Also submitted simultaneously is a building permit for the "notice of disapproval" from the building departement directing us to obtain site plan approval for the agricultural structures. The subject subdivision is known as "The fields at Mattituck" and lot 27 was established for use of a residence and residential accessory structures on the one acre reserve area, with the balance of the parcel for agricultural uses. The agricultural land was not purchased with public funds. The subdivision final plat was approved in 2004, at that time the agricultural parcel was cleared and farmed (fallow farmland). The proposed agricultural uses are the same uses which are currently operated on other parcels on Bergen Avenue. From west to east on Bergen Avenue are large farm parcels with existing vineyards, field crops, and horses. An adjacent parcel (1000-113-1-3.1) is owned by Macari Farms LLC with vines. To the west, on Bergen Avenue, are several horses and pastures. There are development rights sold lots and in tact lots, many of the parcels are owned by the Macari family which operate the winery on the comer of Bergen Avenue and CR 48. My client purchased the parcel from the developer of The Fields at Mattituck (Macari). The recorded Planning Board C&R's clearly permit the proposed agricultural uses on the parcel. Also specifically permitted are farm buildings in support of the agriculture. My client relied on the express language of the C&R's and the character of the surrounding agricultural parcels operating the same use as those proposed herein. The applicant has shown a vineyard and horse farm on the site plan. In support of these agricultural uses is a proposed stable (10 horses), proposed small structure for manure collection, a proposed farm storage structure (equipment and materials storage) and proposed building for wine processing. No winery, only agricultural processing (grapes to wine) is proposed. These are all permitted uses, with structures that are reasonable and necessary to support the proposed agricultural uses. A building permit was issued for the house and inground pool on the reserve residential acre. We respectfully request that the Board approve the location of the proposed agricultural structures on the site plan in order to obtain a building permit for construction of the agricultural structures. Timing of construction of the agricultural structures will be concurrent with preparation of the land for planting of the vines and the horses.
