The Board of Trustees has no objection to this activity of a
canoe-kayak event, provided that we are supplied with a diagram
of the proposed.
However, you are require by Chapter 32-38 of the Town Code, to
notify the Town Board for approval also.
Please, also advise the Bay Constable so as to avoid any
surprises..
Also, on our recent field inspections we notices that the berm
on the south side of the marina was not yet completed. Please
do so before the fall rains set in, and send us the.
specifications of your pump-out facility.
Please do not hesitate to contact me if you have any other
questions.

Dear Town Board Members,
On Labor, Day Weekend, August 30th through September 1st,
Matt-A-Mar Marina would like to hold a non-profit canoe-kayak event on
Mattituck Inlet. The event is 'a slalom race, in which competitors are timed
and Judged on completion of a slalom course.
The slalom is set up the same way as an Olympic Whitewater Slalom.

this means that competitors will have to make their way through poles that
hang 6-12 inches off ,the water. In order to hang these poles, wires will have
to be strung across this narrow portion of the inlet. These wires will
be tied off to trees on both sides of the river, and they will be 10 feet
above the water at high tide. The section of inlet in use is the part past
the Matt-A-Mar lift pit towards Wickham Avenue. This area is too shallow
for most powerboats, and has no powerboat traffic because it is a dead-end
with no other boat docks.
The course construction will begin on August 30th, and
all wires will be taken down on the evening of August 31st. There will
be practice from 1 :00 - 5:00 on August 30th, and the race will begin
at 9 :30 and end around 5:00 on August 31st. All parking and bathroom
facilities will be provided by Matt-A-Mar.

Dear Mr. Cocks:
The Southold Town Trustees inspected the site of your proposed
wetland permit for your storage building today and request the
following information to make your application complete:
1. Please depict a swale and berm feature on your plans
shown in cross section such that surface runoff will not be able .
to flow over the retaining wall and in all areas of which we
spoke on field inspection this date.
2. Please show in detail your proposed screening planting
south of the building with the exact species you plan to use
that is acceptable to the Planning Board and in relation to
number one above.
3 . Please indicate in detail your plans for the floor inside
the structure, such that we are certain there will be no floor
drains or points of entry for toxics.
Upon submission of this information the Trustees will be able to
coordinate your application with other town departments.
As discussed in the field, under current usage and for the
purposes of this, Board, the structure south of the storage
building is presently, functionally, a retaining wall in that it
is above the ordinary high water mark and is primarily soil
retentive. This is not to say that it was not a bulkhead at the
time it was originally constructed. This definition is ours
alone and may not reflect the interpretation of other boards in
Southold Town.

SUBJECT: Appeal in the Matter of Matt-a-mar v. Southold
We have heard today, unofficially, that an appeal has neither
been filed, nor been authorized for filing, in the above matter.
Please let this confirm that the position of the Board of
Appeals has not changed. It is again requested that
discussions be attempted to contact Mr. Lark for a possible
Stipulation relative to outstanding town authorizations that are
necessary,. and other approvals that will be required for
issuance by the Town subsequently, for this property.
It is recommended that no certificates of occupancy or other
permits be issued for this commercial property until appropriate
site plan approval by the Planning Board (and other
authorizations as are appropriate) have been obtained under the
zoning and wetland ordinances - for this storage building, or
other construction in the future as well.

Gentlemen:
It has come to our attention that the Town Board has
issued a stop-work order to the Matt-A-Mar Marina
concerning the construction of the steel building. '
Mattituck Chamber of Commerce feels that the support
of our marine business is important. We feel that this
or any other business should not have become the result
of the inability of the regulations of the different
town offices to coincide with one another.
We would encourage the Board to expedite the removal
of the stop-work order so that Matt-A-Mar Marina can
continue to be a contributing factor to the economy
of our town.
Perhaps it can be suggested that additional trees be
planted to seclude the building from the street so
that an equitable solution can be reached for everyone.

Dear Mr. Cocks:
Please be advised that the application of Ali Agarabi for a dock at
265 Westview Drive, Mattituck, was Tabled at our July 27 'meeting.
Residents of the area,. have- expressed concern about the incidence of
boats being moved, on several occasions, from the marina to residential
docks. We were also presented with photographs showing this activity. I
am sure that you are aware of restrictions preventing the expansion of
commercial activity into residential areas.
The Trustees would like to be assured that this type of activity will
cease before approving any additional docks in this area.

RE: Special Groundwater Protection Area
On Monday, June 12th, the Special Groundwater Protection
Area Advisory Council met at the Long Island Regional Planning
Board's offices in Hauppauge.
At this meeting, the Council voted to include the western
portion of Southold Town' s water recharge area between Mattituck
hamlet and. the Riverhead Town Line into the Central Suffolk
SGPA. A copy of the map showing the new boundary is enclosed
for your convenience. Also, refer to my March 1989 memorandum on
the proposed boundary change.
The Special Groundwater Protection Area Advisory Council
will continue to study the eastern portion of the Town' s
watershed from Mattituck Inlet eastward as a separate study
area.
If there are any questions, please do not hesitate to
contact me.

Dear Members :
On behalf of the officers and board members of
the Sebastian Cove Property Owners Association I am
requesting that the board continue to keep a close look
on the Matt-A-Mar-Marina project .
We feel surely the stop work order, although
coming late, is a step in the right direction properly
regulating the growth in Mattituck Inlet particularly
and on the North Fork in general .
It is a shame in such a beautiful area as ours
that aesthetics and impact on the local envi_r_onment are
not more easily regulated than present laws and codes
allow.
Surely such projects as this affect the lives
of all of us on the inlet .

taken by this Board on Thursday evening, April 27, 1989

RESOLVED, to GRANT -the request under Appl. No. 3829 for the
REVERSAL OF DETERMINATION by the Building Department to grant
BUILDING PERMIT No. 017508Z; and BE IT FURTHER
RESOLVED, that prior to issuance or reissuance of a
Building Permit for this building, further interpretations be
formally requested of this Board, for clarification as to
whether all of the activities in this proposed building is a
permitted principal use or a permitted accessory use in this
zoning district, including but not limited to the applicable
requirements in determining height limitations and yard
locations under the Zoning Code, and be REMANDED FOR FURTHER

Dear Mr. Cocks:
On May 18, 1989, you wrote the building department
notifying us that the structure now dorment because of a "Stop
Order" , is in an unsafe condition. This immediately prompted an
on site inspection by myself and Inspector Curtis Horton.
The building department will lift ONLY that part of the
"Stop Order" to allow you to make the structure safe. We will
require step by step inspections as you go thru the process of
making this structure. safe. That is, when you start the roof
sealing process, call to let. us know. When you start installing
the doors or fastening the. loose panels, call us. The cross
steel reinforcing rods, between piers can be accomplished by
grade beaming, without the necessity of pouring the complete
floor. Your leaders should go to dry wells to prevent any
further damage to the piers or immediate area.
When all unsafe conditions are. rectified, this office will
accept the keys to the then locked building and a Bond or some
type of Financial Security, as you indicated, as a show of good
faith.
Should you have any questions about any of the above
proceedures indicated, please do not hesitate to contact this
office and speak to myself or Senior Building Inspector Curtis
Horton in my absence.
