustees addressed the applicant's permit under the provisions of Chapter 275 of Southold Town Code, the Wetland Ordinance of the Town of Southold. The Board was in receipt of the LWRP Coordinator's comments along with all testimony and documentation submitted for this application. The Trustees determined that the project will not affect the health,safety Page 2,June 18,2026 #8109, Levas SCTM No.21-5-13 and general welfare of the people of the Town. The Board of Trustees deemed the action Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code and voted to approve the application for the existing 18 feet by 36 feet in-ground swimming pool with a 3 feet by 6 feet step area(666 square feet);existing 1,670 square feet of irregular shaped brick pool patio surround set flush with grade on loose material(not a concrete slab) and to install a 4 foot high pool enclosure fencing with gates; with the condition to establish and perpetually maintain a 10 foot vegetated non-turf buffer along landward edge of bluff line; and as depicted on the site plan prepared by Frederick Robert Weber,Architect,received on April 20,2026 and stamped approved on May 6,2026 permit#10957. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 52,534.7 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 118.00 feet and is adjacent to Long Island Sound,the easterly property line measures in total 695.56(518.28 and 177.28)feet,the southerly property line measures in total 94.52 (37.00, 20.00, 37.52) feet and is adjacent to The Long Way and the westerly property line measures in total 637.26(204.50 and 432.76)feet. The property is improved with a two-story frame dwelling with attached garage, an attached rear yard deck and an existing in-ground swimming pool located in the northeast rear yard as shown on the survey map prepared by Paul Barylski, LS, and last revised September 16, 2024. BASIS OF APPLICATION: Request for a Variance from Article XXII, Sections 280-116A(1) and the Building Inspector's December 31, 2025 Notice of Disapproval based on an application for a permit to legalize an as built in- ground swimming pool at: 1) less than the code required 100 feet from the top of the bluff; located at 5834 The Long Way(adj.to Long Island Sound), East Marion,NY. SCTM No. 1000-21-5-13. RELIEF REQUESTED: The applicant requests a variance to open and renew expired permit#15231 to construct an in-ground swimming pool. The completed in-ground pool construction, on this conforming 52,534.7 square foot lot located in the Residential R-40 Zoning District, is not permitted pursuant to Article XXII, Section 280-116A(1),which states: "All building or structures located on lots upon which there exists a bluff landward of the shore or beach be set back not fewer than 100 feet from the top of such bluff." The in-ground swimming pool is located 59.6 feet from the top of the bluff. ADDITIONAL INFORMATION: The existing in-ground swimming pool has been in its current location since 1986. The setback of 59.6 feet from the northwest corner is substantial, however, the setback to the bluff increases to over 100 feet on the northeast side of the property. The property is very sloped on the west side of the rear yard with a bluff that circles the property from north to west. There have been no adverse effects on the bluff or neighboring properties. Relocation of the pool would cause more disturbance and damage. The current owner was not the owner when the pool was installed in 1986. This is an outstanding expired permit that the applicant wishes to legalize the existing pool. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 4,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Several properties in this neighborhood face some of the same problems with bluff setbacks. Many of the homes in this waterfront area have in-ground swimming pools. This pool has been in existence for almost 40 years. The pool location has not disturbed the neighbors to the west and east. 2. Town Law V67-b(3)(bM(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Relocation of a pool that has existed for almost 40 years with no Page 3,June 18,2026 48109, Levas SCTM No. 21-5-13 disturbance to the environment or neighbors is not possible. The current location is the only suitable location on this property. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 40.4% relief from the code. However, due to the topography of the property, there is no other appropriate location. The Southold Town Board of Trustees gave approval and issued the applicant a Wetland Permit. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant's relative purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a legalized in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for,and shown on the Site Plan prepared by Frederick R. Weber,Architect and dated February 16, 2026. SUBJECT TO THE FOLLOWING CONDITIONS: l. The condition imposed by the Southold Board of Trustees to establish a 10-foot vegetated non-turf buffer along landward edge of the bluff line shall be adhered to. 2. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s) within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity,provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application.
