(631) 765-1809 XOU ®?dho ern Clerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF JUNE 18,2026 ZBA Application No. 8099 Applicants/Owners: Veradeana Properties LLC Property Location: 9425 &9555 Soundview Avenue, Southold SCTM No.: 1000-59-6-22 and 23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 40,544 square foot parcel located in an R-40 Zoning District. The property has road frontage along Sound View Avenue of 233.94 feet, it then turns northwest for 291.38 feet towards Great Pond, it then turns northeast in an irregular interval along Great Pond for approximately 229.53 feet,then returns southeast for 275.04 feet to Sound View Avenue. The property is improved with an existing one-story residence, and two (2) accessory seasonal cottages. The existing house has a certificate of occupancy#869 dated October 24, 1960, with a number of additions and alterations over the years all with valid certificates of occupancy. The seasonal accessory cottages have pre-certificates of occupancy#41942 and 41943, both dated March 28, 2021. All as shown on survey prepared by Donald J. Metzger, LLS of Peconic Flood Certificate Solutions, last revised January 9, 2023. BASIS OF APPLICATION: Request for a Waiver of lot Merger under Section 280-11 to unmerge a parcel of 21,488 square feet(SCTM No.1000-59-06-23) from an adjacent land area of 19,056 square feet(SCTM No. 1000-59-06-22), based on the Building Inspector's Notice of Disapproval pursuant to Section 280-10 of the Town Code determining that the properties have been merged. e Page 2,June 18,2026 #8099,Veradeana Properties SCTM No. 1000-59-6-22 and 23 "A non-conforming lot shall merge with an adjacent conforming or non-conforming lot held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty(50)feet or more in distance. Non-conforming lots shall merge until the total lot size conforms to the current bulk schedule requirements located, at 9555 Soundview Avenue, Southold,NY. SCTM Nos. 1000-59-6-23 and 1000-59-6-22." ADDITIONAL INFORMATION: During the first public hearing on May 7, 2026, the applicant's agent acknowledged that the application did not meet the criteria for a waiver of merger because the properties were held in common ownership inside of the same family until the sale to the current owners,Veradeana Properties LLC. Lots 22 &23 were originally created in 1948 by deed from the estate of Gilbert Terry to Arthur Hahn. In 1957 the lots were conveyed by way of a single deed to Eleanor Swenkowski who became Eleanor Schriefer, who held title to the lots until 2016 when she conveyed them to her son John Schriefer. In that same year John conveyed lots 22&23 to an irrevocable trust. In May 2021,the lots were conveyed to the applicant. Because the sale occurred outside of the family without the properties being unmerged, the current property does not qualify for waiver of merger relief. The chain of titles is noted in a title report submitted to this board from Fidelity National Title, dated August 10, 2021. These facts thereby negate any claim to unmerge the properties, as it does not qualify under current Town law. At the public hearing,there was testimony as to rental permits issued to both the cottages and main house. It was noted that the applicant wished to maintain rental permits for all the structures. During subsequent meetings with Town building officials, it was found that the rental permits for the cottages may have been issued in error. However, rental permits expire every two years and applicant and agent were advised of same. There is currently a valid rental permit issued for the main house. While not part of this application, this matter was discussed among the owner, the owners' agent, and the Zoning Board in public session during a second public hearing on June 4, 2026. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The standards for the granting of a waiver of merger are contained in Section 280-11 of the Town Code. Sections 280-11(A)and(B)require that the Board engage in a two-prong test before granting a waiver of merger. Pursuant to Section 280-11(A)the Board must determine whether the lot proposed to be recognized has been transferred to an unrelated person or entity since the time the merger was effected. If the lot has been transferred to an unrelated person,the lot is not eligible for a waiver of merger. Pursuant to Section 280-11 (B), if the lot has not been transferred to an unrelated person, the Board must engage in a balancing test of 3 factors to determine whether the lot is eligible for a waiver of merger, namely, whether(1)the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood, (2)the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation, and (3)the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district. The Zoning Board of Appeals held a public hearing on this application on May 7,2026, and again on June 4, 2026, at which time written and oral evidence were presented. A chain of title search was presented into L' Page 3,June 18,2026 #8099,Veradeana Properties SCTM No. 1000-59-6-22 and 23 evidence as part of the submission package. The chain of title search was completed by the Fidelity National Title Insurance Services, LLC and dated August 10, 2021. This title search confirms that the property was sold outside of the family as a merged property, and is therefore not eligible for unmerging. Pursuant to § 280-11(A) the Applicant has not submitted documentation, to the satisfaction of the Board that there have been no transfers of ownership of the lot outside the family since the time merger was effected. Consequently, the lot is not eligible for a merger waiver. Lots 22 and 23 were originally created in 1948 by a deed from the Estate of Gilbert H. Terry to Arthur Hahn (1,2794 P72). In 1957, the lots were conveyed by way of a single deed to Eleanor Swnkowski who became Eleanor Schriefer who held title to the lots until 2016 when she conveyed them to her son John Schriefer. In that same year, John conveyed Lots 22 and 23 to his Irrevocable trust. In May, 2021, the lots were conveyed to the Applicant. That was the first and only conveyance outside of the Schriefer family since June 1983 when the Merger law became effective. As the Board is aware, the merger law primarily targets substandard vacant parcels that share common ownership with an adjacent improved parcel. The code exempts parcels that are improved with a residential structure that is at least 850 SF from merger. Here, while lots 22 and 23 have always been in common ownership, they have always been treated and maintained as separate and distinct parcels. Lot 22 is improved with a single-family residence that has had a Certificate of Occupancy since 1972. Lot 23 has been improved with two seasonal cottages that have been in existence since at least 1950. Pre-CO's for each cottage were issued in 2021. Received JAN`2 7 2026 When the Applicant purchased these properties, she Zlied for rental 9 Board of ApPdals permits from the building department for both cottages. At that time, the building department questioned the merger of the parcels and suggested that a waiver of merger may be necessary. In the alternative, the Applicant would have to show proof that the cottages were rented prior to the advent of the zoning code in 1957. After extensive research, the Applicant obtained the attached affidavit from Jean Rorke whose family rented the cottages from 1951 to 1958 (See Exhibit "A"). Her affidavit and other photographic evidence was provided to the Building Department and rental permits were issues for both cottages in 2021. Those permits were renewed in 2023 but, notwithstanding the established and longstanding use of the cottages as seasonal rentals, the Applicant was denied a renewal of the permits in 2025 necessitating the instant application. It is clear that the owners of these parcels have historically used the main house as a personal residence and the cottage property as a rental property. Lots 22 and 23 are separate tax parcels with separate driveways and a visual inspection confirms that they are now and always have been separate and distinct improved parcels. The cottages are each 472 SF inclusive of their covered porches. As such, the property is improved with over 850 SF of residential living space. The only reason the merger law applies here is because there are two structures rather than one. 2 Received While the applicant is not able to satisfy the primary criteria for a waiver JA N 2 7-2026 of merger under the Town Code, it is respectfully submitted that the'unique 'Zoning Board of Appeal, history of this parcel and the fact that it has been improved for nearly 75 years, warrants the granting of a waiver of merger of these parcels that have always been in common ownership. Moreover, for the reasons explained in more detail below, the Applicant submits that a Waiver of Merger is justified under all three criteria in §280-1 l(B) of the Town Code. ARGUMENT THE APPLICANT HAS SATISFIED THE CRITERIA FOR THE GRANTING OF A WAIVER OF MERGER UNDER §280-11 OF THE SOUTHOLD TOWN CODE With respect to a waiver of merger, §280-11 of the Town Code provides that: If a lot has merged pursuant to the provisions of§280- 10, the Zoning Board of Appeals may waive the merger and recognize the original lot lines upon public hearing and finding that: A. The lot proposed to be recognized has not been transferred to an unrelated person or entity since the time the merger was effected. These parcels have never been single and separate but, under the unique circumstances here, the Applicant is requesting that the Board use its discretion to waive the merger. The building department has acknowledged the historic use of Lot 23 as a seasonal rental property. The lot has always been a separate and continues to be a distinct parcel and the Applicant should not be denied the right to continue the established historic use of the property by 3 operation of a law that was adopted 50 years after the use was established. Section 280-11(B) requires the Zoning Board of AppeaR91We the following factors: JAN 2 7 2026 Zoning Board of Appeais 1. Whether the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. A simple review of aerial photos on the County GIS map confirms that Lot 23 is comparable in size to the adjacent lot and many of the nearby parcels on Soundview Avenue and it is larger than most of the nearby parcels on Kenny's Road. 2. Whether the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. As disussed above and confirmed by historic evidence and visual observation, Lot 23 is a distinct IMPROVED parcel with two legally existing structures that predate our zoning laws. The parcel has its own address, tax map number and bill and separate access. The improvements on the parcel are a great distance from the house on Lot 22 and none of the amenities are shared. 3. Whether the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or District. Unmerging Lot 22 from Lot 23 will simply allow the well-established historic use of the cottages to continue with no perceivable adverse impacts on 4 the physical and environmental conditions in the neighborhood or District. Finnegan, Esq. 13250 Main Road Mattituck, New York 11952 (631) 315-6070 Dated: May 5, 2026 IM FACTUAL BACKGROUND Pursuant to the Notice of Disapproval dated November 21, 2025, the Applicant, Veradeana Properties, LLC ("the Applicant") is seeking a Waiver of Merger of the improved parcel located at 9555 Soundview Avenue, Southold (SCTM# 1000-59-6-23) ("Lot 23") from the adjacent improved parcel located at 9425 Soundview Avenue, Southold (SCTM # 1000-59-6-22) ("Lot 22"). Lots 22 and 23 were originally created in 1948 by a deed from the Estate of Gilbert H. Terry to Arthur Hahn (L2794 P72). In 1957, the lots were conveyed by way of a single deed to Eleanor Swenkowski who became Eleanor Schriefer who held title to the lots until 2016 when she conveyed them to her son, John Schriefer. In that same year, John conveyed Lots 22 and 23 to his Irrevocable Trust. In May, 2021, the lots were conveyed to the Applicant. That was the first and only conveyance outside of the Schriefer family since June 1983 when the Merger law became effective. . As the Board is aware, the merger law primarily targets substandard vacant parcels that share common ownership with an adjacent improved parcel. The code exempts parcels from merger that are improved with a residential structure that is at least 850 SF. Here, while lots 22 and 23 have always been in common ownership, they have always been treated and maintained as separate and distinct parcels. Lot 22 is improved with a single- family residence that has had a Certificate of Occupancy since 1972. Lot 23 has been improved with two seasonal cottages that have been in existence since at least 1950. Pre-CO's for each cottage were issued in 2021. When the Applicant purchased these properties, she applied for rental permits to continue the seasonal rental of both cottages. At that time, the Building Department questioned the merger of the parcels and suggested that a waiver of merger may be necessary. In the alternative, the Building Department advised that rental permits could be issued if the Applicant could obtain proof.that the cottages were rented prior to the advent of the zoning code in 1957. After extensive research, and with the assistance of neighbors, the Applicant obtained the attached affidavit and photographs from Jean Rorke which confirmed that her family rented the cottages from 1951 to 1958 (See Exhibit "A"). Her affidavit and the photographic evidence was provided to the Building Department and rental permits were issued for both cottages in 2021. (See Applicant's email to Mike Verity dated 9/2/21 attached hereto as Exhibit "B"). Those permits were renewed in 2023 (see copies of permits attached hereto collectively as Exhibit"C") but, notwithstanding the established and longstanding use of the cottages as seasonal rentals, the Applicant was denied a renewal of the permits in 2025. The instant application followed. It is beyond dispute that the owners of these parcels have historically used the main house as a personal residence and the cottage property as a rental property. The Applicant recently obtained an additional affidavit from her neighbor, Kathleen Rice, which provided further verification of the distinct and historic use of the cottages as a separate rental property. See, Affidavit of Kathleen Rice attached hereto as ("Exhibit "D"). Lots 22 and 23 are separate tax parcels with separate driveways and a visual inspection confirms that they are now and always have been separate and distinct improved parcels. The cottages are each 472 SF inclusive of their covered porches. As such, the property is improved with over 850 SF of residential living space. The only reason the merger law applies here is because there are two structures rather than one. While the Applicant is not able to satisfy the primary criteria for a waiver of merger under the Town Code, it is respectfully submitted that the unique history of this parcel and the fact that it has been improved for nearly 75 years, warrants the granting of a waiver of merger of these parcels that have always been in common ownership. Moreover, for the reasons explained in more detail below, the Applicant submits that a Waiver of Merger is justified under all three criteria in §280-11(B) of the Town Code. ARGUMENT UNDER THE FACTS AND CIRCUMSTANCES HERE, THE GRANTING OF A WAIVER OF MERGER IS WARRANTED UNDER §2SO-11 OF THE SOUTHOLD TOWN CODE With respect to a waiver of merger, §280-11 of the Town Code provides that: If a lot has merged pursuant to the provisions of§2SO- 10, the Zoning Board of Appeals may waive the merger and recognize the original lot lines upon public hearing and finding that: A. The lot proposed to be recognized has not been transferred to an unrelated person or entity since the time the merger was effected. These parcels have never been single and separate but, under the unique circumstances here, the Applicant is requesting that the Board use its discretion to waive the merger. The building department has acknowledged the historic use of Lot 23 as a seasonal rental property by issuing 4 years of rental permits and the cottages have Pre-Certificates of Occupancy. The lot has always been separate and continues to be a distinct parcel and the Applicant should not be denied the right to continue the established historic use of the property by operation of a law that was adopted 50 years after the use was established. Section 280-11(B) requires the Zoning Board of Appeals to balance the following factors: 1. Whether the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. A simple review of aerial photos on the County GIS map confirms that Lot 23 is comparable in size to the adjacent lot and many of the nearby parcels on Soundview Avenue and it is larger than most of the nearby parcels on Kenny's Road. 2. Whether the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. As discussed above and confirmed by historic evidence and visual observation, Lot 23 is a distinct IMPROVED parcel with two legally existing structures that predate our zoning laws. The parcel has its own address, tax map number, tax bill and separate access. The improvements on the parcel are a great distance from the house on Lot 22 and none of the amenities are shared. 3. Whether the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or District. As evidenced and confirmed by a dozen Letters in Support from the Applicant's neighbors, the waiver of merger of Lot 22 from Lot 23 will simply allow the well-established historic use of the cottages to continue with no perceivable adverse impacts on the physical and environmental conditions in the neighborhood or District. CONCLUSION It is respectfully submitted that a waiver of merger is warranted under the unique facts and circumstances here and upon a balancing of the factors in Section 280-11(B). But I really had a breakthrough four houses down the road on Soundview Avenue where I met a lovely old lady Kay Parks Rice who has been around a long time since her parents bought her house in 1949 and in a heartbeat gave me the proof I needed and very quickly told me dozens of stories of her childhood on the beach playing with kids who rented the cottages in summer. She connected me to someone in Maryland who as a child not only rented the cottages in the very early 1950's with her parents but met her now husband of 62 years while she stayed at the cottages and a young boy looking for turtles in the lake asked her out on a date! My grandfather, father, and uncle were members of the Holy Name Society and visited Southold during the 1930s and 1940s. The Building Department required this of her in order to prove that the cottages were rented out before 1957,which would allow her to have the rental permits grandfathered in. I directed her to Jean Woods Rorke, my childhood friend and niece of Margaret and Jack Woods,who rented and lived in the cottages before' 1957. I have since come to know Margaret-Ann and Jean Marc Neimetz well and have oftentimes gone to their home and shared a meal with them. During the nineteen-seventies,two adjacent subdivisions were also approved by the Planning Board,Crown Land with nine irregular shaped lots to the west approved on August 27, 1975 which abuts SCTM 13.6, and Highland Road approved on April 28, 1977 to the east containing 6 lots. Both of these subdivisions were developed by the same property owner who sold the lots to separate owners in the nineteen-eighties. The merger law was approved by the Town Board in 1983. Since none of these two subdivisions lots were merged by force of law, it is reasonable to assume the same should have or did apply.to the subject subdivision. 5. The subject lot is the only undeveloped lot in this minor subdivision and is located with frontage along Main Road in the Hamlet HALO Zone where greater residential density is supported by the Town's Comprehensive Plan. 6. The alleged merger of 13.3 with 13.4 and 13.6 encumbers not only the subject lot,but two other developed lots each owned by a different individual. Financial evidence has been submitted to the satisfaction of this Board that the merger creates significant financial hardship to the applicants who purchased the subject lot for$170,000.A recent appraisal valued the merged lot at$15,000. 7. The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because: The subject property is located on NYS Route 25(Main Road)and is comparable in size to all of the adjacent improved properties. Ordinarily, I would have provided this submission well in advance, but as I explained to Donna at the Town Hall Offices during a telephone call yesterday afternoon, I did not receive the packet of information (dated April 15) until Saturday afternoon, May 2. I therefore ask for the Board's indulgence in considering this submission, and our opposition to the petition. My wife and I are the owners of 9025 Soundview Avenue, on the northwest corner of Soundview Avenue and Kenneys Road. That property, which has been in my family for more than 65 years, is adjacent to the petitioner's parcel that is the subject of the petition. We oppose the petition for numerous reasons. As a starting point, we respectfully submit that the Board afford wide deference to the November 21, 2025 determination of the Town Building Inspector, consistent with settled New York law. (See, e.g., Matter of BMG Monroe I, LLC v Vill. of Monroe Zoning Board of Appeals, 215 AD3d 954, 955 [2nd Dept 2023]). That deference is particularly warranted where, as here, the plain language of the Town Code squarely supports the finding made by the Building Inspector, that"a non-conforming lot shall merge with an adjacent conforming or non-conforming lot held in common ownership with the first lot at any time after July 1, 1983" (emphasis supplied). In addition, Southold's ordinance in this regard is consistent with the Town's overall plan of development, which is to ensure that parcels not be subdivided into small lots, as the petitioner here proposes. Let's talk about antiquated septic systems leaching into the pond and one of the last views passersby have of this GREAT Pond. Do you remember as I do almost 40 years ago when we used to swim in Great Pond? Even Peconic Dune campers swam there. Now the pond has gone sour. Yes, there are too many geese: bacteria is rampant. But we are told it's mainly because very few pre-existing houses on the pond have the new IA systems. The owner of the merged property in question would like to unmerge ostensibly to be able to rent the two cottages on the lake. These cute cottages used to be rentals before the IA systems even existed. But times have changed; we know better. And then there are the possible intentions of future owners. Once unmerged, building a big house might be more financially viable. Sure they'll have to get approvals from Trustees and DEC. But we know what often happens, unfortunately, after permits are denied. Regarding "changing the physical conditions of the neighborhood", were alterations made to the cottages (i.e. added 2nd stories, privacy fences), one of the only lake views that the public has now might be destroyed. It is home io Osprey that return every year to fish in water so clear they can spot their prey while circling above; swans that each year valiantly strive to raise a multitude of sygnets; and herons, great blue and snowy, that prowl the edges, spearing fish and frogs. A beautiful eagle can often be seen afternoons, enjoying the Great Pond view, and multitude of peepers start their chorus in early spring, maintaining the high notes while-the bullfrogs add the bass to the evening air. Money has been raised and grants sought by associations and residents. Major efforts have been extended to protect the shore and edges of the pond with phragamite removal. Laws have been passed prohibiting motorized boats and the building of new docks, all in an effort to protect the pond and its enjoyment, ensuring that the pond stay native, natural, healthy. And this enjoyment is not just for the residents who are fortunate enough to live around the edges, but for those who have grown up attending Peconic dunes camp, a throwback to the days of Spin and Marty, as well as the sportsman who have discovered this jewel and come to fish in warm weather and ice boat in cold. But Great Pond needs more. Years back, in an attempt to protect this unique anomaly, two small lots with single ownership were merged into one. This parcel was purchased by owners who understood the situation yet who are now asking the town to unmerge the lots, reportedly to allow them to rent two small cottages. Surely the town can find a better way to remedy this situation. To unmerge them places another lot back into inventory, presenting a danger of development and threatening the stability of the ecosystem. It places a hardship on this pristine and fragile pond, which needs the town's protection as much now as it did years ago ... perhaps even more, as the nature of present development is bigger, larger-and not in the character of the surrounding community. Southold does not need to have every lot overbuilt, does not need more mansions, does not need greater burdens to the land and.the infrastructure. The town is already facing the danger of overdevelopment. Southold needs this pond more than it needs another house that the community cannot sustain. i s I ask that the board consider its role in protecting what's left, in its guardianship of a fragile, unique beauty.
