This site plan has been prepared by the office of John Metzger, L.S. and has a revision date of August 23, 2004. This site referenced herein is pre-existing and the Owner has filed for formal site plan approval from the Planning Board in an effort to bring the site into compliance with Town Code. Due to the fact that the Owner has not proposed any major changes or development of the site, I will review and comment on site plan issues related to drainage that can be reasonably achieved. Drainage calculations have provided for Parking Lot areas that have been numbered one,two&three on the most recently revised plan. These calculations and proposed drainage for the site attempt to reduce storm water runoff generated by hardened surfaces from entering the tidal wetlands. The proposed trench drains along the entrances to the Town roads and the proposed leaching pools will be a substantial improvement from the existing conditions. All parking lot surfaces,where practical,should be graded away from the tidal wetland and diverted into the proposed new leaching system. Proposed trench drains should also be connected to the new leaching pools. The drainage calculations provided and the proposed drainage design represents what appears to be a reasonable attempt to provide adequate containment of storm water run-off generated by the facility. At this time, I would also like to bring your attention to the two existing Highway Department drains located immediately adjacent to the site on West Creek Avenue. These drains are connected to culvert pipes that extend through the existing bulkheads of the Marina. Currently, it is not the practice of the Town to create this type of drainage that would discharge directly into the tidal water. However in this case,due to pre-existing site conditions, it would not be possible for the Town Highway Department to maintain safe roads or provide access to adjacent property if these pipes were to be removed.Therefore, at the request of Mr. Harris and the Highway Department, please consider the inclusion of the following requirement for site plan approvals. Please request the applicant to provide two - Fifteen (15') foot wide Drainage Easements centered on each of the existing culvert pipes to allow for the continued maintenance of these pipes by the Town Highway Department. Due to the fact that the Owner has not proposed any major changes or development of the site, I will review and comment on site plan issues related to drainage that can be reasonably achieved. Drainage calculations have provided for Parking Lot areas that have been numbered one,two&three on the most recently revised plan. These calculations and proposed drainage for the site attempt to reduce storm water runoff generated by hardened surfaces from entering the tidal wetlands. The proposed trench drains along the entrances to the Town roads and the proposed leaching pools will be a substantial improvement from the existing conditions. All parking lot surfaces,where practical,should be graded away from the tidal wetland and diverted into the proposed new leaching system. Proposed trench drains should also be connected to the new leaching pools. The drainage calculations provided and the proposed drainage design represents what appears to be a reasonable attempt to provide adequate containment of storm water run-off generated by the facility. At this time, I would also like to bring your attention to the two existing Highway Department drains located immediately adjacent to the site on West Creek Avenue. These drains are connected to culvert pipes that extend through the existing bulkheads of the Marina. Currently,it is not the practice of the Town to create this type of drainage that would discharge directly into the tidal water. However in this case,due to pre-existing site conditions, it would not be possible for the Town Highway Department to maintain safe roads or provide access to adjacent property if these pipes were to.be removed.Therefore,at the request of Mr.Harris and the Highway Department,please consider the inclusion of the following:requirement for-site plan approvals..Please request the applicant to provide two Fifteen (15')foot wide Drainage Easements centered on each of the existing culvert pipes to allow for the continued maintenance of these pipes by the Town Highway Department. Discussion took place that the conditions which exist and carry the road runoff and residential property runoff should not be this property owners problem. In addition the capacity of the drywells needed to contain the runoff based on ground water level would not be possible and still overflow which would force discharge into the creek. It was agreed that the existing runoff problem is not a simple one and will require a long term correction to prevent discharge. Jamie and Peter indicated it would be best to get a 15'wide legal easement of the two pipes. Heather will speak to the Trustees about amending the permit on this condition. Bruno will work on getting a legal easement draft for the Town to maintain the two pipes. This draft will be sent to the Town Attorney for review. Dear Trustees: Our letter of 13 June 2002(Ref#1)detailed our concerns about the non-compliance of the Cutchogue Harbor Marina.The Southold Planning Department/Board has taken action and a site plan is being prepared. In the interim the marina is in the process of being sold, subject to establishment of a Town accepted site plan.The prospective owners have been operating the marina for the past nine months and have been good neighbors. We see their ownership as a good solution to the marina's operation and we have offered to help in achieving a timely closing. We understand that the Southold Board of Town Trustees(SBoTI)will: • Do a field inspection on 7/14/04, • Hold a hearing on 7/21/04, • Over-view the updated"final"site plan from the buyers via.the Planning Department. • Perform a SBoTT file review. We assume a proper site plan and will support your process to encourage expeditious approval.Toward that end we herein review the Fleet's Neck Property Owners Association's Expectations with respect to the jurisdiction of the Trustees. General: Keep it simple/doable in support of a proper site plan that will require future operations to conform to the rules and regulations of the cognizant authorities. Die test of cesspools: The Trustees cesspool permit stipulates that the marina must submit to a dye test to see if there is leakage into the creek.The permit does not say who is to initiate this test. It v` should be done this season by SBoTT request to the Suffolk County Department of Health Services.The SBoTT should repeat the request and assure compliance every five years,at minimum. Pump-out Log Records: The Trustees permit requires these records to be filed with the SBoTT every year.We understand that the previous operators kept no log and may never have used the pump-out rig.The prospective owners require in their contracts with boat owners that their waste systems be sealed thus forcing resident boat waste pump-out.We find this to be significantly better than previous practice and in accordance with current protection bay practices. It should be adequate for the marina to supply pump-out records upon request of the Trustees without a routine report. Bottom Cleaning and Stripping: The prospective owners indicate that they do not plan these operations at this site. However,if at any future time plans change and these operations are undertaken,the waste produced should be decanted and solids disposed of per NYSDEC/USEPA requirements.This should be a requirement of the SBoTT. Other Issues Springing from a SBoTT file review: The Association is not aware of other issues but will promptly react to any that the Trustees determine by file review. The Association believes that our interests are best served by the establishment of a proper site plan and consummation of the sale of the marina to the prospective buyers as soon as possible. Tom Wetzel,Ed Hassildine and Ray Huntington again reviewed the site plan application/file at Town Hall on 4/23/04 The Executive Committee(EC)meeting minutes of 4/8/04 (modified as discussed with immediate neighbors and EC members and Michael Irving and PB Staff) follow: Buyers(NSSY)of CHM have submitted an application with a site plan.After review by the Planning Department(765-1938) it was reviewed on 3/15/04 by the Planning Board with comment on: • Ramp • TravelLift • Road Drainage • Parking • Winter storage The CHM was asked to make some modifications with regard to the above and submit a candidate"final' site plan.A plan dated 4/8/04 was in the Planning Board file. It is believed that the CHM wants to talk with the FNPOA before submitting the"final"site plan and it is our intention to do so. Anticipating such a"final'site plan the EC determined that the guide sheet dated July 2002 remains applicable.A further tentative position regarding measurable limits(modified after review of the file on 4/13/04 thru 4/23/04)was prepared and it follows: General: The file contains an un-attributed metal-clip bound document of about 300 pages primarily covering Lighting,Landscaping and Permits.We shall refer to this compilation as"LLP". The connection of these _ LLP data to the site-plan is obscure.As a group,these important data should be titled/numbered, attributed, dated,subject indexed,page numbered,provided with a coversheet and perfect bound. This document should then be made part of the site plan via a note on the site plan top drawing sufficient to identify the scope of the"attached"document.At a minimum,the Lighting Data and the Landscaping Data(the first 20 pages)should be so prepared and"attached"via drawing note.Any data shortfall in the attachment should be posted directly on the site plan top drawing. Specific comments about the"Lighting Plan"and the"Landscaping Plan"follow under appropriate headings. Lighting: • The LLP,or the lighting part of it, should be made part of the site plan by drawing note as discussed above:The•site-plan drawing should locate and label illumination devices with nomenclature consistent with the LLP data. • Illumination devices are considered to be of three basic types: (1)"Low Lights" (e.g., dock walkway lamps of low wattage), (2)"Bollard Lights" (low-mounted HP.sodium lights within shielding so that light is emitted only in a downward pattern for walkway illumination) and(3)"Floodlights" (high-mounted area lights equipped with shields to control emissions that if unshielded would allow light to directly strike off the marina property and floodlights of the shoebox or street lights style that shine downward.)The Flood Lights are of greatest concern. • The 15t'page of LLP appears to be illumination field notes made either before or after a 1992 correction. Since there is no attribution and the exact date of the observations and the units used and are not stated,this sheet should not be used as part of an"as-built"site plan dated 2004.Note also that there are differences between the site plan top drawing and this sheet. • Regarding direct lighting—light directly emanating from the source of the light(e.g. lamp filaments) shall not be visible from any point not on the marina property. In other words, it should not be possible to see the light emitting surface from off the marina property. • Regarding indirect or reflected light--light reflected off objects on the marina property onto nearby residences shall be screened by vegetation insofar as practical and timed per Town Code. • Lights and ventilation fans shall not be operated during times prohibited by the Town Code. Buffering: The LLP,or the landscape part of it,should be made part of the site plan by drawing note as discussed above. The note should also say that buffering areas shall not be used for operations or storage. The Site plan to clearly delineate and dimension areas to be used for buffering • Since the LLP does not cover the area North of the middle of the North basin,The site plan top drawing should locate and label plantings/fences with detail and nomenclature consistent with the LLP data. • East(street)side: 10 to 15'deep.Natural screening only--4' to 12'with shrubs trimmed as necessary over time. Site plan to show existing and new plantings. • North side: 3 to 5'feet deep.Fence and natural screening as follows: • For first 80 to 100'from the East(from the road): low(e.g.,4') see-thru fence with 4' to 12' cedar or arborvitae plantings on the South of the fence,trimmed as necessary over time. • For the middle 100 to 120% Six foot privacy fence(6"off the ground for passage of wildlife),— plantings optional. • For the West 100% low(e.g.4')see-thru fence with 4' to 12'cedar or arborvitae plantings on the South of the fence trimmed as necessary over time.The new fencing to replace the old fence in the same location but no further North.
