The meeting was called to order by Supervisor Tuthill at 1:30 P .M. with the following present : Supervisor Henry H. Tuthill, Councilmen Albertson and Demarest; Justices Tuthill , Clark and Edwards - Superintendent of --Highways Price ; Town Attorney Tasker and Town perk R cYimorid �. The meeting was opened by the reading of a prayer m by Supervisor Tuthill. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That the minutes of the meeting of December 30; 1959 be and hereby are duly approved as read; Vote of Town Board: Ayes- Councilmen Albertson and Demarest; Justices Tuthill, Clark ,and Edwards . Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED That the resignation of Fire Inspector of Fishers Island, William N. Pyle , effective December 31, 1959 , be accepted by the Town Board. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards . Moved by Councilman Albertson; Seconded by Justice Clark: WHEREAS , It is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix the salaries of all Town elected officers at an amount not in excess of the amounts respectfully specified in the notice of hearing on the preliminary budget , published pursuant to Section 113 of the Town Law, nowtherefore be it RESOLVED , That the salaries of the following Town elected officers be and hereby are fixed at the following amounts :- Supervisor Henry H. Tuthill , Supervisor , be and he hereby is authorized to act as Public Welfare Officer at the pleasure of the Town B.oard,; and be it further RESOLVED, That Henry H. Section 148 of the Education Law that a local Historian shall be appointed by the Supervisor of a Town, and WHEREAS , The Supervisor has appointed Wayland Jefferson to act as Town Historian, now therefore be it RESOLVED , That Wayland Jefferson be compensated while acting in such capacity in the amount of Five Hundred Dollars ($500.00) per year , payable in regular monthly payments , and be it further RESOLVED That the expenses incurred per year by the Town Historian in the performance of his duties be paid by the Town in an amount not to exceed kkK One�'Hundred Fif:ty_.Dollars and be it further RESOLVED, That the Town Clerk •be instructed to file such certificate T,,,ith the proper parties as is required by Section 30, Subdivision 3., of the Town Law. Terry, be and he hereby is , appointed enforce- ment officer for both the Multiple Resident Law and the said ,Building Zone Ordinance for a term of one year , commencing January 1 , 1960 and expiring on December 31, 1960 and be it further RESOLVED, That the total salary for both positions be and hereby is fixed at the sum of File thousand two hundred dollars ($5,200.00) , per year, payable in regular monthly payments during said term and be it further RESOLVED, That the Town Clerk be instructed to file such certificate with the proper parties as is required by Section 30, Subdivision 3 , of the Town Law. Terry, enforcement officer of the Multiple Resident Law and Building Zone Ordinance , be compensated for travel expense necessarily and actually incurred in carrying out the duties of his office and that he be further compensated for the use of his own automobile when used to carry out the duties of his office 'at a rate not exceeding eight cents ( .08) per mile. Vote of Town Board: A"yes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill , Clark and Edwards . 24 Moved by Councilman Demarest; Seconded by Justice Edwards : WHEREAS , Section 22b of the Town Law allows the Town Board of any Town having more than one assessor to establish the office of Chair- man of Town Assessors , who in addition to his regular duties shall perform such services in connection with assessment and taxation of property for State, County and town purposes as the Town Board shall direct , now therefore be it RESOLVED, That Albert Martocchia be and hereby is designated to hold the office of Chairman of the Town Board of .Assessors until the first day of January next succeeding such designation, all in accordance with Section 22b of the Town Law, and be it further RESOLVED, That compensation for such appointment be fixed at $1 , 500.00 per year, payable in regular monthly payments. Moved by Justice Edwards; seconded by Justice Tuthill: WHEREAS , It is required by Section 27, Subdivision 1 , of the Town Law that the Town Board fix the salaries of all town appointed. officers or employees , now therefore be it - RESOLVED, That the salaries of the members of the Planning Board, Toan of Southold, be and hereby are fixed at $500.00 per year , with the exception of the Chairman of the Planning Board, whose salary be and hereby is fixed at $600.00 per year, and be it further RESOLVED, That the members of the Planning Board and the Chairman of the Planning Board be paid these salaries for their respective offices , and that these salaries be paid in regular monthly pay- ments , 'and be it further RESOLVED, That the Town Clerk be instructed to file such certificate with the proper parties as is required by Section 30, Subdivision 3 of the Town Law. Moved by Councilman Demarest; seconded by Justice Clark: RESOLVED That all the foregoing salaries , except Police Patrolmen (Constables) and Watchmen be effective as of January 1 , 1960. Vote of Town Board: Ayes-Supervisor Tuthill ; Councilmen .Albertson and Demarest; Justices Tuthill , Clark and Edwards , Moved by Councilman Demarest; seconded by justice Clark: WHEREAS , Section 64 of the Town Law requires the Town Board to designate by resolution banks in this State in which the Supervisor or any other officer of the Town shall deposit all monies coming into their hands by virtue of their offices , and WHEREAS , The Town Board may require any Bank so designated to deposit with such Board the Bonds or-Certificates of the United States , of the State of New York, or any County, Town, City , Village or School District of the State of New York as security for such funds 'so deposited but such bonds or certificates shall be subject to the approval of the.. Moved by Justice Clark; seconded by Justice Edwards : WHEREAS , Section 62 of the Town Law requires that every Town Board shall meet on or after the 28th day of December, but not later than the 31st day of December , in each year , and WHEREAS , There is no other time specified by law when meetings of' the Town Board of a Second Class Town shall be held, now therefore be it RESOLVED, That the Supervisor be and here is empowered to call all meetings of the Town Board as may be required for the best interest of the Town, and be it further RESOLVED, That the Supervisor designate Tuesday as the day of the week for calling such meetings , and be it further RESOLVED, That each member of the. Town Board be given at least 2 days notice in advance of such meeting, notice to contain the time and place where such meeting is to be held. Moved by Justice Tuthill; seconded by Councilman Demarest: RESOLVED; That the .Assessors of the Town of Southold who use their own automobiles in the performance of their duties for the Town will be compensated for the use of such automobiles in the amount not exceed eight cents ($.08) per mile. Moved by Justice Clark; seconded by Councilman Demarest: RESOL-VED, That the Long; Island Traveler , Mattituck Watchman, Southold , New York, be and hereby is , effective as of February 1, 1960, designated as the official newspaper. to publish the notice of the Receiver of Taxes that he is in receipt of such tax and assessment roll and warrants , and that the taxes and assessments therein may be paid to the Receiver at the times and with ,penalty other than his principal office when and where he will attend for the receipt of taxes and assessments in accordance with Section_ 22 of the Suffolk County Tax .Act , and all other legal notices as may be necessary and required in accordance with Section 64, Sub- division 11 of the Town Law. RESOLVED That the Southold Town Superintendent of Highways be and he hereby is 'authorized to purchase for the use of the Town, equipment , tools , snowplows and other implements and devices without prior approval of the Town Board of the Town of Southold in an amount not to exceed Five Hundred °($500.00) Dollars during the period January 1 , 1960 to December 31 , 1960. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, The Commissioners of the Fishers Island Ferry District have entered into a lease with the New York, New Haven and Hart- ford Railroad leasing certain portions by the Ferry District in New London for a term of 10 years at an annual rental of $100.00; subject to the approval of the Southold Town Board. Now Therefore Be It RESOLVED, that the Town Board of the Town' of Southold does hereby approve of the action taken by the Board• of Commissioners o-f Fishers Island Ferry District and hereby authorize and direct the Supervisor of the Town of Southold to approve said Lease . Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS , the Board of Commissioners of the Fishers Island Ferry District has by contract retained the firm of Johnson, Dougherty & Williams of New London, Conn. to perform auditing and accounting,' service for said District effective January 1 , 1960 to December 311 1960, at the annual fee of $900.00 to be paid quarterly. NOW THEREFORE BE IT RESOLVED , _That' the Southold Town Board approves said contract and hereby authorizes and empowers the. Supervisor of the- Town of Southold to execute said contract . Griffin, Sr . be engaged under contract to provide a mail transfer and haulage service for the Fishers Island Ferry District for the ,period January 11 1960 thr,ough ,Dec- ember 31, `1960 inclusive , in accordance with the terms and con- . ditions as prescribed by the Board of Commissioners . AND BE IT FURTHER RESOLVED, That the effective date of such service shall be January 1, 1960 and the amount of compensation for such service , shall be One-hundred Fifteen Dollars ($115.00.) per month, payable monthly. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS the Manager of the Fishers Island Ferry District has sub- mitted the name of Carl Christensen for the ,position titled Junior Clerk of the Fishers Island Ferry District . BE IT RESOLVED , That Carl Christensen is hereby -appointed Junior Clerk of the Fishers Island Ferry District with compensation of $1.25 per hour as established by resolution dated September 13 , 1956. Said compensation to be payable on a monthly basis and not to exceed the annual sum of $700.00 and be it further RESOLVED that said appointment be effective January 1 , 196o. Tuthill be authorized ,to attend New York State Supervisorst Meeting_ to be held at Rochester , N.Y. January 18 to 20, 1960. RESOLVED, That necessary expenses incurred while attending such meeting is, a legal charge against the Town.. Registration fee not to exceed $5.00. St..Amand be compensated for said employment at the rate of $3 ,800.00 per annum. RESOLVED, That Supervisor Tuthill also be authorized to employ part time help subject to budget , not to exceed $1,, 500.00 per a nnum. Moved by Councilman Demarest ; seconded by Justice Tuthill: Whereas the Town Board of the Town of Southold , ;Suffolk County, New York, being apprised of the increase of Golden Nematode, infestation of the farm land of. Southold Town and also in the farm land of other towns of Suffolk County, and furthermore that this infestation poses a serious threat -to the economy and well being of the residents of Southold Town and the other towns of Suffolk County be it RESOLVED That the Town Board of the Town of Southold does strongly urge .that the State of New York and the United States Government , not only continue the present program for the .control and eradication .of the Golden Nematode. but also , expand and expedite this program so that this serious - threat to the agriculture of this area as well as the whole nation may be speedily and permanently elim&nated, furthermore be it RESOLVED, That copies of this resolution be sent toAssemblyman Irving Price and State Senator Elisha Barrett , Congressman Stuyvesant Wainright and U.S . Senators Kenneth Keating and Jacob Javits and also to the Board of Supervisor s of Suffolk County so that the rest of the towns of the county may be apprised of the serious situation and take appropriate action. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED, That General Bills in the amount of $5,716. 53; Lighting District Bills in the amount of $340.15; and Fishers Island Ferry District Bills in the amount of $8,769.68 be and the same are hereby ordered paid. Now therefore be it RESOLVED, That the Southold Town Building Zone Ordinance including the Building Zone Map be amended by the Town Board on its own motion as follows : 1. By changing from "A" Residential and Agricultural District to "C" Industrial District the following described property: ALL that certain tract or parcel of land situated at Mattituck, in the Town of Southold, Suffolk County, New York, and more par- ticularly bounded and described as follows : Beginning at a point on the northerly line of Naugles Drive at the southeasterly corner of the existing "C" Industrial Zone and runn ing thence along said "C" Industrial Zone northerly about 200 feet , then easterly about 400 feet , then northerly about 200 feet to Mattituck Creek; thence easterly along said Mattituck Creeek about 250 feet to the northwesterly corner of the exist- ing "B" Business Zone ; thence along said existing "B" Business Zone southerly about 310 feet, then westerly about 60 feet , then southerly about 431 feet to the northerly line of said Naules Drive , thence westerly along said line of Naugle- Drive about 950 feet to the , point of beginning. .ALL as shown on a certain map ; en'titled "Part of Stanley Naugles Property, Mattituck, N.Y." pre ared by Otto W.
