Y. 11971 Dear Mr. Smith: I am writing this letter to summarize a dangerous situation with respect to the operation of boats in and around the federal anchorage. As you know, the arrival of the summer season brings with it a vast increase in the number of boats using the federal anchorage. In the past there have been confrontations between Matt-A-Mar and private boaters not registered at the Marina. I refer to the article in Suffolk Life (1983) and the complaint received by the Chamber of Commerce during the same year. It is these situa- tions which I hope may be alleviated in the near future. In the past, the Marina has hired a full time watchman to prevent and control boaters entering the Marina. It is not that the Marina wants to preclude operators of dingies from entering the Marina, but rather it is out of necessity as there is no place to tie up dingies. If the Marina were to let the boaters tie up the dingies at random, a hazardous and dangerous situation could arise for other boaters. If there were adequate facilities for these dingies, the above situation could be alleviated. It is with this in mind that the Marina requested permis- sion to build a floating dock. As you know, building a floating dock is expensive both in the actual construction and future maintenance. It is not an undertaking primarily geared to generate income, but rather to provide safety for boaters by decreasing the chance of accident. The docks, which are remov- able, would have no environmental impact as there would be no facilities on them (water, electricity, gas, etc.) . They would simply be used for tieing up small boats during the summer season. At the end of the summer season, the docks would be removed and stored. Administrative Law Judge PROCEEDINGS On September 2, 1981 the Staff of the Department of Environmental Con— servation (the "Department") determined complete an application by James H. Rambo, Inc. for MATT—AMAR MARINA, INC. (the "Applicant") pursuant to Environmental Conservation Law ("ECL") Article. 25 ("Tidal Wetlands Act"), Article 1.5, Title 5 (Protection 'of Water) acid Public Law 95-217 (Water Quality Certification). for permits and certification to add additional floating docks to the Applicant's existing Marina on Mattituck Creek, in,Mattituck, Town- of Southold, Suffolk County, New.York (the "Site"). A notice of public hearing was published in the Long Island Traveler— Watchman on November 12, 1981 and in the Department's Environmental Notice Bulletin on November 11, 1981. Copies of the Notice were sent by mail to-the. . :clerks and chief' executive officers of the municipalities within whose boundaries the affected wetland is located. A notice. of complete application was published in the Department's Environmental Notice Bulletin on .September 30., 1981. A public hearing was held before A. Marshall Irving, Administrative taw Judge ("ALJ") in:the Southold Town Hall, 53095 Main Road, Southold, New York on December 3, 1981• Six persons attended the hearing. The Applicant was represented by Thomas E. Samuels, President of James H. Rambo, Inc. Allen P. Van Name, Manager and Robert White, Mechanic of Matt—A—Mar, Inc. appeared at the hearing. The Southold Board of Town Trustees .was represented by Anna T. Hataier, President. The North Fork Environmental Council was represented by Ruth Oliva, President and by Franklin Bear who also represented the Mattituck Inlet Advisory Committee. Due to a composing error the public notice in this matter read 1147 5K40 foot floating docks" instead of 4, 5X80 foot floating docks. This error was not noticed by any of the parties at the hearing nor was there any contention that- longer (or shorter) docks would change the positions of any parties. The stenographic record was received on February 51 1982 and the hearing was closed on.that date. Position of Objecting Parties . The objectors to the proposed project contend that adverse environmental effects would result from increasing the number of boats at the Marina. The objectors claim. "salt water intrusion", "high coliform count", "closed to shellfishing", "navigational hazards", and "boat wake hazards". as items which would be made worse by.the proposal. The matter of "salt water intrusion" is not discussed in this report since.no party raised the issue at the hearing. The remaining matters are addressed by this report. Position.of Department Staff Staff was not represented at. the hearing and has not opposed the project. — 2 — State 3hvironmental Quality Review Pursuant to Part 617 of the Department's implementing regulations for the State Fhvironmental Quality Review Act ("SEQRA"), . it has been determined that this project will not have a-significant effect on the environment. Depart— ment Staff published Notices including "Negative Declaration" in the publica— tions noted above. Findings of Fact 1. The Applicant is a commercial marina with facilities for docking. 82 boats and is requesting .a permit to install additional floating "docks" to increase the boat docking capacity of the Marina by 14 boats to a grand total' of 96 boats. The project would consist of adding 4 "Tee"shaped floating docks of total area of approximately 3,000 square feet. The typical dock would be 5 feet wide by 80 feet long with a 5 foot wide by 72 foot long "Tee" section at its offshore end. . 2. The specific potential problems and contentions associated with the Project are: (a) The marina is located near the southernmost or most landward end of Mattituck Creek and at that loca— tion there is the least flushing by tidal action. (b) The southerly .portion of Mattituck Creek is pre— 2 sently closed to shellfishi.ng due to high coliform counts. (c) Increasing the present boat usage in-the Creek would increase boat wake—related erosion of the shoreline and water pollution:. (d) There is a fede�ally dredged and maintained anchorage/ "turning basin' area located 200 feet west of the Applicant's bulkhead. The Applicant's proposed floating docks could create a navigational hazard to the turning basin. 3. The locale of the Site is depicted on Appendix "A" attached to this report.- Appendix "B" shows the Site with the 4 proposed floating docks. The proposed floating docks would be 120± feet east of the Federally maintained "turning area". The term floating "docks" as used herein refers to floating platforms .restrained from horizontal movement_ by pilings but free to float up and down with. the tide. %hi.le coliforms themselves are considered generally harmless, coliform counts are used to determine the acceptability of tidal waters for shellfishing. 3A "turning basin" is a *,widened_ section generally at 'the .end of a dredged channel designed to permit boats to turn 180 and. proceed ahead in the opposite direction. - 3 4., The. Applicant's.estimate of the maximum number of boats in Mattituck Creek ranged from 350 to 500. 5. The Applicant presently has a marine 11head"4 pump--out facility (for boats with holding tanks) which is only accessible by shallow draft boats. The Applicant would make the pump-out facility available on ,the new floating docks in deeper water. 6. The major source of coliforms in Mattituck Creek "is "most probably caused by naturally occurring organisms being carried from the adjacent farm- lands to the Creek by runoff". The "Suffolk County Department of Planning has so stated in its .April 30, 1981 "Mattituck Creek Watershed Study" (the "Study"). In addition, the Study notes that coliform counts generally increase in order of magnitude (10 fold) after a significant rainfall. As a consequence the southerly quarter of Mattituck Creek is closed to shellfishing. 7. The Applicant contends that the Marina i_s presently unprofitable and that the requested additional berthing space. is necessary in order to operate the Marina at. a profit. The Applicant did not submit financial data in support of this contention. There is however a need for additional deep draft . boat .berthing facilities. 8. The project would require the installation of treated pilings and treated timber floats. The type of pr.eservative/biocide treatment for the wood piles and floats was not revealed at the hearing. No disturbance of. "stream bed" is involved in this project. Conclusions 1. It is concluded that the project as proposed is compatible with the preservation and. protection of tidal wetlands in that, on balance, the additional pollutants from the docking .of 14 more boats would be mitigated to a significant degree by the addition of more access to pump-out facilities by deep. draft boats. In addition it is clear that the major source of pollution in Mattituck"Creek is surface runoff from adjacent lands and that the docking of 14 more or 14 less boats. would not change the present polluted condition of the Creek to any measurable degree nor would it have any effect on the . closed shellfishing area. 2.. The project would be compatible with the public health, safety and welfare since the proposed expansion of the Marina would allow more large boats to have access to pump-.out facilities. 3. The project is reasonable and necessary since there is a significant demand for boat mooring space in Mattituck Creek and the activity requires water. access and is water dependent. 4. The development restrictions of 6 NYCRR Section 66106 (which apply, to upland development of or near tidal wetlands) do not apply to this project since it is solely for fioating.dock construction and does not involve any upland development. toilet - the term "head" is probably from sailing ship days-when.the toilet- facilities were at the bow or "head" of the ship for the. obvious reason of wind direction (almost -always from aft when underway) - 4 - 5. The project complies with the use guidelines of 661.5(17) in that installing floating docks (of more than 200 square feet in area; is categorized as a "Generally compatible use — Notification Letter Required". 6. Since the Applicant's proposed docks would be 120± feet from the Federally maintained "turning basin" there would be no navigational_ hazard to boats anchored or maneuvering in said basin. The addition of the capability for 14 more boats at the Marina to the 500— boats known to use the Creek would be insignificant. Boat wake shoreline erosion, if occurring, can better be controlled by local enforcement of speed limits rather than attempting the exclusion of additional boats as advocated by the objectors to this project. 7• It is reasonable to conclude that the addition of treated wood pilings and floats in this area would not have any adverse effect on water quality since the structures proposed are similar to existing developments .on the . Creek and no issue was raised regarding water quality degradation from the pro— posed structures. A water qualify certification may be issued for this project which should be limited to Copper Chrome Arsenate (CCA) treated timber which is well recognized as preferable to creosote treatment which leaches hydrocarbons into the waters. S. It is concluded that the proposal would not cause unreasonable, uncontrolled or unnecessary damage to the natural resources of the State since the already poor water quality of Mattituck Creek at the Site has not been caused, or even significantly contributed to by Marina operations. 9. It is concluded that a 'permit should be issued for the project as proposed and should contain a special condition requiring that all boats renting or leasing docking space at the Marina, if said boats are equipped with a marine head, shall comply with the pertinent State and Federal require— ments for marine heads. In addition all docked boats shall be prohibited .by their lease or rental agreements from discharging any sewage into Mattituck Creek. Failure of the Marina op&rator to enforce these requirements shall be cause for revocation of this permit. 5Although a public hearing was not mandatory for this project, this hearing. was. scheduled due to significant public and municipal comment to the published , notice of Complete Application.
