WHEREAS, the Laurel Links project includes both a subdivision application and a site plan application; and WHEREAS, the subdivision application consists of a proposal for 31 lots; Lots 1-29 are clustered residential lots, Lot 30 is a 2.39 acre parcel shown as a Golf Course Maintenance area, Lot 31 is a 154.66 acre parcel shown as a Golf Course; and WHEREAS, the site plan application consists of the Golf Course Maintenance Area which is to be located on Lot 30 and the Golf Course, which includes a club house, parking areas, a pool, tennis courts, maintenance buildings, a pump house, a halfway house and a Superintendent's Residence, all to be located on Lot 31; and WHEREAS, the Planning Board and the Planning Board's Consultant, Charles Voorhis of Nelson, Pope &Voorhis, LLC, have reviewed the EAF Part III which was submitted in connection with the above-referenced project; and Laurel Links - 3/6/00 - Page Two WHEREAS, the EAF Part III indicates that implementation of certain mitigation measures will occur during the site plan and subdivision review process; and WHEREAS a list of the mitigation items and the recommended mechanisms by which each mitigation should be implemented is included in the report dated February 17, 2000, prepared by Charles Voorhis; and WHEREAS, the Planning Board will ensure that the implementation of certain design, maintenance and operational practices, as outlined in the February 17, 2000 report, are incorporated into the project by including the design, maintenance and operational practices as part of any approval of the subdivision or site plan; and WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard Young, of Young and Young, there was a typographical error in regard to the area of the Golf Course Lot (Lot#31). The correct area is 154.66 acres, and the correction in no way effects the yield or any other aspect of the project. All future plans will reflect the corrected lot area; be it therefore RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, assumes lead agency, and as lead agency makes a determination of non-significance, and grants a Negative Declaration. The reasons supporting the Negative Declaration are outlined in the Negative Declaration. RESOLUTION #2: This motion pertains to the subdivision application. WHEREAS, the Yield Plan dated April 21, 1998, shows 29 residential lots in addition to the Golf Course lot for a total of 30 lots; and WHEREAS, one of the 29 lots shown on the Yield Plan dated April 21, 1998 (Lot#3 on Yield Plan) is proposed as Golf Course Maintenance on the Cluster Plan dated January 19, 2000 (Lot#30 on Cluster Plan) and therefore can not be counted as part of the density for a residential lot; and WHEREAS, since the subdivision proposal is for a total of 31 lots: 29 residential lots in addition the Golf Course lot (Lot#31 on Cluster Plan) and the Golf Course Maintenance lot (Lot#30 on Cluster Plan), the yield shown on the cluster subdivision plan exceeds the Yield Plan by one (1) lot; and Laurel Links - 3/6/00 - Page Three WHEREAS, the Planning Board reviewed this fact, and determined that for density purposes, there was sufficient area within the Golf Course parcel to allow for another 2 acre residential lot; and WHEREAS, the Planning Board decided that they would not require that the Yield Plan be revised to show the additional 2 acre lot, but that they would require that the applicant revise the cluster plan to include an additional 2 acres of Open Space to account for the density of the additional 2 acre lot; and WHEREAS, the original cluster plan was revised, and the Cluster Plan dated January 19, 2000, includes an additional 2 acres of Open Space; and WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard Young, of Young and Young, there was a typographical error in regard to the area of the Golf Course Lot (Lot#31). That no construction or work vehicles shall use the proposed emergency access, and the emergency access shall only be used for fire and other emergency purposes (not for general public or private use); and WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard Young, of Young and Young, there was a typographical error in regard to the area of the Golf Course Lot (Lot#31). The correct area is 154.66 acres, and the correction in no way effects the yield or any other aspect of the project. All future plans will reflect the corrected lot area; BE IT THEREFORE RESOLVED that the Southold Town Planning Board grant sketch approval on the map dated January 19, 2000 with the following conditions: 1. There shall be no further subdivision of any lot within the subdivision, including the Golf Course Lot (Lot#31), in perpetuity. This restriction must be included in a Declaration of Covenants and Restrictions. 2. The emergency access shall be 15' wide and shall be used for access to the Superintendent's House and for emergency purposes only. All conditions of the ZBA decision shall apply to the emergency access. 3. Open Space Parcel "B" shall be revised so that the outermost boundary of the open space parcel is at least 75' feet from the wetland area. The following items must be addressed before the preliminary hearing will be scheduled: A. There are 4 areas of Open Space included in the proposal. (North side LIRR, surrounding residential development and surrounding wetland area.) The open space parcels have been created as part of the cluster requirements. In accordance with the cluster regulations, there shall be no development or structures allowed within the open space areas. Draft restrictions for each area of Open Space must be submitted for the Planning Board's review and approval. B. The LIRR separates the Golf Course Maintenance Lot from the Golf Course Lot. The proposal includes 6 tax lots. Three of the parcels are contiguous parcels on the south side of the Long Island Rail Road. The Planning Board will be requiring that the tax lots be merged prior to any final approval. The deed for a parcel located on the south side of Peconic Bay Boulevard (SCTM# 1000-128-6-3) was submitted with the Laurel Links application. The applicant has stated that they own a half interest in this bay-front parcel with the Delmar Drive Civic Association, and that they will convey the beach front to the civic association and surrender any right to use that parcel. The Planning Board will be requiring that this be completed prior to any final subdivision approval. The Planning Board has reviewed the property and has decided that it is inadequate in size for a reservation of land for park and playground use. The Part III has been amended to include further analysis of Archaeological Resources and Groundwater Resources in addition to the prior issues addressed including topography/grading, geology/soils, ecology/wetlands, transportation and land use/zoning. Based on this review, and provided the.Planning Board is in agreement, we believe .that the project will not cause a significant adverse impact 'on `the environment. The following are the reasons that support- this conclusion: 1. Topography and Grading. The cut and fill quantities on site will be balanced such that there will be no importation or exportation of material. The Town has received a subdivision 'plan'and a site plan which will be subject.to detailed engineering and drainage review to ensure that the project conforms with Town drainage:and grading requirements.'. . 2.. Geology and Soils. The site plan includes drainage and erosion:control measur..es'to ensure-thai erodable.soils do not cause sediment transport or sedimentation. Natural buffers are provided around sensitive site features.such as wetlands, and all.buffers will be maintained within open space parcels, while erosion control measures will be implemented as part of the site development plan. The project will include the preparation of a Storm Water Pollution Prevention Plan to be incorporated into site plan applications. 3. Ecology and Wetlands. Based on the plan 38.49 acres of open space will be preserved on the subject parcel. A 20.09 acre area will encompass the freshwater wetland feature at the southwest part of the site, with substantial setbacks and buffer area protection included. No activity will be permitted to occur within 75, feet of the wetlands, a setback area that will be preserved as a naturally vegetated buffer. The action is not expected to require a Town Trustees wetlands permit under Chapter 97 as activity is 75 feet from the wetlands; however, the Trustees should be contacted to verify this. The _action will require a NYS Department of Environmental Conservation Wetlands Permit under. Article 24, prior to any activity occurring with 100 feet of NYS designated freshwater wetlands. Water Resources. A detailed Integrated Turfgrass Management Plan was developed including appropriate pest management practices, fertilizer management practices, soil sampling and risk assessment. The Superintendent of the golf course will follow best management practices using the Integrated Turfgrass Management Plan. Potential impacts were evaluated using mass-balance nitrogen load simulation and a complete groundwater resource evaluation, and it was determined that the project would not adversely affect groundwater. Surface water would be created on the site in the form of ponds, and existing surface water and wetlands on site would be buffered. The owner/operator of the golf course will enter into joint agreement with the Town and the Suffolk County Water Authority for continued groundwater monitoring of the golf course. 5. Historic/Archaeological Resources. A Stage IA/IB cultural resource assessment was completed including archival search and systematic subsurface testing of the property with screening of soils for cultural evidence. No significant cultural material was found and based on a study which conforms to recognized methodologies, it was concluded that the project would not impact historic or archaeological resources. 6. Transportation Resources. Project generated traffic was determined using trip generation factors applied to the development components. The site access is not at a congested location and adequate sight distance and.road curvature is present in the design to allow safe ingress/egress:at- the site. The NYS Dept. of Transportation will review and approve the road opening application. 7. Land Use and Zoning. The density of the project is consistent with zoning. The residential use is clustered to provide surrounding open space. Overall 38.49 acres of open space will be preserved, not including the golf course. The golf course use will minimize structural improvements on the site and will provide an appropriate transition with.adjacent uses. Attached for your consideration, please find a draft Negative Declaration for the Laurel Links project. Please review this document, and utilize same for the completion of the SEQRA process by adopting it and filing it in accordance with.-the Notice and Filing Requirements contained in Part 617, or feel free to contact me to review any questions you may have. The Part III indicates that implementation.of certain mitigation measures will occur during the site plan review process. In addition, the implementation of certain design, maintenance and operational practices that are incorporated into the project as mitigation, relies on further action of the Board to-ensure completion. As a result, we have prepared a list of these items and the recommended mechanism by which each mitigation should be implemented. 1. A comprehensive soil testing program shall be performed-on those areas of the site which had been farmed, in order to determine whether long-term agricultural chemical usage has impacted these soils to a significant degree. The NYS Department of Health guidelines for such programs shall be utilized in this procedure. The Planning Board approval could make this a condition of approval. We have expertise in reviewing and performing this type of study, and can assist. This program should be performed after Planning Board approval and prior to onset of construction activities. 2. The Applicant shall undertake the recommended test well monitoring program described in the SCWA letter (dated July 20, 1999), and in the July, 1999 document, "Ground Water Resource Evaluation for The Laurel Links Residential Development and Golf Course, Southold, New York" (prepared by CA Rich Consultants, Inc.; both items contained in the revised EAF Part III). This test well monitoring program would be satisfied by the groundwater monitoring program described in Item 4 below. Page 2 �7 Laurel Links Laurel,Town of Southold 3. The project will require a NYSDEC Freshwater wetlands permit. Activity appears to be 75' from the freshwater wetlands in the area of the 8 h hole. While we believe that a permit would be issued, we would prefer to see grading removed to no closer than 100' to wetlands. The wetlands line must be accepted by NYSDEC and a permit or letter of no-jurisdiction is needed. In addition, any activity within 75' requires a permit from the Southold Trustees under Chapter 97. The Planning Board approval should make note of the need to obtain State and Town permits. 4. The Applicant shall provide a framework for a groundwater monitoring program to ensure that accountability for potential impacts to groundwater quality due to use of golf course-related chemicals is provided. This program shall be undertaken and funded by the Applicant, via a three- party contract between the Applicant, the Town-and SCWA. An example of such a contract is attached, and I understand that you spoke with SCWA and they are willing to assist with such a program. Attached is a format for such a contract that has been used by SCWA in the past. The monitoring program should include a specific procedure whereby the Town and SCWA are regularly issued the results of golf course monitoring well tests. Notification will include the type(s), amounts, .locations, areal extent, purpose and any other information deemed appropriate in regard to the application of chemicals performed since the previous issuance of test results, to enable the correlation of chemical use and groundwater quality impacts, if any. This program could be made a condition of Planning Board approval, requiring the Applicant to enter into a program with the SCWA and Town. 5. All the recommended procedures specified in the Integrated Turfgrass Management Program (ITMP) shall be followed; these include the procedures regarding the storage, preparation, application and disposal of wastes related to fertilizers and/or pesticides. Implementation of these procedures shall be made a part of the'three-party contract between the Applicant, the Town and-SCWA. 6. The Applicant shall be responsible for the preparation and adherence to the Storm Water Pollution Prevention Plan (SWPPP), to be prepared prior to the onset of construction, and which procedures shall apply throughout the construction and occupation phases. This shall be made a part of the Town's review of the Grading Plan, during the Site Plan review process. We will include this in our comments on the grading and drainage plan,but you may wish to notify the Applicant to be sure this is included on the plan. 7. To the greatest extent practicable, the Site Plan shall feature the Applicant's proposed "balance" of . excavated soils, so that no soils shall be removed from the site. This shall be'made a part of the Town's review of the Grading Plan, during the Site Plan review process. 8. As specified in the EAF Part III, surface soils disturbed by grading operations shall be stockpiled and properly protected from erosion, until such time that this material can be replaced for landscaping purposes. This shall be made a part of the Town's review of the Grading Plan, during the Site Plan review process. 9. As recommended in the document, "Ground Water Resource Evaluation for The Laurel Links Residential Development and Golf Course, Southold, New York" (prepared by CA Rich Consultants, Inc. as part of the revised EAF Part III), the following mitigation measures shall be provided by the Applicant, for the existing and/or any future on-site irrigation wells • The well depths should be accurately measured; The wells should be pump-tested to determine their true yield; • The wells should be registered with the NYSDEC; and, Page 3 YJ Laurel Links Laurel,Town of Southold • The chloride concentration should be monitored closely. The following was recommended by the Applicant in the Part III document: Development of a local hydrologic baseline is suggested to determine whether the planned irrigation system will have any significant adverse impacts upon the water levels and water quality of nearby, off-site homeowners' wells. This mitigation measure shall be provided, as part of the three-party contract between the Applicant, the Town and SCWA. 11. As recommended in the document, "Addendum Number 1, Ground Water Resource Evaluation for The Laurel Links Residential Development and Golf Course, Southold, New York" (prepared by CA Rich Consultants, Inc. as part of the revised EAF Part III), the following mitigation measures shall be provided for the existing and/or any future on-site irrigation wells: We do suggest that the irrigation demand experienced at the Laurel Links, following its full build- out,be thoroughly metered, and periodically sampled, to establish an actual physical record of the quantity(and continued quality) of long-term pumpage. This mitigation measure shall be provided, as part of the three-party contract between the Applicant, the Town and SCWA. 12. The Applicant shall provide the.additional vegetation enhancement in the buffer along the wetland system in the northeastern corner of the property, as specified in the revised EAF Part III. We recommend that the Applicant be advised that a detailed landscaping plan is required. The landscape plan should identify ground cover, maintenance practice, revegetation of buffers, plant-soil stabilization,particularly near the 8`'hole where grading will occur in proximity to wetlands. Implementation of the above-listed mitigation measures via the recommended mechanisms would allow for the development of the site while protecting the natural and human resources of the Town. The Laurel Links project is a model development in terms' of open space, wetlands protection, recreational opportunities, and residential housing opportunities at a reduced yield in an attractive setting. The development must occur in a sensitive manner, and the maintenance and operation of the.golf course is critical to maintaining environmental quality. Voo is, Managing Partner Page 4 o Nn, ATV GROUNDWATER MONITORING AGREEMENT This agreement is made on . 1998 between ,'hereinafter"Owner") and the Suffolk County Water Authority, 4060 Sunrise Highway, Oakdale, New York (hereinafter"SCWA"). For the consideration subsequently named and in consideration of the approval of the use of the premises, hereinafter referenced, as a golf course with Declarations of Covenants and Restrictions, attached hereto and made part hereof, the parties.agree as follows: Section I Groundwater Monitoring System Owner shall install, maintain and operate on the premises described in Schedule A, attached hereto and made part hereof, consisting of a golf course and related facilities, presently located at ,County of Suffolk, State of New York, at Owner's sole expense, groundwater monitoring wells at locations pursuant to Findings of the Town of attached hereto and made part hereof,and pursuant to the specifications described in Schedule D attached hereto and made part hereof, and referred to as the groundwater monitoring system or the system. The groundwater monitoring system shall be sufficient to determine the effects. if any, of the landscape maintenance program on the groundwater at, under and emanating from said premises. Section II Entry on Premises Owner authorizes and empowers SCWA and its employees, agents or assigns to inspect the installation of the groundwater monitoring system on said premises and to make any inspections or tests of the system and to draw and test samples from the system, and for that purpose the SCWA shall have access to Owner's premises upon twenty-four hours notice prior to time of entry. Section III Inspection and Repair SCWA may make any inspections necessary to monitor the system. Owner shall make all inspection necessary for the upkeep of the system and shall make adjustments or repairs or otherwise correct any defects that may appear in any part of the system. Expenses for such upkeep to the system shall be paid by Owner. F Section IV Alteration or Restoration of Groundwater Monitoring System Equipment Owner shall use diligence to prevent any accident or interference with any of the parts or equipment of the groundwater monitoring system. If any part of the system is damaged or interfered with by any act not the fault of the SCWA, or if any change in the premises or use of the premises introduces new or special conditions, or if any alterations are made that may affect the operation or effectiveness of the system, Owner shall make such alterations to the system as are necessary to the system and shall pay the costs therefor. Section V Additions and Alterations to Premises If the groundwater monitoring system originally provided for under this agreement is rendered a partial or substandard system by additions or alterations to the premises, the system shall be expanded to cover such additions or alterations to the premises. Expenses for such alterations to the system shall be paid by Owner. Section VI Monitoring Schedule and Reporting Owner shall take samples from each groundwater monitoring well in accordance with the schedule prescribed by the Town of to detect any possible contamination due to the use of the premises as a golf course. If any groundwater monitoring well or wells show evidence of contamination due to the use of the premises as a golf course, more frequent monitoring may be required as reasonably determined by the SCWA. Notwithstanding the above, if any groundwater monitoring well or wells show evidence of contamination, a repeat sample will be taken to verify the existence of such contamination. Owner shall notify the SCWA and the Town of of the results of all monitoring tests and shall provide all laboratory documents related to such tests upon reasonable request. Section VII Enforcement If any test of the groundwater from said groundwater monitoring system, as confirmed by a repeat sample pursuant to Section VI, shows contamination that exceeds any standard or advisory for drinking water as established by the United States Environmental Protection Agency, the New York State Department of Health, the Suffolk County Department of Health Services, or any governmental agency with jurisdiction to establish drinking water standards in Suffolk County. due to the use of the premises as a golf course,Owner agrees to abate the activity that, upon reasonable inquiry, is determined to have caused or is determined to be the likely cause of such exeeedance. Owner agrees to cooperate with any such reasonable inquiry. Any inquiry or determination under this section shall be made by the Owner, its agents or assigns. Owner further agrees to remediate, at its own expense, any contamination caused by the use of the premises as a golf course to a level that no longer exceeds such standard or advisory. The Town of shall have any action at law or in equity available to it to enforce the terms of this agreement. Owner, its successors and assigns, shall be strictly liable for any damages incurred by the SCWA, its successors and assigns, resulting from the use of the premises as a golf course. Section VIII Arbitration Any disputes arising under this agreement pertaining to the installation,maintenance or condition of the groundwater monitoring system or pertaining to the frequency, accuracy, fees or costs of monitoring or testing between SCWA and the Owner shall be arbitrated by the American Arbitration Association or other agreed upon dispute resolution organization. Section IX Term of Agreement,Assignability This agreement shall remain in effect for so long as the premises or any part thereof shall continue to be used as a golf course and for a reasonable time thereafter so as to determine any latent effect of the prior golf course use. Owner may assign its rights or delegate its duties under this agreement only upon written consent of the Owner and SCWA. This agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. Section X Interpretation Regardless of any contrary rule of construction, no provision of this agreement shall be construed in favor of one of the parties because it was drafted by the other party's attorney. No alleged ambiguity in this agreement shall be construed against the party whose attorney drafted it. The application has been reviewed pursuant to the Criteria for Determination of Significance contained in Part 617.7. The Part III includes extensive data and analysis of the potential impacts associated with the proposed project. The document analyzes topographic and grading impacts, site ecology and habitats including wetlands, potential groundwater and surface water impacts, archaeological resource issues, transportation issues and land use and zoning, and also provides mitigation measures to minimize potential impacts that are inherent in the project. 3. Topography and Grading. The cut and fill quantities on site will be balanced such that there will be no importation or exportation of material. The Town has received a subdivision plan and a site plan which will be subject to detailed engineering and drainage review to ensure that the project conforms with Town drainage and grading requirements. 4. Geology and Soils. The site plan includes drainage and erosion control measures to ensure that erodable soils do not cause sediment transport or sedimentation. Natural buffers are provided around sensitive site features such as wetlands, and all buffers will be maintained within open space parcels, while erosion control measures will be implemented as part of the site development plan. The project will include the preparation of a Storm Water Pollution Prevention Plan to be incorporated into site plan applications. 5. Ecology and Wetlands. Based on the plan 38.49 acres of open space will be preserved on the subject parcel. A 20.09 acre area will encompass the freshwater wetland feature at the southwest part of the site, with substantial setbacks and buffer area protection included. No activity will be permitted to occur within 75 feet of the wetlands, a setback area that will be preserved as a naturally vegetated buffer. The action is not expected to require a Town Trustees wetlands permit under Chapter 97 as activity is 75 feet from the wetlands; however, the Trustees should be contacted to verify this. A landscape plan will be required as part of the site plan review process to ensure that appropriate species and transitions between surface water and turfed areas are provided. 6. Water Resources. A detailed Integrated Turfgrass Management Plan was developed including appropriate pest management practices, fertilizer management practices, soil sampling and risk assessment. The Superintendent of the golf courase will follow best management practices using the Integrated Turfgrass Management Plan. Potential impacts were evaluated using mass-balance nitrogen load simulation and a complete groundwater resource evaluation, and it was determined that the project would not adversely affect groundwater. Surface water would be created on the site in the form of ponds, and existing surface water and wetlands on site would be buffered. The owner/operator of the golf course will enter into joint agreement with the Town and the Suffolk County Water Authority for continued groundwater monitoring of the golf course. 7. Historic/Archaeological Resources. A Stage IA/IB cultural resource assessment was completed including archival search and systematic subsurface testing of the property with screening of soils for cultural evidence. No significant cultural material was found and based on a study which conforms to recognized methodologies, it was concluded that the project would not impact historic or archaeological resources. 8. Transportation Resources. Project generated traffic was determined using trip generation factors applied to the development components. The site access is not at a congested location and adequate sight distance and road curvature is present in the design to allow safe ingress/egress at the site. The NYS Dept. of Transportation will review and approve the road opening application. 9. Land Use and Zoning. The density of the project is consistent with zoning. The residential use is clustered to provide surrounding open space. Overall 38.49 acres of open space will be preserved, not including the golf course. The golf course use will minimize structural improvements on the site and will provide an appropriate transition with adjacent uses. Based upon a detailed evaluation of the potential impacts of the proposed project, and in comparing the project and this evaluation to the criteria for determining significance contained in SEQRA Part 617.7, it is determined that the project will not cause significant adverse impact on the environment and a Negative Declaration should be issued.
