Approximately nine(9)product piping soil endpoint samples are anticipated to be collected along the piping
run from.the UST field to the dispensers.
Approximately one(1)vent line soil endpoint sample will be collected under the vent stack.
01 Liquid,residue and all sludge must be removed from the tank(s)and all connecting lines.
• All piping associated with the tank(s)must be disconnected and removed,or cleaned and securely capped or
plugged.
• All equipment associated with tank(s) must be removed(pumps, fill boxes, monitoring and high-level alarm
systems,vents,gauges,etc.).
4. A representative from this office must be present during the collection of all soil/water samples at the approved
locations, and to visually inspect the closure of the tank(s) and all piping. All samples must be sent for laboratory
testing by a NYSDOH FLAP approved laboratory for analysis using EPA Test Methods 8260(VOC's), 8270 (Semi-
VC C's)and RCRA 8 Metals(for waste oil tanks).
5. If soil or groundwater is observed to be contaminated,or if oil spills or leaks occur during the tank closure process, it
must be reported to NYSDEC's Spill Hotline at(800)457-7362 within 2 hours.
6. If a spill is documented, an inspection by a NYSDEC representative will be required prior to backfilling unless
directed otherwise.
7. Additional sampling or remediation may be required by NYSDEC for any spills identified during the closure
activities.
To finalize the project, a Closure Report must be submitted to this office for approval within 90 days of physical closure of the
tank(s). The Closure Report shall be prepared and signed by a New York State licensed professional engineer or a qualified
environmental professional.The Closure Report shall include at a minimum.,a brief description of closure activities performed,
a description of any deviations from the approved work plan, the quantity and locations of any samples collected, a table
showing sample results compared to Standards,Criteria and Guidance (SCG), and any SDEC spill number associated with
the tank closure. An updated tank registration must also be submitted which indicates a change of status within 30 days
of the closure of all USTs.
Please note that engineering plans must be submitted to this office and a permit to construct must be obtained prior to any new
tank(s)being installed.
Contact the local building department and/or fire safety enforcement office for any additional requirements that may apply to
your project.
Issuance of this approval does not supersede any existing agreements with,compliance dates agreed to,or mandates by
the Office of Pollution Control or any other government agency.

Dear Applicant.
Based on the information you submitted, the Department of Environmental Conservation has
determined that the portion of the above referenced property which is located landward of the
functional and substantial man--made structure (a bulkhead) greater than 100 feet in length, which
was constructed prior to 8/2011977, as evidenced by NYSDEC's Tidal Wetland Aerial Photomap
#706 538, the 1974 Tidal Wetlands Map 1R 965, and currently shown on the survey prepared by All
County Land Surveyor PC, last revised on 3/17/2025, is beyond the jurisdiction of the Article 25
Tidal 'Wetlands Act. Therefore, no permit is required for work landward of this structure.
Be advised, no construction, sedimentation, or disturbance of any kind may take place seaward of the
tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to
ensure that all precautions are taken to prevent any sedimentation or disturbance within Article 25
jurisdiction which may result from your project. Such precautions may include maintaining adequate
work area between the jurisdictional boundary and your project (i.e. a 15'wide construction area) or
erecting a temporary fence, barrier, or hay bale berm.
In addition, please be advised that DEC has documented the summer occurrence of the
Northern Long Eared Bat (NLEB) (!yobs septentrionalfs), a species listed as "endangered" by
both New York State and the US Fish &Wildlife Service, within 3 miles of the project location.
We have determined that tree cutting at this location between March 1 and November 30 of any
calendar year may result in the "take" of these endangered/threated species or their habitat within the
meaning of Environmental Conservation Law (ECL) §11-535. The term "take" is defined in part as the
direct killing or injury of individual members of a protected species, interference with critical breeding,
foraging, migratory or other essential behaviors, or the adverse modification of the species' habitat.
The "take" of a species listed as endangered or threatened is prohibited in the absence of a permit
from this Department issued pursuant to ECL§11-535.
In order to avoid an Endangered Species "take", no tree cutting activities should be
conducted at the project site between the dates of March 1 and November 30 of any calendar
year.

Project Description: Remove underground storage tanks and associated

Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
site plan prepared by Island Pump & Yank, received on April 17, 2026, and
stamped approved on May 13, 2026.

If the proposed activities do not meet the requirements for issuance of an

This office has reviewed your,application.The collection of endpoint soil/water samples at the locations indicated in your work
plan for the required site assessment have been found to be in accordance with the Suffolk County Sanitary Code Articles
1.2/1 .Your Tank Closure application has been approved with the following conditions:
1. The Office of Pollution Control must be notified at least two (2) days in advance of all Tank Closure related work.
Please call this office at 631-854-2534 to schedule the tank closure inspection.
. You must notify the New York Mate Department of Environmental Conservation NYSD C)Region 1 Spills Unit of
any PBS regulated underground storage tank (UST) closure(s) by nailing, facing or e-mailing the attached
notification form to DEC at least 5 days in advance of the proposed date of the work..
3. The tank(s) must be closed in accordance with the Suffolk County Sanitary Code Articles 1.2/1 . All work roust be
completed as described in the approved Work Plan and/or at the discretion of the inspector and field,.. conditions. As
this approval is based on information provided in. the Work Plain., this department reserves the right to amend the
requirements,as deemed necessary. Minimum requirements include the following:
Approximately 12 sidewa.11 soil endpoint samples are anticipated to be collected around the entire tank field..
Five(5)groundwater samples to be taken from the monitoring and tank field wells and within the excavation.
0 One(1)soil endpoint sample will be collected from beneath each of the three(3)dispensers.
